0012| OF THE WORTHLESS CHECK ACT; PROVIDING PRIVATE CIVIL REMEDIES;

0013| INCREASING THE AMOUNT OF PROCESSING FEES THAT MAY BE ASSESSED
|
0014| BY DISTRICT ATTORNEYS; AMENDING, REPEALING AND ENACTING
|
0015| SECTIONS OF THE WORTHLESS CHECK ACT; MAKING AN APPROPRIATION.
|

|
0017| BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF NEW MEXICO:
|
0018| Section 1. Section 30-36-1 NMSA 1978 (being Laws 1963,
|
0019| Chapter 315, Section 1) is amended to read:
|
0020| "30-36-1. SHORT TITLE. [This act] Chapter 30, Article
|
0021| 36 NMSA 1978 may be cited as the "Worthless Check Act"."
|
0022| Section 2. Section 30-36-5 NMSA 1978 (being Laws 1965,
|
0023| Chapter 114, Section 1) is amended to read:
|
0024| "30-36-5. PENALTY.--Any person violating Section [40-49-
|
0025| 4 New Mexico Statutes Annotated, 1953 Compilation] 30-36-4
|
0001| NMSA 1978 shall be punished as follows:
|
0002| A. when the amount of the check, draft or order or
|
0003| the total amount of the checks, drafts or orders [are for more
|
0004| than one dollar ($1.00) but less than twenty-five dollars
|
0005| ($25.00), imprisonment in the county jail for a term of not
|
0006| more than thirty days or a fine of not more than one hundred
|
0007| dollars ($100), or both such imprisonment and fine] is less
|
0008| than one hundred dollars ($100), the person is guilty of a
|
0009| petty misdemeanor;
|
0010| B. when the amount of the check, draft or order or
|
0011| the total amount of the checks, drafts or orders [are for
|
0012| twenty-five dollars ($25.00) or more, imprisonment in the
|
0013| penitentiary for a term of not less than one year nor more than
|
0014| three years or the payment of a fine of not more than one
|
0015| thousand dollars ($1,000) or both such imprisonment and fine]
|
0016| is one hundred dollars ($100) or more but less than two
|
0017| hundred fifty dollars ($250), the person is guilty of a
|
0018| misdemeanor;
|
0019| C. when the amount of the check, draft or order or
|
0020| the total amount of the checks, drafts or orders is two hundred
|
0021| fifty dollars ($250) or more but less than two thousand five
|
0022| hundred dollars ($2,500), the person is guilty of a fourth
|
0023| degree felony;
|
0024| D. when the amount of the check, draft or order or
|
0025| the total amount of the checks, drafts or orders is two
|
0001| thousand five hundred dollars ($2,500) or more but less than
|
0002| twenty thousand dollars ($20,000), the person is guilty of a
|
0003| third degree felony; and
|
0004| E. when the amount of the check, draft or order or
|
0005| the total amount of the checks, drafts or orders is twenty
|
0006| thousand dollars ($20,000) or more, the person is guilty of a
|
0007| second degree felony."
|
0008| Section 3. Section 30-36-10 NMSA 1978 (being Laws 1984,
|
0009| Chapter 110, Section 4) is amended to read:
|
0010| "30-36-10. DISTRICT ATTORNEY--PROCESSING FEE.--
|
0011| A. A district attorney is authorized to assess a
|
0012| processing fee against any person who is convicted of violating
|
0013| Section 30-36-4 NMSA 1978 and against any person who
|
0014| acknowledges violation of that section but for whom prosecution
|
0015| is waived by the district attorney. The processing fee
|
0016| assessed pursuant to this section shall not exceed:
|
0017| (1) [five dollars ($5.00) if the amount of the
|
0018| check, draft or order is less than twenty-five dollars
|
0019| ($25.00);
|
0020| (2) ten dollars ($10.00)] twenty-five
|
0021| dollars ($25.00) if the amount of the check, draft or order is
|
0022| [twenty-five dollars ($25.00) or more but] less than one
|
0023| hundred dollars ($100);
|
0024| [(3) thirty dollars ($30.00)] (2) seventy-
|
0025| five dollars ($75.00) if the amount of the check, draft or
|
0001| order is one hundred dollars ($100) or more but less than
|
0002| [three hundred dollars ($300)] two hundred fifty dollars
|
0003| ($250);
|
0004| [(4) fifty dollars ($50.00)] (3) one
|
0005| hundred fifty dollars ($150) if the amount of the check, draft
|
0006| or order is [three hundred dollars ($300)] two hundred fifty
|
0007| dollars ($250) or more but less than [five hundred dollars
|
0008| ($500)] two thousand five hundred dollars ($2,500); and
|
0009| [(5) seventy-five dollars ($75.00)] (4)
|
0010| five hundred dollars ($500) if the amount of the check, draft
|
0011| or order is [five hundred dollars ($500)] two thousand five
|
0012| hundred dollars ($2,500) or more.
|
0013| B. All processing fees collected by a district
|
0014| attorney pursuant to this section shall be transmitted to the
|
0015| administrative office of the district attorneys for credit to
|
0016| the district attorney fund."
|
0017| Section 4. A new section of the Worthless Check Act is
|
0018| enacted to read:
|
0019| "[NEW MATERIAL] PRIVATE CIVIL REMEDIES.--
|
0020| A. A person who receives a worthless check, draft
|
0021| or order may bring a civil action instead of seeking criminal
|
0022| prosecution of the issuer of the worthless check, draft or
|
0023| order. If the person who received a worthless check, draft or
|
0024| order prevails in his civil action, he may be awarded:
|
0025| (1) three times the amount of the worthless
|
0001| check, draft or order;
|
0002| (2) reasonable attorney fees and costs;
|
0003| (3) pre-judgment interest, at a rate of
|
0004| fifteen percent per year, on the amount of the worthless check,
|
0005| draft or order, beginning on the date of issuance of the
|
0006| worthless check, draft or order and continuing until it is
|
0007| repaid in full; and
|
0008| (4) post-judgment interest, at a rate of
|
0009| fifteen percent per year, on the amount of the judgment in the
|
0010| civil action, including attorney fees and costs.
|
0011| B. The provisions of Subsection A of this section
|
0012| apply when the amount of the worthless check, draft or order is
|
0013| two hundred fifty dollars ($250) or less."
|
0014| Section 5. REPEAL.--Section 30-36-9 NMSA 1978 (being Laws
|
0015| 1963, Chapter 315, Section 9) is repealed.
|
0016| Section 6. EFFECTIVE DATE.--The effective date of the
|
0017| provisions of this act is July 1, 1997.
