0011| RELATING TO PUBLIC EDUCATION; PROVIDING FOR FAMILY INVOLVEMENT

0012| PROGRAMS IN SCHOOL DISTRICTS; CREATING THE COUNCIL ON FAMILY

0013| INVOLVEMENT.

0015| BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF NEW MEXICO:
|
0016| Section 1. A new section of the Public School Code is
|
0017| enacted to read:
|
0018| "[NEW MATERIAL] SHORT TITLE.--This act may be cited as
|
0019| the "Family Involvement Act"."
|
0020| Section 2. A new section of the Public School Code is
|
0021| enacted to read:
|
0022| "[NEW MATERIAL] LEGISLATIVE FINDINGS AND PURPOSE.--
|
0023| A. The legislature finds that the involvement and
|
0024| support of families in the education of their children is an
|
0025| integral part of improving academic achievement and that
|
0001| properly constructed family involvement programs can play an
|
0002| important and effective role in the participation of families
|
0003| in their children's schools and in improving children's
|
0004| learning.
|
0005| B. The purpose of the Family Involvement Act is to
|
0006| ensure that family involvement programs are properly designed
|
0007| and implemented and to provide a focus and structure for these
|
0008| programs based on prior experience and research while
|
0009| maintaining sufficient local flexibility to design a program
|
0010| that best meets the needs of the local community. The goals of
|
0011| these programs are to:
|
0012| (1) engage families from diverse cultures
|
0013| positively in their children's education by:
|
0014| (a) building effective and consistent
|
0015| methods of home-school communications;
|
0016| (b) supporting families in developing
|
0017| skills that enhance their children's academic efforts and their
|
0018| development as responsible members of society; and
|
0019| (c) helping professionals learn to work
|
0020| comfortably with diverse families and to view these families as
|
0021| valuable sources of information about their children;
|
0022| (2) inform families that they can directly
|
0023| affect the success of their children's learning, offer families
|
0024| various techniques and strategies to improve their children's
|
0025| academic success or assist their children in learning at home,
|
0001| if they desire; and
|
0002| (3) integrate family involvement programs,
|
0003| including compliance with the provisions of the Family
|
0004| Involvement Act, into a school's master plan for academic
|
0005| accountability."
|
0006| Section 3. A new section of the Public School Code is
|
0007| enacted to read:
|
0008| "[NEW MATERIAL] FAMILY INVOLVEMENT COUNCIL.--
|
0009| A. The "family involvement council" is created as
|
0010| an advisory council to the department of education.
|
0011| B. The council shall consist of nine members
|
0012| appointed by the state superintendent for staggered three-year
|
0013| terms as follows:
|
0014| (1) one representative of a statewide parent-
|
0015| teacher organization;
|
0016| (2) two parents or guardians of pupils
|
0017| enrolled in a public school;
|
0018| (3) two public school teachers;
|
0019| (4) one public school administrator;
|
0020| (5) one local school board member;
|
0021| (6) one representative of the business
|
0022| community; and
|
0023| (7) one department of education employee, who
|
0024| shall be the chairman of the council.
|
0025| C. The council shall:
|
0001| (1) develop an instrument or process to
|
0002| evaluate family involvement programs developed by local school
|
0003| boards;
|
0004| (2) make recommendations to the department of
|
0005| education about family involvement programs that are effective;
|
0006| (3) make recommendations to the department
|
0007| about training programs for local school boards and school
|
0008| staff;
|
0009| (4) make recommendations to the department
|
0010| about facilitating coordination among school officials, parents
|
0011| and families, educators and community leaders; and
|
0012| (5) make recommendations to the department
|
0013| about the coordination of department services and services of
|
0014| other state agencies.
|
0015| D. Members of the council who are not state
|
0016| employees may receive per diem and travel expenses pursuant to
|
0017| the Per Diem and Mileage Act."
|
0018| Section 4. A new section of the Public School Code is
|
0019| enacted to read:
|
0020| "[NEW MATERIAL] FAMILY INVOLVEMENT PROGRAM.--
|
0021| A. Each local school board shall, in conjunction
|
0022| with parents, teachers, administrators and community leaders,
|
0023| establish a family involvement program for each school in the
|
0024| school district. The local school board shall:
|
0025| (1) ensure that parents and families
|
0001| participate in the planning, design, implementation and
|
0002| evaluation of the family involvement program; and
|
0003| (2) provide for regular and periodic programs
|
0004| throughout the school year that offer learning opportunities
|
0005| for both families and school personnel in areas such as:
|
0006| (a) the ability of families to directly
|
0007| affect the success of a child's learning through the support
|
0008| given at home and at school;
|
0009| (b) home activities, strategies and
|
0010| materials that can be used to assist and enhance the learning
|
0011| of children at home and at school;
|
0012| (c) the developmental needs of children,
|
0013| positive guidance techniques and ways for parents and teachers
|
0014| to build healthy relationships with children; and
|
0015| (d) the ability of families and schools
|
0016| to develop consistent and effective communications concerning
|
0017| the progress of the children in school and concerning school
|
0018| programs;
|
0019| (3) prepare an annual statement identifying
|
0020| specific objectives of the program; and
|
0021| (4) conduct an annual review and assessment of
|
0022| the program's progress in meeting its objectives, which shall
|
0023| be made available to parents.
|
0024| B. A family involvement program may include the
|
0025| following:
|
0001| (1) a plan to encourage participation by
|
0002| families from diverse cultures;
|
0003| (2) a program that builds on parenting
|
0004| strengths, helps families develop skills they desire and
|
0005| facilitates networks to support families in effectively
|
0006| nurturing their children;
|
0007| (3) a communication element that provides
|
0008| effective two-way communication practices to reach families,
|
0009| both individually and collectively, to ensure that families and
|
0010| school staff communicate back and forth about their children;
|
0011| (4) a home learning element that provides for
|
0012| families and staff to work together in developing learning
|
0013| goals and offers opportunities for learning activities at home
|
0014| and in the community;
|
0015| (5) a volunteer element that recruits and
|
0016| organizes volunteer participation from families and the
|
0017| community at large;
|
0018| (6) a governance and advocacy element that
|
0019| provides a democratic governance structure that ensures that
|
0020| parents are partners in policy making about school programs and
|
0021| that family representatives are elected to act as advocates or
|
0022| decision makers for other parents and families; and
|
0023| (7) a community outreach element that
|
0024| establishes partnerships with individuals and organizations in
|
0025| the community.

0001| (8) a plan to encourage parents to visit
|
0002| schools, which may include an area in each school designated as
|
0003| a family center."
|
0004| Section 5. EFFECTIVE DATE.--The effective date of the
|
0005| provisions of this act is July 1, 1997.

0011| department of public education for expenditure in fiscal year

0012| 1998 for expenses of the family involvement council. Any
|
0013| unexpended or unencumbered balance remaining at the end of fiscal
|
0014| year 1998 shall revert to the general fund.".

0016| 4. Renumber the succeeding section accordingly.,

0018| and thence referred to the APPROPRIATIONS AND FINANCE
|
0019| COMMITTEE.
