0011| RELATING TO PUBLIC EMPLOYEES; PROVIDING FOR PURCHASE OF SERVICE

0012| CREDIT FOR RETIREMENT PURPOSES BY CERTAIN PUBLIC EMPLOYEES FOR
|
0013| CERTAIN PRIOR EMPLOYMENT WITH THE UNITED STATES DEPARTMENT OF
|
0014| ENERGY.

0016| BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF NEW MEXICO:
|
0017| Section 1. Section 10-11-141 NMSA 1978 (being Laws 1993,
|
0018| Chapter 29, Section 1, as amended) is amended to read:
|
0019| "10-11-141. PURCHASE OF SERVICE CREDIT.--An affiliated
|
0020| public employer that assumes a firefighting function previously
|
0021| provided by the United States government may, at the time of
|
0022| the assumption of the firefighting function, provide credited
|
0023| service for retirement board purposes to any employees who were
|
0024| previously employed by a firefighting unit of the United States
|
0025| government in connection with the assumed firefighting function
|
0001| or were previously employed as guards or couriers in a
|
0002| protective force of the United States government. The
|
0003| credited service may be provided by the affiliated public
|
0004| employer subject to the following conditions:
|
0005| A. the employee shall pay to the [public
|
0006| employees'] retirement board the difference between the
|
0007| actuarial present value of association benefits likely to be
|
0008| paid the employee computed with and without the United States
|
0009| government service;
|
0010| B. the employee, within one year of the assumption
|
0011| of the governmental function, irrevocably forfeits all rights
|
0012| based upon employee contributions in and to the immediate
|
0013| vested or nonvested retirement benefits under the retirement
|
0014| program of the United States government in which the employee
|
0015| was participating immediately prior to the assumption of the
|
0016| governmental function; and
|
0017| C. the payments made under Subsections A and B of
|
0018| this section shall be made in a lump sum or by entering into an
|
0019| installment contract for up to thirty-six months with the
|
0020| retirement board at the regular interest rates and under the
|
0021| standard conditions set for such installment contracts by that
|
0022| board. The employee may purchase service credit equivalent to
|
0023| the employee's service in a firefighting unit of the United
|
0024| States department of energy or as a guard or courier in a
|
0025| protective force of the United States department of energy.
|
0001| The employee shall make a written election concerning payment
|
0002| not later than December 1, [1996] 1997, and any election
|
0003| made thereafter shall be void."

0008| "Section 2. EFFECTIVE DATE--CONTINGENCY--INTERNAL REVENUE SERVICE
|
0009| RULING.--On or before April 30, 1997, the public employees retirement
|
0010| association shall seek a ruling from the internal revenue service that
|
0011| this 1997 act does not jeopardize the qualified status of the public
|
0012| employees retirement plan. The provisions of this act shall become
|
0013| effective on the date that the association receives a favorable ruling.
|
0014| If the association receives an unfavorable ruling, the provisions of
|
0015| this 1997 act are null and void.".
