0016| BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF NEW MEXICO:
|
0017| Section 1. Section 29-7-7 NMSA 1978 (being Laws 1981,
|
0018| Chapter 114, Section 6, as amended) is amended to read:
|
0019| "29-7-7. DEFINITIONS.--For the purpose of the Law
|
0020| Enforcement Training Act:
|
0021| A. "academy" means the New Mexico law enforcement
|
0022| academy;
|
0023| B. "basic law enforcement training" means a course
|
0024| consisting of not less than four hundred hours of instruction
|
0025| in basic law enforcement training as required by the Law
|
0001| Enforcement Training Act;
|
0002| C. "board" means the New Mexico law enforcement
|
0003| academy board;
|
0004| D. "conviction" means an adjudication of guilt or a
|
0005| plea of no contest and includes convictions that are suspended
|
0006| or deferred;
|
0007| E. "director" means the director of the academy;
|
0008| F. "in-service law enforcement training" means a
|
0009| course of instruction required of all certified peace officers
|
0010| designed to train and equip all police officers in the state
|
0011| with specific law enforcement skills and to ensure the
|
0012| continuing development of all police officers in the state.
|
0013| The training and instruction shall be kept current and may be
|
0014| conducted on a regional basis at the discretion of the
|
0015| director;
|
0016| G. "police officer" means any commissioned employee
|
0017| of a law enforcement agency that is part of or administered by
|
0018| the state or any political subdivision of the state or a
|
0019| civilian law enforcement agency on a federal installation and
|
0020| which employee is responsible for the prevention and detection
|
0021| of crime or the enforcement of the penal or traffic or highway
|
0022| laws of this state. The term specifically includes deputy
|
0023| sheriffs. Sheriffs are eligible to attend the academy and are
|
0024| eligible to receive certification as provided in the Law
|
0025| Enforcement Training Act. As used in this subsection,
|
0001| "commissioned" means an employee of a law enforcement agency
|
0002| who is authorized by a sheriff or chief of police to apprehend,
|
0003| arrest and bring before the court all violators within the
|
0004| state; and
|
0005| H. "certified regional law enforcement training
|
0006| facility" means a law enforcement training facility within the
|
0007| state certified by the director, with the approval of the
|
0008| academy's board of directors, that offers basic law enforcement
|
0009| training and in-service law enforcement training that is
|
0010| comparable to or exceeds the standards of the programs of the
|
0011| academy."

0012| Section 2. Section 29-7-7.1 NMSA 1978 (being Laws 1981,
|
0013| Chapter 114, Section 7, as amended) is amended to read:
|
0014| "29-7-7.1. IN-SERVICE LAW ENFORCEMENT TRAINING--
|
0015| REQUIREMENTS--ELIGIBILITY.--
|
0016| A. In-service law enforcement training consists of
|
0017| at least forty hours of academic instruction, approved by the
|
0018| board, for each certified police officer during each twenty-
|
0019| four month period of employment or service with a political
|
0020| subdivision or civilian police agency of a federal
|
0021| installation. The first training course shall commence no
|
0022| later than twelve months after graduation from an approved
|
0023| basic law enforcement training program.
|
0024| B. All certified police officers who are eligible
|
0025| for in-service training shall, during each twenty-four month
|
0001| period of employment, complete a minimum of forty hours of in-
|
0002| service law enforcement training in courses approved by the
|
0003| board. All certified police officers shall provide proof of
|
0004| completing in-service law enforcement training requirements to
|
0005| the director no later than March 1 of the year in which the
|
0006| requirements must be met. The director shall provide annual
|
0007| notice to all certified police officers regarding in-service
|
0008| law enforcement training requirements. Failure to complete in-
|
0009| service law enforcement training requirements may be grounds
|
0010| for suspension of a certified police officer's certification.
|
0011| A police officer's certification may be reinstated by the board
|
0012| when the police officer presents the board with evidence of
|
0013| satisfying in-service law enforcement training requirements."
