0011| RELATING TO CRIMINAL LAW; AMENDING AN ELEMENT OF THE OFFENSE OF
|
0012| KIDNAPPING.
|

0014| BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF NEW MEXICO:
|
0015| Section 1. Section 30-4-1 NMSA 1978 (being Laws 1963,
|
0016| Chapter 303, Section 4-1, as amended) is amended to read:
|
0017| "30-4-1. KIDNAPPING.--
|
0018| A. Kidnapping is the unlawful taking, restraining,
|
0019| transporting or confining of a person, by force, intimidation
|
0020| or deception, with intent:
|
0021| (1) that the victim be held for ransom;
|
0022| (2) that the victim be held as a hostage or
|
0023| shield and confined against his will;
|
0024| (3) that the victim be held to service against
|
0025| the victim's will; or
|
0001| (4) to inflict death, physical injury or a
|
0002| sexual offense on the victim when the unlawful taking,
|
0003| restraining, transporting or confining of the victim is not
|
0004| merely incidental to the infliction of death, a physical injury
|
0005| or a sexual offense on the victim.
|
0006| B. Whoever commits kidnapping is guilty of a first
|
0007| degree felony, except that he is guilty of a second degree
|
0008| felony when he voluntarily frees the victim in a safe place and
|
0009| does not inflict great bodily harm upon the victim."
|
0010| Section 2. EFFECTIVE DATE.--The effective date of the
|
0011| provisions of this act is July 1, 1997.
