0012| TRANSIT PLANNING COUNCIL; CREATING A PUBLIC ADVISORY COMMITTEE;

0013| DIRECTING THE COUNCIL TO DEVELOP A REGIONAL TRANSIT PLAN AND TO
|
0014| PRESENT ITS FINDINGS AND RECOMMENDATIONS FOR IMPLEMENTATION OF
|
0015| THE PLAN TO THE FIRST SESSION OF THE FORTY-FOURTH LEGISLATURE.

0017| BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF NEW MEXICO:
|
0018| Section 1. CENTRAL COUNTIES TRANSIT PLANNING COUNCIL
|
0019| CREATED--MEMBERSHIP--PUBLIC ADVISORY COMMITTEE--REGIONAL
|
0020| TRANSIT PLAN.--
|
0021| A. The "central counties transit planning council"
|
0022| is created and shall function from July 1, 1997 until December
|
0023| 31, 1999. The council shall consist of representatives of the
|
0024| governing bodies of the municipalities and counties in the
|
0025| central counties metropolitan area. Each governing body shall
|
0001| appoint one representative to the council.
|
0002| B. The central counties metropolitan area consists
|
0003| of Bernalillo county and the municipalities of Albuquerque, Los
|
0004| Ranchos and Tijeras; Sandoval county and the municipalities of
|
0005| Bernalillo, Corrales and Rio Rancho; Torrance county; and
|
0006| Valencia county and the municipalities of Belen, Bosque Farms
|
0007| and Los Lunas. The council may allow for participation by the
|
0008| pueblo of Isleta, should the pueblo wish to cooperate in the
|
0009| work of the council. The council may also invite participation
|
0010| from unincorporated communities within the central counties
|
0011| metropolitan area should any of those communities wish to
|
0012| participate.
|
0013| C. The governing body of each local government in
|
0014| the central counties metropolitan area shall name one member of
|
0015| the public who is a resident of that municipality or county to
|
0016| a public advisory committee who shall advise and assist the
|
0017| council in the development of a regional transit plan. A
|
0018| public member shall not be an elected official, employee or
|
0019| contractor of the government he represents or otherwise have or
|
0020| conduct for profit any business with that government.
|
0021| D. The governing body of each municipality and
|
0022| county in the central counties metropolitan area shall appoint
|
0023| a representative to the central counties transit planning
|
0024| council and a member of the public to the public advisory
|
0025| committee no later than July 1, 1997. The council shall
|
0001| convene no later than August 1, 1997 to elect a chairman and
|
0002| such other officers as it deems necessary and to begin its
|
0003| work. Staff for the council shall be drawn from among the
|
0004| staffs of the participating local governments. The council
|
0005| shall meet as often as necessary, but no less than quarterly,
|
0006| to carry out its duties. The public advisory committee shall
|
0007| also hold its initial meeting with the council when it first
|
0008| convenes, but shall elect its own officers and meet thereafter
|
0009| at the call of the council.
|
0010| E. The council shall develop a regional transit
|
0011| plan for the central counties metropolitan area. The plan
|
0012| shall include a proposal and schedule for implementation of the
|
0013| plan, the governing body and administration of any regional
|
0014| transit entity proposed to implement the plan, a financing
|
0015| proposal and any other related matters the council deems
|
0016| necessary. The council shall seek expertise and assistance
|
0017| from local, regional and state transportation and planning
|
0018| bodies, nongovernmental community organizations and the general
|
0019| public in developing the regional transit plan.
|
0020| F. The regional transit plan, including any
|
0021| legislation proposed, must be approved by the governing bodies
|
0022| of the participating local governments. If a regional transit
|
0023| plan is approved, the plan and any proposed legislation shall
|
0024| be presented to the first session of the forty-fourth
|
0025| legislature.
|
0001| Section 2. DELAYED REPEAL.--This act is repealed
|
0002| effective July 1, 1999.
