0011| RELATING TO THE ATTORNEY GENERAL; AMENDING A SECTION OF THE

0012| NMSA 1978 TO BRING THE EMPLOYEES OF THE ATTORNEY GENERAL UNDER

0013| THE PERSONNEL ACT.

0015| BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF NEW MEXICO:
|
0016| Section 1. Section 8-5-5 NMSA 1978 (being Laws 1933,
|
0017| Chapter 21, Section 5, as amended) is amended to read:
|
0018| "8-5-5. ASSISTANT ATTORNEYS GENERAL--OTHER EMPLOYEES--
|
0019| APPOINTMENT.--
|
0020| A. Within legislative appropriations, the attorney
|
0021| general may appoint [a] deputy [attorney] attorneys gen-
|
0022|
|
0023| eral, [and as many] other assistant attorneys general
|
0024| [together with] and stenographic, clerical and other
|
0025| necessary employees [on a full- or part-time basis, at
|
0001| salaries to be fixed by him within budget allowances and ap-
|
0002|
|
0003| propriation limits, as the business of the department shall
|
0004| require and who shall hold office at the pleasure of the
|
0005| attorney general]. The deputy [attorney] attorneys
|
0006| general and the assistant attorneys general shall, subject to
|
0007| the direction of the attorney general, have the same power and
|
0008| authority as the attorney general.

0009| B. Within legislative appropriations, the attorney
|
0010| general may appoint full-time salaried members of his staff as
|
0011| peace officers for the full-time investigation of violations
|
0012| of, [and] and the full-time enforcement of, the criminal laws
|
0013| of the state. These employees shall comply with the
|
0014| certification provisions of [Section 29-7-8 NMSA l978] the
|
0015| Law Enforcement Training Act.

0016| C. Employees of the attorney general are subject
|
0017| to the provisions of the Personnel Act."
