0011|     RELATING TO CRIMINAL LAW; PROVIDING ENHANCED PENALTIES WHEN A

0013|     OR RESIDENTIAL DWELLING; AMENDING A SECTION OF THE CRIMINAL

0016|     BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF NEW MEXICO:
    |
0017|          Section 1.  Section 30-16-3 NMSA 1978 (being Laws 1963,
    |
0018|     Chapter 303, Section 16-3, as amended) is amended to read:
    |
0019|          "30-16-3.  BURGLARY.--Burglary consists of the
    |
0020|     unauthorized entry of any vehicle, watercraft, aircraft,
    |
0021|     dwelling <u>house, residential dwelling</u> or other structure,
    |
0022|     movable or immovable, with the intent to commit any felony or
    |
0023|     theft therein.
    |
0024|               A.  Any person who, without authorization, enters a
    |
0025|     dwelling house <u>or residential dwelling</u> with intent to commit
    |
0001|     any felony or theft therein is guilty of a third degree felony.
    |
0002|               <u>B.  Any person who commits burglary of a dwelling
</u>    |
<u></u>0003| <u>    house or residential dwelling, as provided in Subsection A of
</u>    |
<u></u>0004| <u>    this section, who has a prior conviction for burglary of a
</u>    |
<u></u>0005| <u>    dwelling house or residential dwelling, shall have his basic
</u>    |
<u></u>0006| <u>    sentence increased by three years for each prior conviction for
</u>    |
<u></u>0007| <u>    burglary of a dwelling house or residential dwelling.
</u>    |
<u></u>0008| <u>              C.  For the purposes of this section, "prior
</u>    |
<u></u>0009| <u>    conviction for burglary of a dwelling house or residential
</u>    |
<u></u>0010| <u>    dwelling" means:
</u>    |
<u></u>0011| <u>                   (1)  a prior conviction under Subsection A of
</u>    |
<u></u>0012| <u>    this section; or
</u>    |
<u></u>0013| <u>                   (2)  a prior conviction in any other
</u>    |
<u></u>0014| <u>    jurisdiction, territory or possession of the United States when
</u>    |
<u></u>0015| <u>    the criminal act is burglarizing a dwelling house or
</u>    |
<u></u>0016| <u>    residential dwelling.
</u>    |
<u></u>0017| <u>    </u>         <s>[B.]</s> <u>D.</u>  Any person who, without authorization,

0020|     therein is guilty of a fourth degree felony."
    |
0021|          Section 2.  EFFECTIVE DATE.--The effective date of the
    |
0022|     provisions of this act is July 1, 1997.
