0011| RELATING TO CRIMINAL PROCEDURE; PROVIDING FOR HEARINGS TO

0012| DETERMINE IF A PERSON WHO IS COMMITTED PURSUANT TO A
|
0013| DETERMINATION OF INCOMPETENCY IS MENTALLY RETARDED; ENACTING A
|
0014| NEW SECTION OF THE NMSA 1978.

0016| BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF NEW MEXICO:
|
0017| Section 1. A new Section 31-9-1.6 NMSA 1978 is enacted to
|
0018| read:
|
0019| "31-9-1.6. [NEW MATERIAL] HEARING TO DETERMINE MENTAL
|
0020| RETARDATION.--
|
0021| A. Upon motion of the defense requesting a ruling,
|
0022| the court shall hold a hearing prior to one year after a
|
0023| defendant was determined to be incompetent. If the court
|
0024| finds, by a preponderance of the evidence, that the defendant
|
0025| is mentally retarded, the defendant shall be released upon the
|
0001| expiration of one year after the defendant was determined to be
|
0002| incompetent.
|
0003| B. As used in this section, "mentally retarded"
|
0004| means significantly subaverage general intellectual functioning
|
0005| existing concurrently with deficits in adaptive behavior. An
|
0006| intelligence quotient of seventy or below on a reliably
|
0007| administered intelligence quotient test shall be presumptive
|
0008| evidence of mental retardation."
|
0009| Section 2. EFFECTIVE DATE.--The effective date of the
|
0010| provisions of this act is July 1, 1997.

0008| 2. On page 1, line 23, after the period, strike the

0009| remainder of the line and insert:
|

0011| "B. If the court finds, by a preponderance of the
|
0012| evidence, that the defendant is mentally retarded, the defendant
|
0013| shall be:

0015| (1) released upon the expiration of one year
|
0016| after the defendant was determined to be incompetent to stand
|
0017| trial; and
|

0019| (2) referred to the department of health for an
|
0020| evaluation of whether the defendant presents a likelihood of
|
0021| serious harm to himself or the likelihood of serious harm to
|
0022| others.

0024| C. If the department of health determines that the
|
0025| defendant presents a likelihood of serious harm to himself or the
|
0001| likelihood of serious harm to others the department may commence
|
0002| proceedings pursuant to Article 1 of Chapter 43 NMSA 1978.
|

|
0004| D. The provisions of this section apply to all
|
0005| persons in the custody of the department of health as of July 1,
|
0006| 1997.".
|

|

0004| "B. If the court finds, by a preponderance of the

0005| evidence, that the defendant is mentally retarded, then no later
|
0006| than one year from the court's initial determination that the
|
0007| defendant is incompetent to stand trial, the department shall
|
0008| perform an evaluation to determine whether the defendant presents
|
0009| a likelihood of serious harm to himself or a likelihood of
|
0010| serious harm to others.

|
0012| C. If the department evaluation results in a finding
|
0013| that the defendant presents a likelihood of serious harm to
|
0014| himself or a likelihood of serious harm to others, within sixty
|
0015| days of the department's evaluation the department:
|
0016|
|
0017| (1) shall commence proceedings pursuant to Chapter
|
0018| 43, Article 1 NMSA 1978 if the defendant was charged with first
|
0019| degree homicide, first degree sexual penetration, criminal sexual
|
0020| contact of a minor or arson in the initial proceedings, and the
|
0021| court presiding over the initial proceedings shall enter a
|
0022| finding that the respondent presents a likelihood of harm to
|
0023| others; or
|
0024|
|
0025| (2) may commence proceedings pursuant to Chapter
|
0001| 43, Article 1 NMSA 1978 if the defendant was charged with any
|
0002| crime other than first degree homicide, first degree sexual
|
0003| penetration, criminal sexual contact of a minor or arson in the
|
0004| initial proceedings from which he was referred pursuant to this
|
0005| section to the department.
|

|

|
0009|
|
0010|
|
0011| D. The criminal charges shall be dismissed without
|
0012| prejudice after the hearing pursuant to Chapter 43, Article 1
|
0013| NMSA 1978 or upon expiration of fourteen months from the court's
|
0014| initial determination that the defendant is incompetent to stand
|
0015| trial.".
