0001| HOUSE BILL 1015 | 0002| 43rd legislature - STATE OF NEW MEXICO - first session, 1997 | 0003| INTRODUCED BY | 0004| MAX COLL | 0005| | 0006| | 0007| | 0008| | 0009| | 0010| AN ACT | 0011| RELATING TO CAPITAL EXPENDITURES; AUTHORIZING THE ISSUANCE OF | 0012| SEVERANCE TAX BONDS FOR CAPITAL PROJECTS IN SANTA FE COUNTY; | 0013| MAKING APPROPRIATIONS; DECLARING AN EMERGENCY. | 0014| | 0015| BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF NEW MEXICO: | 0016| Section 1. SEVERANCE TAX BONDS--AUTHORIZATIONS-- | 0017| APPROPRIATION OF PROCEEDS.-- | 0018| A. The state board of finance may issue and sell | 0019| severance tax bonds in compliance with the Severance Tax | 0020| Bonding Act in an amount not to exceed the total of the amounts | 0021| authorized for purposes specified in Sections 2 through 7 of | 0022| this act. The state board of finance shall schedule the | 0023| issuance and sale of the bonds in the most expeditious and | 0024| economical manner possible upon a finding by the board that the | 0025| project has been developed sufficiently to justify the issuance | 0001| and that the project can proceed to contract within a | 0002| reasonable time. The state board of finance shall further take | 0003| the appropriate steps necessary to comply with the Internal | 0004| Revenue Code of 1986, as amended. Proceeds from the sale of | 0005| the bonds are appropriated for the purposes specified in | 0006| Sections 2 through 7 of this act. | 0007| B. The agencies named in Sections 2 through 7 of | 0008| this act shall certify to the state board of finance when the | 0009| money from the proceeds of the severance tax bonds authorized | 0010| in this section is needed for the purposes specified in the | 0011| applicable section of this act. | 0012| C. If the specified agency has not certified the | 0013| need for the issuance of the bonds by the end of fiscal year | 0014| 1999, the authorization provided in this act shall be void. | 0015| D. Unless otherwise specified in this act, any | 0016| unexpended or unencumbered balance remaining from the proceeds | 0017| of severance tax bonds issued pursuant to Sections 2 through 7 | 0018| of this act at the end of fiscal year 2000 shall revert to the | 0019| severance tax bonding fund. | 0020| Section 2. SEVERANCE TAX BONDS--STATE DEPARTMENT OF | 0021| PUBLIC EDUCATION--PURPOSES.--Pursuant to the provisions of | 0022| Section 1 of this act, upon certification by the state | 0023| department of public education that the need exists for the | 0024| issuance of the bonds, the following amounts are appropriated | 0025| to the state department of public education for the following | 0001| purposes: | 0002| | 0003| A. four hundred fifty thousand dollars ($450,000) | 0004| for planning, designing, constructing and equipping or | 0005| purchasing, installing and equipping classrooms for the | 0006| alternative high school in the Santa Fe public school district | 0007| located in Santa Fe county; | 0008| B. three hundred ninety-eight thousand dollars | 0009| ($398,000) to purchase and install educational technology and | 0010| theater and dance floor equipment for the Santa Fe public | 0011| schools' dropout prevention program in Santa Fe county; and | 0012| C. five hundred twenty thousand dollars ($520,000) | 0013| to purchase and install educational technology for the Santa Fe | 0014| public schools' comprehensive student and staff database | 0015| program in Santa Fe county. | 0016| Section 3. SEVERANCE TAX BONDS--LOCAL GOVERNMENT DIVISION | 0017| OF THE DEPARTMENT OF FINANCE AND ADMINISTRATION--PURPOSE.-- | 0018| Pursuant to the provisions of Section 1 of this act, upon | 0019| certification by the local government division of the | 0020| department of finance and administration that the need exists | 0021| for the issuance of the bonds, three million eighteen thousand | 0022| dollars ($3,018,000) is appropriated to the local government | 0023| division of the department of finance and administration for | 0024| the purpose of constructing, equipping and furnishing a school- | 0025| community library in Eldorado located in Santa Fe county. | 0001| Section 4. SEVERANCE TAX BONDS--NEW MEXICO SCHOOL FOR THE | 0002| DEAF--PURPOSE.--Pursuant to the provisions of Section 1 of this | 0003| act, upon certification by the board of regents of the New | 0004| Mexico school for the deaf that the need exists for the | 0005| issuance of the bonds, five hundred thousand dollars ($500,000) | 0006| is appropriated to the board of regents of the New Mexico | 0007| school for the deaf for the purpose of campus improvements, | 0008| including roof repairs, completion of construction of the | 0009| library and dormitory, for equipping the television-media | 0010| studio, for purchasing vehicles for student transportation and | 0011| for maintenance at the New Mexico school for the deaf located | 0012| in Santa Fe county. | 0013| Section 5. SEVERANCE TAX BONDS--SANTA FE COMMUNITY | 0014| COLLEGE--PURPOSE.--Pursuant to the provisions of Section 1 of | 0015| this act, upon certification by the community college board of | 0016| Santa Fe community college that the need exists for the | 0017| issuance of the bonds, two million dollars ($2,000,000) is | 0018| appropriated to the community college board of Santa Fe | 0019| community college for the purpose of planning, designing, | 0020| constructing and equipping an instructional technology center | 0021| at Santa Fe community college located in Santa Fe county. | 0022| Section 6. SEVERANCE TAX BONDS--OFFICE OF CULTURAL | 0023| AFFAIRS--PURPOSE.--Pursuant to the provisions of Section 1 of | 0024| this act, upon certification by the office of cultural affairs | 0025| that the need exists for the issuance of the bonds, nine | 0001| hundred thousand dollars ($900,000) is appropriated to the | 0002| office of cultural affairs for the purpose of making | 0003| improvements to the Camino Lejo museum complex located in Santa | 0004| Fe county. | 0005| Section 7. SEVERANCE TAX BONDS--STATE HIGHWAY AND | 0006| TRANSPORTATION DEPARTMENT--PURPOSES.--Pursuant to the | 0007| provisions of Section 1 of this act, upon certification by the | 0008| state highway and transportation department that the need | 0009| exists for the issuance of the bonds, the following amounts are | 0010| appropriated to the state highway and transportation department | 0011| for the following purposes: | 0012| A. six hundred fifty thousand dollars ($650,000) | 0013| for the purpose of planning, designing and making improvements | 0014| to Botulph road, including necessary drainage and sewer | 0015| improvements, in the city of Santa Fe located in Santa Fe | 0016| county; | 0017| B. thirty thousand dollars ($30,000) for | 0018| improvements to county road 60A at the Canada Ancha crossing | 0019| located in Santa Fe county; and | 0020| C. eighteen thousand dollars ($18,000) for | 0021| improvements to county road 69 at the Arroyo Hondo crossing | 0022| located in Santa Fe county. | 0023| Section 8. EMERGENCY.--It is necessary for the public | 0024| peace, health and safety that this act take effect immediately. | 0025|  |
