    |
0011|     RELATING TO MOTOR VEHICLES; PROVIDING FOR THE USE OF YEAR-OF-
    |
0012|     MANUFACTURE LICENSE PLATES FOR ANTIQUE MOTOR VEHICLES; ENACTING
    |
0013|     A SECTION OF THE MOTOR VEHICLE CODE.

0015|     BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF NEW MEXICO:
    |
0016|          Section 1.  A new section of the Motor Vehicle Code is
    |
0017|     enacted to read:
    |
0018|          "[NEW MATERIAL]  YEAR-OF-MANUFACTURE LICENSE PLATES--
    |
0019|     PROCEDURES--FEES.--
    |
0020|               A.  The division may specially register and permit
    |
0021|     the use of year-of-manufacture license plates on motor vehicles
    |
0022|     thirty or more years old.
    |
0023|               B.  The division shall inspect the year-of-
    |
0024|     manufacture license plate to ensure the plate is in good
    |
0025|     condition and the number on the plate is not already assigned
    |
0001|     or in use.  To qualify for use, the year-of-manufacture plate
    |
0002|     shall be an authentic plate issued in New Mexico during the
    |
0003|     motor vehicle's model year.
    |
0004|               C.  For a one-time fee of twenty-five dollars
    |
0005|     ($25.00), which shall be in addition to the regular motor
    |
0006|     vehicle registration fees, any owner of a motor vehicle that is
    |
0007|     thirty or more years old may apply to the division to use a
    |
0008|     year-of-manufacture plate on his vehicle.
    |
0009|               D.  Upon the sale or transfer of a motor vehicle
    |
0010|     bearing a year-of-manufacture plate, the plate shall remain
    |
0011|     with the vehicle and be transferred to the new owner."

0008|   payment of a ten dollar ($10.00) transfer fee in addition to the
    |
0009|   regular motor vehicle registration fees,".

0011|        2.  On page 2, line 11, strike the quotation mark.
    |

0013|        3.  On page 2, between lines 11 and 12, insert the following
    |
0014|   new subsection:
    |

0016|             "E.  Ten dollars ($10.00) of the fee collected
    |
0017|   pursuant to Subsection C of this section shall be retained by the
    |
0018|   department and is appropriated to the department to defray the
    |
0019|   cost of issuing the special year-of-manufacture registration
    |
0020|   plates."".

0009|           "C.  State legislator member coverage plan 1 is also
    |
0010|   applicable to a state legislator who:

0012|                (1)  was unable to become a member or unable to
    |
0013|   make member contributions during the period from December 29,
    |
0014|   1988 through July 15, 1996 because administration of state
    |
0015|   legislator member coverage plan 1 was suspended due to
    |
0016|   litigation; and
    |
0017|   
    |
0018|                (2)  because of the death of the legislator after
    |
0019|   the November 22, 1995 New Mexico supreme court decision in
    |
0020|   Udall v. P.E.R.B. et al. 120 N.M. 786 (1995) but prior to
    |
0021|   June 15, 1996, was unable to comply with the public employees
    |
0022|   retirement association June 15, 1996 rule establishing procedures
    |
0023|   for acquiring benefits.  The eligible surviving spouse of the
    |
0024|   legislator, as defined by Section 10-11-14.5 NMSA 1978, may on
    |
0025|   behalf of the legislator enroll in the plan by making application
    |
0001|   and paying member contributions as the association may
    |
0002|   prescribe."".
