0011| RELATING TO CRIMINAL LAW; REVISING THE ELEMENTS OF THE CRIMINAL
|
0012| OFFENSE OF ABUSE OF A CHILD; AMENDING A SECTION OF THE NMSA
|

0015| BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF NEW MEXICO:
|
0016| Section 1. Section 30-6-1 NMSA 1978 (being Laws 1973,
|
0017| Chapter 360, Section 10, as amended) is amended to read:
|
0018| "30-6-1. ABANDONMENT OR ABUSE OF A CHILD.--
|
0019| A. As used in this section:
|
0020| (1) "child" means a person who [has not
|
reached his age of majority] is less than eighteen years of
|
0022| age; [and]
|
0023| (2) "neglect" means that a child is without
|
0024| proper parental care and control of subsistence, education,
|
0025| medical or other care or control necessary for his well-being
|
0001| because of the faults or habits of his parents, guardian or
|
0002| custodian or their neglect or refusal, when able to do so, to
|
0003| provide them; and
|
0004| (3) "negligently" refers to criminal negligence
|
0005| and means that a person knew or should have known of the danger
|
0006| involved and acted with a reckless disregard for the safety or
|
0007| health of the child.
|
0008| B. Abandonment of a child consists of the parent,
|
0009| guardian or custodian of a child intentionally leaving or
|
0010| abandoning the child under circumstances whereby the child may
|
0011| or does suffer neglect. Whoever commits abandonment of a child
|
0012| is guilty of a misdemeanor, unless the abandonment results in
|
0013| the child's death or great bodily harm, in which case he is
|
0014| guilty of a second degree felony.
|
0015| C. Abuse of a child consists of a person knowingly,
|
0016| intentionally or negligently, and without justifiable cause,
|
0017| causing or permitting a child to be:
|
0018| (1) placed in a situation that may endanger
|
0019| the child's life or health;
|
0020| (2) tortured, cruelly confined or cruelly
|
0021| punished; or
|
0022| (3) exposed to the inclemency of the weather.
|
0023| Whoever commits abuse of a child which does not result in
|
0024| the child's death or great bodily harm is, for a first offense,
|
0025| guilty of a third degree felony and for second and subsequent
|
0001| offenses is guilty of a second degree felony. If the abuse
|
0002| results in great bodily harm or death to the child, he is
|
0003| guilty of a first degree felony."
|
0004| Section 2. EFFECTIVE DATE.--The effective date of the
|
0005| provisions of this act is July 1, 1997.
