0011| RELATING TO THE ECONOMIC DEVELOPMENT DEPARTMENT; AMENDING,
|
0012| REPEALING AND ENACTING SECTIONS OF THE NMSA 1978.
|

|
0014| BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF NEW MEXICO:
|
0015| Section 1. Section 9-15-1 NMSA 1978 (being Laws 1983,
|
0016| Chapter 297, Section 1, as amended) is amended to read:
|
0017| "9-15-1. SHORT TITLE. [Sections 9-15-1 through 9-15-15]
|
0018| Chapter 9, Article 15 NMSA 1978 may be cited as the "Economic
|
0019| Development Department Act"."
|
0020| Section 2. Section 9-15-2 NMSA 1978 (being Laws 1983,
|
0021| Chapter 297, Section 2, as amended) is amended to read:
|
0022| "9-15-2. FINDINGS AND PURPOSE.--
|
0023| A. The legislature finds that a need exists for
|
0024| economic diversification in the state in order to protect
|
0025| against dramatic changes in the state's economy and to increase
|
0001| revenues to help state government finance the various services
|
0002| it provides to the state's communities and citizens.
|
0003| B. The legislature further finds that the goal of
|
0004| economic development and diversification can best be
|
0005| accomplished by creating a cabinet-level department [which]
|
0006| that will be concerned solely with the areas of economic
|
0007| development and diversification and business recruitment,
|
0008| expansion and retention.
|
0009| C. The purpose of the Economic Development
|
0010| Department Act is to create a cabinet-level department in order
|
0011| to:
|
0012| (1) provide a coordinated statewide
|
0013| perspective with regard to economic development activities;
|
0014| [(2) provide a data base for local and
|
0015| regional economic development groups and serve as a
|
0016| comprehensive source of information and assistance to
|
0017| businesses wishing to locate or expand in New Mexico;
|
0018| (3) actively encourage new economic
|
0019| enterprises to locate in New Mexico and assist existing
|
0020| businesses to expand;]
|
0021| (2) assist in gathering information on local
|
0022| and regional assets;
|
0023| (3) assist in the establishment of procedures
|
0024| for handling potential clients;
|
0025| (4) monitor the progress of state-supported
|
0001| economic development activities and prepare annual reports of
|
0002| such activities, their status and their impact;
|
0003| (5) create and encourage methods designed to
|
0004| provide rapid economic diversification development that will
|
0005| create new employment opportunities for the citizens of the
|
0006| state, including the issuance of grants and loans to
|
0007| municipalities and counties for economic enhancement projects;
|
0008| [(6) provide for technology commercialization
|
0009| projects as an incentive to industry locating or expanding in
|
0010| the state;
|
0011| (7) support technology transfer programs;
|
0012| (8) promote New Mexico as a technology
|
0013| conference center;
|
0014| (9) promote and market federal and state
|
0015| technology commercialization programs;
|
0016| (10) develop and implement enhanced statewide
|
0017| procurement programs; and
|
0018| (11) provide support and assistance in the
|
0019| creation and operation of development finance mechanisms such
|
0020| as business development corporations and the industrial and
|
0021| agricultural finance authorities in order to insure capital
|
0022| availability for business expansion and economic
|
0023| diversification.]
|
0024| (6) assist in the development of a plan for
|
0025| the expansion of the local regional economic base;
|
0001| (7) assist in the establishment of programs to
|
0002| attract new labor forces or training local labor forces;
|
0003| (8) identify barriers to local or regional
|
0004| economic development and develop plans to overcome such
|
0005| barriers;
|
0006| (9) promote investment by private sector in
|
0007| the state; and
|
0008| (10) provide support and assistance in the
|
0009| creation and operation of development finance mechanisms such
|
0010| as business development corporations and the New Mexico
|
0011| industrial and agricultural finance authority in order to
|
0012| ensure capital availability for business expansion and economic
|
0013| diversification."
|
0014| Section 3. Section 9-15-4 NMSA 1978 (being Laws 1983,
|
0015| Chapter 297, Section 4, as amended) is amended to read:
|
0016| "9-15-4. DEPARTMENT ESTABLISHED.--There is created in the
|
0017| executive branch the "economic development department". The
|
0018| department shall be a cabinet department and shall consist of,
|
0019| but not be limited to, [seven] six divisions as follows:
|
0020| A. the administrative services division;
|
0021| B. the economic development division;
|
0022| C. the New Mexico film division;
|
0023| D. the science and technology [enterprise]
|
0024| division;
|
0025| E. the trade division; and
|
0001| [F. the state housing authority; and
|
0002| G.] F. the [office for] space
|
0003| commercialization division."
|
0004| Section 4. Section 9-15-5 NMSA 1978 (being Laws 1983,
|
0005| Chapter 297, Section 5, as amended) is amended to read:
|
0006| "9-15-5. SECRETARY [OF THE ECONOMIC DEVELOPMENT
|
0007| DEPARTMENT]--APPOINTMENT.--The chief executive and
|
0008| administrative officer of the department is the "secretary of
|
0009| economic development". The secretary shall be appointed by the
|
0010| governor with the consent of the senate. The secretary shall
|
0011| hold that office at the pleasure of the governor and shall
|
0012| serve in the executive cabinet [provided, however, that the
|
0013| secretary appointed to serve as the secretary of economic
|
0014| development and tourism and whose appointment has been
|
0015| confirmed by the senate may serve as the secretary of the
|
0016| economic development department at the pleasure of the governor
|
0017| and without further confirmation]."
|
0018| Section 5. Section 9-15-6 NMSA 1978 (being Laws 1983,
|
0019| Chapter 297, Section 6, as amended) is amended to read:
|
0020| "9-15-6. SECRETARY--DUTIES AND GENERAL POWERS.--
|
0021| A. The secretary is responsible to the governor for
|
0022| the operation of the department. It is his duty to manage all
|
0023| operations of the department and to administer and enforce the
|
0024| laws with which he or the department is charged.
|
0025| B. To perform his duties, the secretary has every
|
0001| power expressly enumerated in the laws, whether granted to the
|
0002| secretary or the department or any division of the department,
|
0003| except where authority conferred upon any division is
|
0004| explicitly exempted from the secretary's authority by statute.
|
0005| In accordance with these provisions, the secretary shall:
|
0006| (1) except as otherwise provided in the
|
0007| Economic Development Department Act, exercise general
|
0008| supervisory and appointing authority over all department
|
0009| employees, subject to any applicable personnel laws and
|
0010| regulations;
|
0011| (2) delegate authority to subordinates as he
|
0012| deems necessary and appropriate, clearly delineating such
|
0013| delegated authority and the limitations thereto;
|
0014| (3) organize the department into those
|
0015| organizational units he deems will enable it to function most
|
0016| efficiently;
|
0017| (4) within the limitations of available
|
0018| appropriations and applicable laws, employ and fix the
|
0019| compensation of those persons necessary to discharge his
|
0020| duties;
|
0021| (5) take administrative action by issuing
|
0022| orders and instructions, not inconsistent with the law, to
|
0023| assure implementation of and compliance with the provisions of
|
0024| law for whose administration or execution he is responsible and
|
0025| to enforce those orders and instructions by appropriate
|
0001| administrative action in the courts;
|
0002| (6) conduct research and studies that will
|
0003| improve the operations of the department and the provision of
|
0004| services to the citizens of the state;
|
0005| (7) provide for courses of instruction and
|
0006| practical training for employees of the department and other
|
0007| persons involved in the administration of programs, with the
|
0008| objective of improving the operations and efficiency of
|
0009| administration;
|
0010| (8) prepare an annual budget of the department
|
0011| based upon the five-year economic development plan approved by
|
0012| the commission. The economic development plan shall be updated
|
0013| and approved annually by the commission;
|
0014| (9) provide cooperation, at the request of
|
0015| heads of administratively attached agencies, in order to:
|
0016| (a) minimize or eliminate duplication of
|
0017| services;
|
0018| (b) coordinate activities and resolve
|
0019| problems of mutual concern; and
|
0020| (c) resolve by agreement the manner and
|
0021| extent to which the department shall provide budgeting,
|
0022| recordkeeping and related clerical assistance to
|
0023| administratively attached agencies;
|
0024| (10) appoint a "director" for each division.
|
0025| These appointed positions are exempt from the provisions of the
|
0001| Personnel Act. Persons appointed to these positions shall
|
0002| serve at the pleasure of the secretary;
|
0003| (11) give bond in the penal sum of twenty-five
|
0004| thousand dollars ($25,000) and require directors to each give
|
0005| bond in the penal sum of ten thousand dollars ($10,000)
|
0006| conditioned upon the faithful performance of duties, as
|
0007| provided in the Surety Bond Act. The department shall pay the
|
0008| costs of these bonds; and
|
0009| (12) require performance bonds of such
|
0010| department employees and officers as he deems necessary, as
|
0011| provided in the Surety Bond Act. The department shall pay the
|
0012| costs of these bonds.
|
0013| C. The secretary may apply for and receive in the
|
0014| name of the department any public or private funds, including
|
0015| [but not limited to] United States government funds,
|
0016| available to the department to carry out its programs, duties
|
0017| or services.
|
0018| D. The secretary may make and adopt such reasonable
|
0019| and procedural rules and regulations as may be necessary to
|
0020| carry out the duties of the department and its divisions. No
|
0021| rule or regulation promulgated by the director of any division
|
0022| in carrying out the functions and duties of the division shall
|
0023| be effective until approved by the secretary unless otherwise
|
0024| provided by statute. Unless otherwise provided by statute, no
|
0025| regulation affecting any person or agency outside the
|
0001| department shall be adopted, amended or repealed without a
|
0002| public hearing on the proposed action before the secretary or a
|
0003| hearing officer designated by him. The public hearing shall be
|
0004| held in Santa Fe unless otherwise permitted by statute. Notice
|
0005| of the subject matter of the regulation, the action proposed to
|
0006| be taken, the time and place of the hearing, the manner in
|
0007| which interested persons may present their views and the method
|
0008| by which copies of the proposed regulation, proposed amendment
|
0009| or repeal of an existing regulation may be obtained shall be
|
0010| published once at least thirty days prior to the hearing date
|
0011| in a newspaper of general circulation and mailed at least
|
0012| thirty days prior to the hearing date to all persons who have
|
0013| made a written request for advance notice of hearing. All
|
0014| rules and regulations shall be filed in accordance with the
|
0015| State Rules Act."
|
0016| Section 6. Section 9-15-10 NMSA 1978 (being Laws 1983,
|
0017| Chapter 297, Section 10, as amended) is amended to read:
|
0018| "9-15-10. ORGANIZATIONAL UNITS OF DEPARTMENT--POWERS AND
|
0019| DUTIES SPECIFIED BY LAW--ACCESS TO INFORMATION.--Those
|
0020| organizational units of the department and the officers of
|
0021| those units specified by law shall have all of the powers and
|
0022| duties enumerated in the specific laws involved. However, the
|
0023| carrying out of those powers and duties shall be subject to the
|
0024| direction and supervision of the secretary, and he shall retain
|
0025| the final decision-making authority and responsibility for the
|
0001| administration of any such laws as provided in Subsection B of
|
0002| Section 9-15-6 NMSA 1978. The department shall have access to
|
0003| all records, data and information of other state departments,
|
0004| agencies and institutions, including its own organizational
|
0005| units, not specifically held confidential by law. Any
|
0006| information obtained by the department that is deemed by the
|
0007| secretary to be proprietary technical or business information
|
0008| shall be held in confidence. Proprietary technical or business
|
0009| information shall not be deemed a public record pursuant to the
|
0010| Public Records Act or be open to inspection pursuant to Section
|
0011| 14-2-1 NMSA 1978. The department shall take such steps as are
|
0012| necessary to safeguard the confidentiality of the
|
0013| information."
|
0014| Section 7. Section 9-15-11 NMSA 1978 (being Laws 1988,
|
0015| Chapter 81, Section 5, as amended) is amended to read:
|
0016| "9-15-11. ECONOMIC DEVELOPMENT COMMISSION CREATED--
|
0017| MEMBERSHIP--ADMINISTRATIVELY ATTACHED TO THE DEPARTMENT.--
|
0018| A. The "economic development commission" is
|
0019| created. The commission shall be a planning commission
|
0020| administratively attached to the [economic development]
|
0021| department. The commission shall provide advice to the
|
0022| department on policy matters. The commission shall be
|
0023| responsible for the annual approval and update of the state's
|
0024| five-year economic development plan. The commission shall
|
0025| consist of [seven] eight members who shall be qualified
|
0001| electors of the state [of New Mexico], no more than four of
|
0002| whom at the time of their appointment shall be members of the
|
0003| same political party and at least one of whom shall be a Native
|
0004| American. Members shall be appointed by the governor and
|
0005| confirmed by the senate. [Two members shall be appointed from
|
0006| each of the three congressional districts. The seventh member
|
0007| shall be the governor's "science advisor", hereby named. The
|
0008| governor's science advisor shall advise the governor on matters
|
0009| relating to science and technology, technological innovation,
|
0010| technical excellence, technology-based new business
|
0011| development, research and development and other science and
|
0012| technology projects conducted at research institutes and
|
0013| institutions of higher education throughout the state, with
|
0014| emphasis on commercialization of such projects and technology
|
0015| transfer for economic development purposes.] Seven members
|
0016| shall be appointed from their respective planning districts,
|
0017| and the eighth member shall be a Native American and represent
|
0018| the interests of the Indian tribes and pueblos.
|
0019| B. Appointments shall be made for [seven-year]
|
0020| five-year terms expiring on January 1 of the appropriate
|
0021| year. Commission members shall serve staggered terms as
|
0022| determined by the governor at the time of their initial
|
0023| appointment. Annually, the governor shall designate a chairman
|
0024| of the commission from among the members.
|
0025| C. The commission shall meet at the call of the
|
0001| chairman, not less than once each quarter, and shall invite
|
0002| representatives of appropriate legislative committees, other
|
0003| state agencies and interested persons to its meetings for the
|
0004| purpose of information exchange and coordination.
|
0005| D. Commission members shall not vote by proxy. A
|
0006| majority of the members constitutes a quorum for the conduct of
|
0007| business.
|
0008| E. Members of the commission shall not be removed
|
0009| except for incompetence, neglect of duty or malfeasance in
|
0010| office; provided, however, no removal shall be made without
|
0011| notice of hearing and an opportunity to be heard having first
|
0012| been given the member being removed. The senate shall be given
|
0013| exclusive original jurisdiction over proceedings to remove
|
0014| members of the commission [under such rules as it may
|
0015| promulgate]. The senate's decision in connection with such
|
0016| matters shall be final. A vacancy in the membership of the
|
0017| commission occurring other than by expiration of term shall be
|
0018| filled in the same manner as the original appointment, but for
|
0019| the unexpired term only.
|
0020| F. Commission members shall not be paid, but shall
|
0021| receive per diem and mileage as provided in the Per Diem and
|
0022| Mileage Act."
|
0023| Section 8. A new section of the Economic Development
|
0024| Department Act is enacted to read:
|
0025| "[NEW MATERIAL] ECONOMIC DEVELOPMENT DIVISION--CREATED-
|
0001| -DUTIES.--The "economic development division" is created as a
|
0002| division of the department. The division shall:
|
0003| A. actively encourage new economic enterprises to
|
0004| locate in New Mexico and assist existing business to expand;
|
0005| B. provide a database for local and regional
|
0006| economic development groups and serve as a comprehensive source
|
0007| of information and assistance to businesses wishing to locate
|
0008| or expand in New Mexico;
|
0009| C. serve as staff to the governor's rural economic
|
0010| development council;
|
0011| D. serve as lead agency in the coordination of the
|
0012| census program at the state data center;
|
0013| E. promote Indian economic potential and establish
|
0014| a business mentor program to enhance Indian business exports;
|
0015| and
|
0016| F. assist New Mexico communities to enhance their
|
0017| ability to attract economic development through main street,
|
0018| enterprise zone, retention and expansion and rural readiness
|
0019| programs."
|
0020| Section 9. A new section of the Economic Development
|
0021| Department Act is enacted to read:
|
0022| "NEW MATERIAL] ENTERPRISE DEVELOPMENT BUREAU--CREATED--
|
0023| DUTIES.--
|
0024| A. The "enterprise development bureau" is created
|
0025| in the economic development division. The bureau shall:
|
0001| (1) serve as the state's primary source of
|
0002| business information regarding licensing, permitting and
|
0003| taxation requirements and procedures and other matters relevant
|
0004| to business and economic development;
|
0005| (2) develop and maintain a comprehensive
|
0006| statewide business information database and referral service;
|
0007| (3) establish a mechanism for advertising the
|
0008| existence of the bureau and its referral service;
|
0009| (4) establish a reporting procedure to monitor
|
0010| the success of the referral service; and
|
0011| (5) provide professional assistance to
|
0012| businesses involved in state licensing, permitting and taxation
|
0013| procedures.
|
0014| B. The secretary shall develop a budget for the
|
0015| bureau and hire a chief and other staff as necessary to carry
|
0016| out the provisions of this section."
|
0017| Section 10. Section 9-15-16 NMSA 1978 (being Laws 1991,
|
0018| Chapter 21, Section 21) is amended to read:
|
0019| "9-15-16. SCIENCE AND TECHNOLOGY [ENTERPRISE] DIVISION
|
0020| CREATED.--The "science and technology [enterprise]
|
0021| division" is created as a division of the [economic
|
0022| development] department. The division shall:
|
0023| A. enhance the business climate to encourage the
|
0024| start-up, relocation, development and growth of science- and
|
0025| technology-based industry in New Mexico;
|
0001| B. promote an expanded, diversified science- and
|
0002| technology-based economy, emphasizing areas that:
|
0003| (1) derive from the state's scientific and
|
0004| technological strengths;
|
0005| (2) provide a commercial advantage;
|
0006| (3) lend themselves to a distributed science-
|
0007| and technology-based industry network; and
|
0008| (4) [utilize] use imaginative state,
|
0009| federal
|
0010| and private partnerships; and
|
0011| C. attain sufficient levels of human, financial and
|
0012| physical resources to support in-state industries and attract
|
0013| new industries to New Mexico."
|
0014| Section 11. Section 9-15-17 NMSA 1978 (being Laws 1991,
|
0015| Chapter 21, Section 22) is amended to read:
|
0016| "9-15-17. DIRECTOR--DUTIES.--The director of the science
|
0017| and technology [enterprise] division is responsible for the
|
0018| overall supervision of the division [in accordance with the
|
0019| provisions of Section 9-15-16 NMSA 1978] and shall serve as
|
0020| the governor's science adviser. The governor's science adviser
|
0021| shall advise the governor on matters related to science,
|
0022| technology, education and economic development. In addition,
|
0023| the director shall:
|
0024| A. formulate and submit to the commission a five-
|
0025| year state science and technology development plan;
|
0001| B. develop and be responsible for the operating and
|
0002| capital budgets of the division;
|
0003| C. develop agreements with federal research,
|
0004| development, testing and evaluating organizations and
|
0005| universities to facilitate the transfer and commercialization
|
0006| of technology;
|
0007| D. recommend to the secretary proposed projects and
|
0008| contracts in accordance with the policies, procedures and
|
0009| guidelines established by the department;
|
0010| E. subject to the approval of the secretary, apply
|
0011| for and accept any federal funds or grants and private
|
0012| donations;
|
0013| F. develop requests for proposals in science and
|
0014| technology commercialization areas given priority by the
|
0015| commission in the state's economic development [and tourism]
|
0016| plan; receive and refer with commentary to the secretary
|
0017| proposals submitted in response to requests for proposals;
|
0018| confer with research investigators to assist them when needed;
|
0019| monitor progress on state-funded research and development
|
0020| projects; maintain contact with research and development
|
0021| offices of the universities, federal laboratories and private
|
0022| research operations; and receive reports of individual
|
0023| projects;
|
0024| G. prepare an annual report on:
|
0025| (1) the status of the [technology
|
0001| enterprise] division;
|
0002| (2) the status of ongoing research and
|
0003| development projects;
|
0004| (3) the results obtained from completed
|
0005| projects and the dissemination of those results; and
|
0006| (4) other activities of the division;
|
0007| H. maintain and update records on the status of all
|
0008| completed and ongoing projects;
|
0009| I. request from each entity under contract with the
|
0010| division a detailed description of tasks and associated budgets
|
0011| for review and approval by the commission; and
|
0012| J. perform such other duties as are assigned to him
|
0013| by the secretary [in order to further the purposes of Section
|
0014| 9-15-17 NMSA 1978]."
|
0015| Section 12. Section 9-15-31 NMSA 1978 (being Laws 1988,
|
0016| Chapter 80, Section 5, as amended) is amended to read:
|
0017| "9-15-31. DIRECTOR--DUTIES.--The director of the trade
|
0018| division of the department is responsible for the overall
|
0019| supervision of the division's activities [in accordance with
|
0020| the purposes of Sections 9-15-28 through 9-15-34 NMSA 1978].
|
0021| In addition, the director shall:
|
0022| A. work with individuals and organizations outside
|
0023| of state government to formulate a trade promotion plan for
|
0024| inclusion in the department's five-year economic development
|
0025| [and tourism] plan;
|
0001| B. establish and annually update the New Mexico
|
0002| trade registry of New Mexico businesses and the products and
|
0003| services they offer to consumers;
|
0004| C. develop and maintain a database of trade
|
0005| opportunities;
|
0006| D. work with individuals and organizations outside
|
0007| of state government to promote New Mexico trade; and
|
0008| E. prepare an annual report on the activities of
|
0009| the division."
|
0010| Section 13. Section 9-15-43 NMSA 1978 (being Laws 1994,
|
0011| Chapter 127, Section 2, as amended) is amended to read:
|
0012| "9-15-43. DEFINITIONS.--As used in [the Spaceport
|
0013| Development Act] Sections 9-15-43 through 9-15-47 NMSA 1978:
|
0014| A. "commission" means the [spaceport] space
|
0015| commission;
|
0016| [B. "department" means the economic development
|
0017| department;
|
0018| C.] B. "director" means the director of the
|
0019| [office for] space commercialization division;
|
0020| C. "division" means the space commercialization
|
0021| division;
|
0022| D. "secretary" means the secretary of economic
|
0023| development; [and]
|
0024| E. "space" means any location beyond altitudes of
|
0025| sixty thousand feet above the earth's mean sea level; and
|
0001| [E.] F. "spaceport" means an installation and
|
0002| related facilities [utilized] used for the launching,
|
0003| landing, recovery, servicing and monitoring of vehicles capable
|
0004| of entering or returning from space."
|
0005| Section 14. Section 9-15-44 NMSA 1978 (being Laws 1994,
|
0006| Chapter 127, Section 3, as amended) is amended to read:
|
0007| "9-15-44. [OFFICE FOR] SPACE COMMERCIALIZATION
|
0008| DIVISION CREATED--DUTIES OF DIRECTOR.--
|
0009| A. The "[office for] space commercialization
|
0010| division" is created as a division in the department.
|
0011| B. The duties of the [office for space
|
0012| commercialization] division shall be discharged by a
|
0013| director, who shall be hired by the secretary.
|
0014| C. The director shall:
|
0015| (1) employ such other staff as is necessary to
|
0016| carry out the work of the [office for space
|
0017| commercialization] division and the commission and the
|
0018| purposes of [the Spaceport Development Act] Sections 9-15-43
|
0019| through 9-15-47 NMSA 1978;
|
0020| (2) discharge the responsibilities of the
|
0021| [office for space commercialization] division in accordance
|
0022| with the policies established and approved by the secretary;
|
0023| (3) administer federally funded grants for the
|
0024| purpose of determining the feasibility of developing and
|
0025| operating a regional spaceport and other space
|
0001| development-related activities in the state;
|
0002| (4) manage all aspects of the spaceport
|
0003| program;
|
0004| (5) coordinate the promotion and marketing of
|
0005| space-related resources of New Mexico and a regional spaceport;
|
0006| (6) serve as the interface between New Mexico
|
0007| and national and international users of the regional spaceport;
|
0008| (7) schedule user mission support with other
|
0009| elements of the regional spaceport;
|
0010| (8) develop a comprehensive inventory of New
|
0011| Mexico's space-related assets;
|
0012| (9) cooperate with the commission in
|
0013| performing tasks necessary to establish the criteria for
|
0014| overflight; and
|
0015| (10) support the commission in executing the
|
0016| tasks approved by the secretary."
|
0017| Section 15. Section 9-15-45 NMSA 1978 (being Laws 1994,
|
0018| Chapter 127, Section 4, as amended) is amended to read:
|
0019| "9-15-45. COMMISSION CREATED--MEMBERSHIP.--
|
0020| A. The "[spaceport] space commission" is
|
0021| created. The commission is administratively attached to the
|
0022| department.
|
0023| B. The commission is composed of up to eleven
|
0024| voting members. Three members shall be ex officio and [four]
|
0025| all others shall be appointed by the governor. The ex-
|
0001| officio members are the secretary, the [secretary of finance
|
0002| and administration] governor's science adviser and the
|
0003| lieutenant governor. In selecting the appointed members of the
|
0004| commission, the governor shall appoint at least three members
|
0005| knowledgeable of [the] government and commercial space
|
0006| [industry] activities. One member shall be a resident of
|
0007| Sierra county, one member shall be a representative of a
|
0008| federal space development project in the state and one member
|
0009| shall be a representative of one of the state's national
|
0010| laboratories.
|
0011| C. Appointed members of the commission shall serve
|
0012| for terms of three years; provided, when making his initial
|
0013| appointments, the governor shall appoint one member to a term
|
0014| of one year, two members to terms of two years and [three]
|
0015| two members to terms of three years.
|
0016| D. The governor shall appoint a chairman of the
|
0017| commission from among the appointed members. Other necessary
|
0018| officers shall be elected by the commission from among its
|
0019| membership.
|
0020| E. Commission members shall meet at the call of the
|
0021| chairman, not less than four times a year. Meetings shall be
|
0022| conducted in different geographic locations in the state on an
|
0023| alternating basis.
|
0024| F. Members of the commission appointed by the
|
0025| governor [of the state of New Mexico] shall be reimbursed for
|
0001| per diem and mileage pursuant to the Per Diem and Mileage Act,
|
0002| but shall not receive any other compensation, perquisite or
|
0003| allowance."
|
0004| Section 16. Section 9-15-46 NMSA 1978 (being Laws 1994,
|
0005| Chapter 127, Section 5, as amended) is amended to read:
|
0006| "9-15-46. COMMISSION--POWERS--DUTIES.--The commission
|
0007| shall:
|
0008| A. in cooperation with the [office for space
|
0009| commercialization] division, promote [spaceport] the
|
0010| development of a spaceport and other space-related
|
0011| activities in the state;
|
0012| B. advise the secretary on methods for soliciting
|
0013| and accepting, on behalf of the state, federal, state, local
|
0014| and private funds for the purpose of developing, constructing,
|
0015| maintaining and operating a regional spaceport and other space
|
0016| development-related projects;
|
0017| C. act in an advisory capacity to the secretary on
|
0018| matters that pertain to the development and operation of [the
|
0019| regional spaceport] space development projects;
|
0020| D. advise the secretary on methods for providing
|
0021| for the development, construction and acceptance of a regional
|
0022| spaceport; and
|
0023| E. report annually to the governor and the
|
0024| legislature on the status of the [regional spaceport and other
|
0025| space-related] space development-related activities and
|
0001| projects undertaken by the commission."

0002| Section 17. A new section of the Economic Development
|
0003| Department Act is enacted to read:
|
0004| "[NEW MATERIAL] NEW MEXICO FILM DIVISION--CREATED--
|
0005| DUTIES.--The "New Mexico film division" is created as a
|
0006| division of the department. The division shall promote and
|
0007| facilitate location productions by:
|
0008| A. promoting New Mexico's communities and their
|
0009| resources to potential domestic and international production
|
0010| companies;
|
0011| B. establishing a database of New Mexico business
|
0012| and personnel relevant to the film industry; and
|
0013| C. fostering and supporting the recruitment,
|
0014| retention and expansion of film-related businesses in the
|
0015| state."

0016| Section 18. A new section of the Economic Development
|
0017| Department Act is enacted to read:
|
0018| "[NEW MATERIAL] NEW MEXICO FILM DIVISION DIRECTOR--
|
0019| DUTIES.--The director of the New Mexico film division of the
|
0020| department is responsible for the overall supervision of the
|
0021| division's activities. In addition, the director shall:
|
0022| A. develop and maintain a network of community-
|
0023| appointed volunteers to aid in further promoting New Mexico's
|
0024| communities and regions for location production;
|
0025| B. establish and maintain a photographic library of
|
0001| potential location sites statewide;
|
0002| C. produce and disseminate collateral materials for
|
0003| the promotion of location production; and
|
0004| D. prepare an annual report on the activities of
|
0005| the division."
|
0006| Section 19. REPEAL.--Sections 9-15-7.1, 9-15-18, 9-15-29
|
0007| and 9-15-32 through 9-15-42 NMSA 1978 (being Laws 1983, Chapter
|
0008| 296, Section 21, Laws 1991, Chapter 21, Section 23, Laws 1988,
|
0009| Chapter 80, Section 3, Laws 1989, Chapter 205, Sections 1
|
0010| through 3, Laws 1991, Chapter 27, Sections 1 and 2, Laws 1993,
|
0011| Chapter 211, Sections 1 through 5 and also by Laws 1993,
|
0012| Chapter 216, Sections 1 through 5 and Laws 1994, Chapter 127,
|
0013| Section 1, as amended) are repealed.
|
0014| Section 20. EFFECTIVE DATE.--The effective date of the
|
0015| provisions of this act is July 1, 1997.
