0012| RELATING TO CRIMES; REMOVING THE TIME LIMITATION FOR
|
0013| PROSECUTION, TRIAL OR PUNISHMENT OF CAPITAL AND FIRST DEGREE
|
0014| FELONIES.

0016| BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF NEW MEXICO:
|
0017| Section 1. Section 30-1-8 NMSA 1978 (being Laws 1963,
|
0018| Chapter 303, Section 1-8, as amended) is amended to read:
|
0019| "30-1-8. TIME LIMITATIONS FOR COMMENCING PROSECUTION.--No
|
0020| person shall [hereafter] be prosecuted, tried or punished in
|
0021| any court of this state unless the indictment [shall be] is
|
0022| found or information or complaint is filed therefor within
|
0023| the time [hereinafter] as provided:
|
0024| [A. for a capital felony, within fifteen years
|
0025| from the time the crime was committed;
|
0001| B. for a first degree felony, within fifteen years
|
0002| from the time the crime was committed;
|
0003| C.] A. for a second degree felony, within six
|
0004| years from the time the crime was committed;
|
0005| [D.] B. for a third or fourth degree felony,
|
0006| within five years from the time the crime was committed;
|
0007| [E.] C. for a misdemeanor, within two years
|
0008| from the time the crime was committed;
|
0009| [F.] D. for a petty misdemeanor, within one
|
0010| year from the time the crime was committed;
|
0011| [G.] E. for any crime against or violation of
|
0012| the revenue laws of this state of Section 51-1-38 NMSA 1978,
|
0013| within three years from the time the crime was committed; [and
|
0014| H.] F. for any crime not contained in the
|
0015| Criminal Code, or where a limitation is not otherwise provided
|
0016| for, within three years from the time the crime was committed;
|
0017| and
|
0018| G. for a capital felony or a first degree felony,
|
0019| no limitation period shall exist and prosecution for these
|
0020| crimes may commence at any time after the occurrence of the
|
0021| crime."
|
0022| Section 2. EFFECTIVE DATE.--The effective date of the
|
0023| provisions of this act is July 1, 1997.
