Section 22-8-23 NMSA 1978 (being Laws 1975, | 0017| Chapter 119, Section 1, as amended) is amended to read: | 0018| "22-8-23. SIZE ADJUSTMENT PROGRAM UNITS.-- | 0019| A. An approved public school with a MEM of less | 0020| than 400, including early childhood education full-time- | 0021| equivalent MEM but excluding special education class C and | 0022| class D MEM, is eligible for additional program units. | 0023| Separate schools established to provide special programs, | 0024| including but not limited to vocational and alternative | 0025| education, shall not be classified as public schools for | 0001| purposes of generating size adjustment program units. The | 0002| number of additional program units to which a school district | 0003| is entitled under this subsection is the sum of elementary- | 0004| junior high units and senior high units computed in the | 0005| following manner: | 0006| Elementary-Junior High Units | 0007| 200 - MEM x 1.0 x MEM = Units | 0008| 200 | 0009| where MEM is equal to the membership of an approved elementary | 0010| or junior high school, including early childhood education | 0011| full-time-equivalent membership but excluding special education | 0012| class C and class D membership; | 0013| Senior High Units | 0014| 200 - MEM x 2.0 x MEM = Units | 0015| 200 | 0016| or, | 0017| Senior High Units | 0018| 400 - MEM x 1.6 x MEM = Units | 0019| 400 | 0020| whichever calculation for senior high units is higher, where | 0021| MEM is equal to the membership of an approved senior high | 0022| school, excluding special education class C and class D | 0023| membership. | 0024| B. A school district with total MEM of less than | 0025| 4,000, including early childhood education full-time-equivalent | 0001| MEM and special education MEM, is eligible for additional | 0002| program units. The number of additional program units to which | 0003| a district is entitled under this subsection is the number of | 0004| district units computed in the following manner: | 0005| District Units | 0006| 4000 - MEM x 0.15 x MEM = Units | 0007| 4000 | 0008| where MEM is equal to the total district membership, including | 0009| early childhood education full-time-equivalent membership and | 0010| special education membership. | 0011| C. A school district with over 10,000 MEM with a | 0012| ratio of MEM to senior high schools less than 4,000:1 is | 0013| eligible for additional program units based on the number of | 0014| approved regular senior high schools that are not eligible for | 0015| senior high units under Subsection A of this section. The | 0016| number of additional program units to which an eligible school | 0017| district is entitled under this subsection is the number of | 0018| units computed in the following manner: | 0019| 4000 - MEM x 0.50 = Units | 0020| Senior High Schools | 0021| where MEM is equal to the total district membership, including | 0022| early childhood education full-time-equivalent membership and | 0023| special education membership, and where senior high schools are | 0024| equal to the number of approved regular senior high schools in | 0025| the district. | 0001| [D. A school district with a total MEM of greater | 0002| than ten thousand but less than fifteen thousand, including | 0003| early childhood education full-time equivalent MEM and special | 0004| education MEM, is eligible for additional program units. The | 0005| number of additional program units to which an eligible | 0006| district is entitled under this subsection is the number of | 0007| units computed in the following manner: | 0008| MEM - 10,000 x .15 x MEM = Units | 0009| 10,000 | 0010| where MEM is equal to the total district membership, including | 0011| early childhood education full-time equivalent membership and | 0012| special education membership. | 0013| E. A school district with a total MEM of greater | 0014| than fifteen thousand but less than thirty-five thousand, | 0015| including early childhood education full-time equivalent MEM | 0016| and special education MEM, is eligible for additional program | 0017| units. The number of additional program units to which an | 0018| eligible district is entitled under this subsection is the | 0019| number of units computed in the following manner: | 0020| MEM - 15,000 x .15 x MEM = Units | 0021| 15,000 | 0022| where MEM is equal to the total district membership, including | 0023| early childhood education full-time equivalent membership and | 0024| special education membership. | 0025| F. A school district with a total MEM of greater | 0001| than thirty-five thousand, including early childhood education | 0002| full-time equivalent MEM and special education MEM, is eligible | 0003| for additional program units. The number of additional program | 0004| units to which an eligible district is entitled under this | 0005| subsection is the number of units computed in the following | 0006| manner: | 0007| MEM - 35,000 x .023 x MEM = Units | 0008| 35,000 | 0009| where MEM is equal to the total district membership, including | 0010| early childhood education full-time equivalent membership and | 0011| special education membership.]" | 0012|  |
