0011| RELATING TO MOTOR VEHICLES; CHANGING CERTAIN DISCLOSURE
|
0012| REQUIREMENTS.
|

0014| BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF NEW MEXICO:
|
0015| Section 1. Section 57-12-6 NMSA 1978 (being Laws 1971,
|
0016| Chapter 274, Section 1, as amended) is amended to read:
|
0017| "57-12-6. MISREPRESENTATION OF MOTOR VEHICLES--
|
0018| PENALTY.--
|
0019| A. The willful misrepresentation of the age or
|
0020| condition of a motor vehicle by any person, including
|
0021| [regrooving tires or] performing chassis repair, without
|
0022| informing the purchaser of the vehicle that the [regrooving
|
0023| or] chassis repair has been performed, is an unlawful practice
|
0024| within the meaning of the Unfair Practices Act, unless the
|
0025| alleged misrepresentation is based wholly on repair of damage,
|
0001| the disclosure of which was not required pursuant to Subsection
|
0002| C of this section. The failure to provide [an affidavit] a
|
0003| statement signed by the seller pursuant to Subsection B of
|
0004| this section when there has been repair for which disclosure is
|
0005| required shall constitute prima facie evidence of willful
|
0006| misrepresentation.
|
0007| B. Except as provided in Subsections C and D of
|
0008| this section, a seller of a motor vehicle shall furnish at the
|
0009| time of sale of a motor vehicle [an affidavit] a statement
|
0010| that:
|
0011| (1) describes the vehicle; and
|
0012| (2) states to the best of the seller's
|
0013| knowledge whether there has been an alteration or chassis
|
0014| repair due to wreck damage.
|
0015| C. No [affidavit] statement shall be required
|
0016| pursuant to this section if the flat rate manual cost of the
|
0017| alteration or chassis repair is less than six percent of the
|
0018| sales price of the vehicle; except that the cost of the
|
0019| alteration or chassis repair, tires, glass, plastic and rubber
|
0020| parts replacements and cleanup of the vehicle shall be deducted
|
0021| from the sales price before calculating the six percent.
|
0022| D. In the case of a private-party sale of a
|
0023| vehicle, [an affidavit] a statement shall be furnished only
|
0024| upon the request of the purchasing party.
|
0025| E. Notwithstanding the provisions of Subsection D
|
0001| of Section 57-12-10 NMSA 1978, the award of three times actual
|
0002| damages as provided for in that section shall be in lieu of any
|
0003| award of punitive damages based only on those facts
|
0004| constituting the unfair or deceptive trade practice or
|
0005| unconscionable trade practice.
|
0006| F. Any person who violates this section is guilty
|
0007| of a misdemeanor."
