0011| RELATING TO CRIMINAL LAW; MAKING IT UNLAWFUL TO BRING

0012| CONTRABAND INTO A JUVENILE JUSTICE FACILITY; PROVIDING
|
0013| PENALTIES; ENACTING A NEW SECTION OF THE CRIMINAL CODE.

0015| BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF NEW MEXICO:
|
0016| Section 1. A new section of the Criminal Code is enacted
|
0017| to read:
|
0018| "[NEW MATERIAL] BRINGING CONTRABAND INTO A JUVENILE
|
0019| JUSTICE FACILITY--PENALTY.--
|
0020| A. Bringing contraband into a juvenile justice
|
0021| facility consists of carrying, transporting or depositing
|
0022| contraband onto the grounds of any facility designated by the
|
0023| children, youth and families department for the detention or
|
0024| commitment of children. Whoever commits bringing contraband
|
0025| into a juvenile justice facility is guilty of a third degree
|
0001| felony.
|
0002| B. As used in this section, "contraband" means:
|
0003| (1) any deadly weapon, as defined in Section
|
0004| 30-1-12 NMSA 1978, or an essential component part thereof,
|
0005| including ammunition, explosive devices and explosive
|
0006| materials, but does not include a weapon carried by a peace
|
0007| officer in the lawful discharge of his duties;
|
0008| (2) currency brought onto the grounds of a
|
0009| juvenile justice facility for the purpose of transfer to a
|
0010| child detained in or committed to the facility;
|
0011| (3) any alcoholic beverage; or
|
0012| (4) any controlled substance, as defined in
|
0013| the Controlled Substances Act, but does not include a
|
0014| controlled substance carried into a juvenile justice facility
|
0015| through regular facility channels and pursuant to the direction
|
0016| or prescription of a regularly licensed physician."
|
0017| Section 2. EFFECTIVE DATE.--The effective date of the
|
0018| provisions of this act is July 1, 1997.

0002| guilty of a fourth degree felony.".

0004| 6. On page 2, line 9, strike "justice" and insert in lieu

0005| thereof "detention facility or juvenile correctional".

0007| 7. On page 2, line 9, after "facility" insert ", and not
|
0008| declared upon entry to the facility,".
|

0010| 8. On page 2, line 10, after "facility" insert ", but does
|
0011| not include currency carried into areas designated by the
|
0012| facility administrator as areas for the deposit and receipt of
|
0013| currency for credit to a child's account before contact is made
|
0014| with any child".

0016| 9. On page 2, line 11, after "beverage" insert "brought
|
0017| within the physical confines of the juvenile detention or
|
0018| juvenile correctional facility".

0020| 10. On page 2, line 14, strike "justice" and insert in lieu
