0011|     RELATING TO CHILD AND SPOUSAL SUPPORT; ENACTING A NEW SECTION

0012|     OF THE NMSA 1978 REGARDING INTEREST ON UNPAID SUPPORT.

0014|     BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF NEW MEXICO:
    |
0015|          Section 1.  ACCRUAL OF INTEREST ON DELINQUENT CHILD AND
    |
0016|     SPOUSAL SUPPORT.--
    |
0017|               A.  Interest accrues on delinquent child support and
    |
0018|     spousal support at the rate set forth in Section 56-8-4 NMSA
    |
0019|     1978 in effect when the support payment becomes due and accrues
    |
0020|     from the date the support is delinquent until the date the
    |
0021|     support is paid or consolidated in a judgment.
    |
0022|               B.  Interest accrues on a consolidated judgment for
    |
0023|     delinquent support at the rate provided in Section 56-8-4 NMSA
    |
0024|     1978 in effect when the consolidated judgment is entered until
    |
0025|     the judgment is satisfied.
    |
0001|               C.  Unless the order, judgment or decree specifies a
    |
0002|     due date other than the first day of the month, support shall
    |
0003|     be deemed due on the first day of each month and, if not paid
    |
0004|     by that date, shall be deemed delinquent.
    |
0005|               D.  Payments of support shall be first applied to
    |
0006|     the current support obligation, next to any accrued interest on
    |
0007|     delinquent support, next to any delinquent support, next to any
    |
0008|     interest accrued on a consolidated judgment of delinquent
    |
0009|     support and next to any consolidated judgment of delinquent
    |
0010|     support.
