0011| RELATING TO REGIONAL EDUCATION COOPERATIVES; AMENDING AND
|
0012| REPEALING SECTIONS OF THE NMSA 1978.
|

|
0014| BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF NEW MEXICO:
|
0015| Section 1. Section 22-2-6.3 NMSA 1978 (being Laws 1986,
|
0016| Chapter 94, Section 3, as amended) is amended to read:
|
0017| "22-2-6.3. DEFINITIONS.--As used in the Public School
|
0018| Insurance Authority Act:
|
0019| A. "authority" means the public school insurance
|
0020| authority;
|
0021| B. "board" means the board of directors of the
|
0022| public school insurance authority;
|
0023| C. "director" means the director of the public
|
0024| school insurance authority;
|
0025| D. "educational entities" means state educational
|
0001| institutions as enumerated in Article 12, Section 11 of the
|
0002| constitution of New Mexico [and], other state diploma,
|
0003| degree-granting and certificate-granting post-secondary
|
0004| educational institutions and regional education cooperatives
|
0005| as defined in the Regional Cooperative Education Act;
|
0006| E. "fund" means the public school insurance fund;
|
0007| F. "group health insurance" means coverage which
|
0008| includes but is not limited to life insurance, accidental death
|
0009| and dismemberment, medical care and treatment, dental care, eye
|
0010| care and other coverages as determined by the authority;
|
0011| G. "risk-related coverage" means coverage which
|
0012| includes, but is not limited to property and casualty, general
|
0013| liability, auto and fleet, [workmen's] workers'
|
0014| compensation and other casualty insurance; and
|
0015| H. "school district" means a school district as
|
0016| defined in Subsection [J] K of Section 22-1-2 NMSA 1978,
|
0017| excluding any school district with a student enrollment in
|
0018| excess of sixty thousand students."
|
0019| Section 2. Section 22-2B-1 NMSA 1978 (being Laws 1993,
|
0020| Chapter 232, Section 1) is amended to read:
|
0021| "22-2B-1. SHORT TITLE.--[Sections 1 through 6 of this
|
0022| act] Chapter 22, Article 2B NMSA 1978 may be cited as the
|
0023| "Regional Cooperative Education Act"."
|
0024| Section 3. Section 22-2B-2 NMSA 1978 (being Laws 1993,
|
0025| Chapter 232, Section 2) is amended to read:
|
0001| "22-2B-2. DEFINITIONS.--As used in the Regional
|
0002| Cooperative Education Act:
|
0003| A. "council" means a regional education
|
0004| coordinating council; and
|
0005| B. "cooperative" means a regional education
|
0006| cooperative [and
|
0007| C. "fund" means an educational cooperative fund]."
|
0008| Section 4. Section 22-2B-3 NMSA 1978 (being Laws 1993,
|
0009| Chapter 232, Section 3) is amended to read:
|
0010| "22-2B-3. REGIONAL EDUCATION COOPERATIVES AUTHORIZED.--
|
0011| A. The state board may authorize the existence and
|
0012| operation of "regional education cooperatives". Upon
|
0013| authorization by the state board, local school boards may join
|
0014| with other local school boards or other state-supported
|
0015| educational institutions to form cooperatives for the purpose
|
0016| of providing education-related services to qualified school-age
|
0017| residents of participating educational entities. [Regional
|
0018| education cooperatives shall be deemed individual state
|
0019| agencies administratively attached to the department of
|
0020| education.]
|
0021| B. The state board shall, by regulation, establish
|
0022| minimum criteria for the establishment and operation of
|
0023| cooperatives. The state board shall also establish procedures
|
0024| for oversight of cooperatives to ensure compliance with state
|
0025| board regulation. [Regional education cooperatives shall be
|
0001| exempt from the provisions of the Personnel Act.]"
|
0002| Section 5. REPEAL.--Section 22-2B-6 NMSA 1978 (being Laws
|
0003| 1993, Chapter 232, Section 6) is repealed.
