0011| RELATING TO THE DWI OVERSIGHT TASK FORCE; ADDING THE PRESIDENT
|
0012| OF MOTHERS AGAINST DRUNK DRIVING AS AN ADVISORY MEMBER TO THE
|
0013| TASK FORCE; AMENDING A SECTION OF THE NMSA 1978.
|

0015| BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF NEW MEXICO:
|
0016| Section 1. Section 2-12-7 NMSA 1978 (being Laws 1993,
|
0017| Chapter 65, Section 16) is amended to read:
|
0018| "2-12-7. MEMBERSHIP--APPOINTMENT--VACANCIES.--
|
0019| A. The DWI oversight task force shall be composed
|
0020| of six legislative members, six public members and [thirteen]
|
0021| fourteen advisory members from the executive and judicial
|
0022| branches of government.
|
0023| B. Three members of the house of representatives
|
0024| shall be appointed by the speaker of the house of
|
0025| representatives and three members of the senate shall be
|
0001| appointed by the committees' committee of the senate or, if the
|
0002| senate appointments are made in the interim, by the president
|
0003| pro tempore of the senate after consultation with and the
|
0004| agreement of a majority of the members of the [committee's]
|
0005| committees' committee. Members shall be appointed from each
|
0006| house so as to give the two major political parties in each
|
0007| house the same proportional representation on the task force as
|
0008| prevails in each house; however, in no event shall either party
|
0009| have less than one member from each house on the task force.
|
0010| Vacancies on the task force shall be filled by appointment in
|
0011| the same manner as the original appointments.
|
0012| C. Three public members shall be appointed to the
|
0013| task force by the speaker of the house of representatives and
|
0014| three public members shall be appointed by the president pro
|
0015| tempore of the senate so as to represent the state's ethnic and
|
0016| geographic diversity. The public members of the task force
|
0017| shall be paid per diem and mileage in accordance with the
|
0018| provisions of the Per Diem and Mileage Act plus reimbursement
|
0019| for reasonable actual expenses.
|
0020| D. Additionally, the task force shall include the
|
0021| following advisory members:
|
0022| (1) the secretary of finance and
|
0023| administration or the secretary's designee;
|
0024| (2) the attorney general or his designee;
|
0025| (3) the president of the district judges
|
0001| association or his designee;
|
0002| (4) the secretary of health or his designee;
|
0003| (5) the secretary of children, youth and
|
0004| families or his designee;
|
0005| (6) the president of the magistrate judges
|
0006| association or his designee;
|
0007| (7) the president of the municipal judges
|
0008| association or his designee;
|
0009| (8) the chief justice of the supreme court or
|
0010| his designee;
|
0011| (9) the chief judge of the Bernalillo county
|
0012| metropolitan court or his designee;
|
0013| (10) the chief of the traffic safety bureau of
|
0014| the state highway and transportation department;
|
0015| (11) the chief public defender;
|
0016| (12) one district attorney appointed by the
|
0017| president of the district [attorney's] attorneys
|
0018| association; [and]
|
0019| (13) the secretary of taxation and revenue or
|
0020| the secretary's designee; and
|
0021| (14) the president of mothers against drunk
|
0022| driving or the president's designee.
|
0023| E. The speaker of the house of representatives and
|
0024| the president pro tempore of the senate shall each designate
|
0025| one co-chairman of the task force."
|
0001| Section 2. EFFECTIVE DATE.--The effective date of the
|
0002| provisions of this act is July 1, 1997.
