0011|     RELATING TO ENGINEERING EXEMPTIONS; AMENDING SECTION 61-23-22

0012|     NMSA 1978 (BEING LAWS 1993, CHAPTER 218, SECTION 17).

0014|     BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF NEW MEXICO:
    |
0015|          Section 1.  Section 61-23-22 NMSA 1978 (being Laws 1993,
    |
0016|     Chapter 218, Section 17) is amended to read:
    |
0017|          "61-23-22.  ENGINEERING--EXEMPTIONS.--
    |
0018|               A.  A New Mexico licensed architect who has complied
    |
0019|     with all of the laws of New Mexico relating to the practice of
    |
0020|     architecture has the right to engage in the incidental
    |
0021|     practice, as defined by regulation, of activities properly
    |
0022|     classified as engineering; provided that the architect shall
    |
0023|     not hold himself out to be an engineer or as performing
    |
0024|     engineering services; and further provided that the architect
    |
0025|     shall perform only that part of the work for which he is
    |
0001|     professionally qualified and shall utilize qualified
    |
0002|     professional engineers or others for those portions of the work
    |
0003|     in which the contracting architect is not qualified. 
    |
0004|     Furthermore, the architect shall assume all responsibility for
    |
0005|     compliance with all laws, codes, regulations and ordinances of
    |
0006|     the state or its political subdivisions pertaining to all
    |
0007|     documents bearing his professional seal.
    |
0008|               <s>[B.  Officers and employees of the government of
</s>    |
<s></s>0009| <s>    the United States engaged in the practice of engineering
</s>    |
<s></s>0010| <s>    insofar that the work involved in said practice is limited and
</s>    |
<s></s>0011| <s>    restricted to within federal government property shall be
</s>    |
<s></s>0012| <s>    exempt from the provisions of the Engineering and Surveying
</s>    |
<s></s>0013| <s>    Practice Act.  Any connection or joining of work to other work
</s>    |
<s></s>0014| <s>    outside of the federal property shall require that the
</s>    |
<s></s>0015| <s>    connection or joining be specified by engineers registered
</s>    |
<s></s>0016| <s>    under the provisions of that act.
</s>    |
<s></s>0017| <s>              C.]</s> <u>B.</u>  An engineer employed by a firm,
    |
0018|     association or corporation who performs only the engineering
    |
0019|     services involved in the operation of the employer's business
    |
0020|     shall be exempt from the provisions of the Engineering and
    |
0021|     Surveying Practice Act, provided that neither the employee nor
    |
0022|     the employer offers engineering services to the public."
    |
0023|          Section 2.  TEMPORARY EFFECT.--The provisions of Section 1
    |
0024|     of this act shall be effective until July 1, 2000.
