0011|     RELATING TO SUBSTANCE ABUSE TREATMENT; PROVIDING FOR REGULATION

0012|     OF ESTABLISHMENT AND MAINTENANCE OF METHADONE CLINICS.

0014|     BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF NEW MEXICO:
    |
0015|          Section 1.  METHADONE CLINICS--DEPARTMENT OF HEALTH
    |
0016|     REGULATION.--The department of health shall regulate the
    |
0017|     establishment and continuance of methadone clinics in New
    |
0018|     Mexico in accordance with its powers and duties as the state's
    |
0019|     public health agency pursuant to the Public Health Act and the
    |
0020|     state's drug abuse agency pursuant to the Drug Abuse Act. In
    |
0021|     regulating methadone clinics, the department shall perform an
    |
0022|     assessment of the need for the clinic and shall consider the
    |
0023|     appropriateness of the clinic location and the nearness of
    |
0024|     other clinics.  The department may consider such other factors
    |
0025|     it deems necessary to ensure the provision of drug abuse
    |
0001|     treatment services and the protection of the health and safety
    |
0002|     of New Mexico citizens.  For the purposes of this section,
    |
0003|     "methadone clinic" means a public or private facility for the
    |
0004|     detoxification treatment or maintenance treatment of narcotic
    |
0005|     addicts.
