Section 4-44-18 NMSA 1978 (being Laws 1961, | 0018| Chapter 253, Section 4, as amended) is amended to read: | 0019| "4-44-18. SHERIFFS, DEPUTY SHERIFFS AND GUARDS--EXPENSES | 0020| INCURRED IN SERVING PROCESS AND CERTAIN OTHER OFFICIAL | 0021| BUSINESS--PER DIEM.-- | 0022| A. Sheriffs, their deputies and guards shall be | 0023| paid per diem expenses at the rate authorized in the Per Diem | 0024| and Mileage Act by the counties on behalf of which expenses are | 0025| incurred in: | 0001| (1) service of criminal process issued out of | 0002| the supreme court or district court; | 0003| (2) service of criminal process issued out of | 0004| a magistrate court when the issuance is approved in writing by | 0005| the district attorney or his assistants; | 0006| (3) service of civil process issued by the | 0007| district court; and | 0008| (4) attempting to discover or arrest a person | 0009| charged with a felony if written authorization is obtained from | 0010| the district judge. | 0011| B. Expenses authorized under this section shall be | 0012| paid on the rendition of sworn accounts filed in the county | 0013| clerk's office and approved by the board of county | 0014| commissioners and the district judge. | 0015| C. Sheriffs, their deputies and guards or private | 0016| persons performing the extradition and transportation at the | 0017| request of the county shall be paid per diem and mileage | 0018| expenses at the rate authorized in the Per Diem and Mileage Act | 0019| for extraditing prisoners from without the state and for | 0020| transporting persons committed by a court to any state | 0021| institution or required to be returned by order of the court | 0022| from any state institution to the county of commitment. On page 2, line 22, after the period insert: | 0006| | 0007| "Private contractors that provide extradition and | 0008| transportation services for a county shall train security | 0009| personnel in all phases of prisoner transportation and shall be | 0010| properly licensed and insured in accordance with state and | 0011| federal rules and regulations. Private contractors shall provide | 0012| a certificate of insurance demonstrating coverage at least to the | 0013| state's tort liability limits and shall name the county as an | 0014| additional insured.". | 0015| | 0016| 4.
