0011|     AMENDING SECTION 24-10-3 NMSA 1978 (BEING LAWS 1963, CHAPTER

0012|     59, SECTION 1) COMMONLY REFERRED TO AS THE "GOOD SAMARITAN"

0013|     LAW, TO CLARIFY THE SCOPE OF THE IMMUNITY FROM LIABILITY

0016|     BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF NEW MEXICO:
    |
0017|          Section 1.  Section 24-10-3 NMSA 1978 (being Laws 1963,
    |
0018|     Chapter 59, Section 1) is amended to read:
    |
0019|          "24-10-3. <u>PERSONS COMING TO AID OR RESCUE OF ANOTHER
</u>    |
<u></u>0020| <u>    RENDERING EMERGENCY CARE--RELEASE FROM LIABILITY</u>.--No person
    |
0021|     who <s>[shall administer emergency care]</s> <u>comes to the aid or
</u>    |
<u></u>0022| <u>    rescue of another person by providing care or assistance</u> in
    |
0023|     good faith at or near the scene of an emergency, as defined
    |
0024|     <s>[herein]</s> <u>in Section 24-10-4 NMSA 1978</u>, shall be held liable
    |
0025|     for any civil damages as a result of any action or omission by
    |
0001|     <s>[such]</s> <u>that</u> person in <s>[administering said]</s> <u>providing
</u>    |
<u></u>0002| <u>    that</u> care <u>or assistance</u>, except <s>[for]</s> <u>when guilty of</u>
    |
0003|     gross negligence; <s>[provided that]</s> <u>but</u> nothing <s>[herein]</s>
    |
0004|     <u>in this section</u> <s>[shall apply]</s> <u>applies</u> to the
    |
0005|     <s>[administering]</s> <u>provision</u> of <s>[such]</s> <u>emergency</u> care <u>or
</u>    |
<u></u>0006| <u>    assistance</u> <s>[where the same]</s> <u>when it</u> is rendered for
    |
0007|     remuneration or with the expectation of remuneration or is
    |
0008|     rendered by <s>[any]</s> <u>a</u> person or agent of a principal who was
    |
0009|     at the scene of the accident or emergency because he or his
    |
0010|     principal was soliciting business or performing or seeking to
    |
0011|     perform some services for remuneration."
