0011| AMENDING SECTION 24-10-3 NMSA 1978 (BEING LAWS 1963, CHAPTER

0012| 59, SECTION 1) COMMONLY REFERRED TO AS THE "GOOD SAMARITAN"

0013| LAW, TO CLARIFY THE SCOPE OF THE IMMUNITY FROM LIABILITY
|
0014| GRANTED.

0016| BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF NEW MEXICO:
|
0017| Section 1. Section 24-10-3 NMSA 1978 (being Laws 1963,
|
0018| Chapter 59, Section 1) is amended to read:
|
0019| "24-10-3. PERSONS COMING TO AID OR RESCUE OF ANOTHER
|
0020| RENDERING EMERGENCY CARE--RELEASE FROM LIABILITY.--No person
|
0021| who [shall administer emergency care] comes to the aid or
|
0022| rescue of another person by providing care or assistance in
|
0023| good faith at or near the scene of an emergency, as defined
|
0024| [herein] in Section 24-10-4 NMSA 1978, shall be held liable
|
0025| for any civil damages as a result of any action or omission by
|
0001| [such] that person in [administering said] providing
|
0002| that care or assistance, except [for] when guilty of
|
0003| gross negligence; [provided that] but nothing [herein]
|
0004| in this section [shall apply] applies to the
|
0005| [administering] provision of [such] emergency care or
|
0006| assistance [where the same] when it is rendered for
|
0007| remuneration or with the expectation of remuneration or is
|
0008| rendered by [any] a person or agent of a principal who was
|
0009| at the scene of the accident or emergency because he or his
|
0010| principal was soliciting business or performing or seeking to
|
0011| perform some services for remuneration."
