0011| RELATING TO CRIMINAL LAW; PROVIDING ENHANCED PENALTIES WHEN A

0012| PERSON HAS A PRIOR CONVICTION FOR BURGLARY OF A DWELLING HOUSE

0013| OR RESIDENTIAL DWELLING; AMENDING A SECTION OF THE CRIMINAL
|

0016| BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF NEW MEXICO:
|
0017| Section 1. Section 30-16-3 NMSA 1978 (being Laws 1963,
|
0018| Chapter 303, Section 16-3, as amended) is amended to read:
|
0019| "30-16-3. BURGLARY.--Burglary consists of the
|
0020| unauthorized entry of any vehicle, watercraft, aircraft,
|
0021| dwelling house, residential dwelling or other structure,
|
0022| movable or immovable, with the intent to commit any felony or
|
0023| theft therein.
|
0024| A. Any person who, without authorization, enters a
|
0025| dwelling house or residential dwelling with intent to commit
|
0001| any felony or theft therein is guilty of a third degree felony.
|
0002| B. Any person who commits burglary of a dwelling
|
0003| house or residential dwelling, as provided in Subsection A of
|
0004| this section, who has a prior conviction for burglary of a
|
0005| dwelling house or residential dwelling, shall have his basic
|
0006| sentence increased by three years for each prior conviction for
|
0007| burglary of a dwelling house or residential dwelling.
|
0008| C. For the purposes of this section, "prior
|
0009| conviction for burglary of a dwelling house or residential
|
0010| dwelling" means:
|
0011| (1) a prior conviction under Subsection A of
|
0012| this section; or
|
0013| (2) a prior conviction in any other
|
0014| jurisdiction, territory or possession of the United States when
|
0015| the criminal act is burglarizing a dwelling house or
|
0016| residential dwelling.
|
0017| [B.] D. Any person who, without authorization,
|
0018| enters any vehicle, watercraft, aircraft or other structure,
|
0019| movable or immovable, with intent to commit any felony or theft
|
0020| therein is guilty of a fourth degree felony."
|
0021| Section 2. EFFECTIVE DATE.--The effective date of the
|
0022| provisions of this act is July 1, 1997.
