0011| RELATING TO ALTERNATIVE FUELS; DESIGNATING A WATER-PHASED
|
0012| HYDROCARBON FUEL EMULSION AS AN ALTERNATIVE FUEL; AMENDING
|
0013| SECTIONS OF THE NMSA 1978.

0015| BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF NEW MEXICO:
|
0016| Section 1. Section 7-16B-3 NMSA 1978 (being Laws 1995,
|
0017| Chapter 16, Section 3) is amended to read:
|
0018| "7-16B-3. DEFINITIONS.--As used in the Alternative Fuel
|
0019| Tax Act:
|
0020| A. "alternative fuel" means liquefied petroleum
|
0021| gas, compressed natural gas, [and] liquefied natural gas or
|
0022| a water-phased hydrocarbon fuel emulsion consisting of a
|
0023| hydrocarbon base and water in an amount not less than twenty
|
0024| percent by volume of the total water-phased fuel emulsion, all
|
0025| of which may be used for the generation of power to propel a
|
0001| motor vehicle on the highways;
|
0002| B. "alternative fuel user" means any user who is a
|
0003| registrant, owner or operator of a motor vehicle propelled by
|
0004| alternative fuel;
|
0005| C. "department" means the taxation and revenue
|
0006| department, the secretary of taxation and revenue or any
|
0007| employee of the department exercising authority lawfully
|
0008| delegated to that employee by the secretary;
|
0009| D. "distributor" means any person who delivers or
|
0010| dispenses alternative fuel into the [storage] supply tank
|
0011| of a motor vehicle;
|
0012| E. "gallon" means the quantity of liquid necessary
|
0013| to fill a standard United States gallon liquid measure, which
|
0014| is approximately 3.785 liters for liquid alternative fuel;
|
0015| provided, however, that in the case of a water-phased
|
0016| hydrocarbon fuel emulsion a gallon shall be measured only with
|
0017| respect to the hydrocarbon base portion of the emulsion and not
|
0018| to the water base portion, or one hundred fourteen cubic feet
|
0019| for nonliquid alternative fuel;
|
0020| F. "gross vehicle weight" means the weight of a
|
0021| motor vehicle or a combination motor vehicle without load, plus
|
0022| the weight of any load on the motor vehicle;
|
0023| G. "highway" means every road, highway,
|
0024| thoroughfare, street or way, including toll roads, generally
|
0025| open to the use of the public as a matter of right for the
|
0001| purpose of motor vehicle travel and notwithstanding that the
|
0002| same may be temporarily closed for the purpose of construction,
|
0003| reconstruction, maintenance or repair;
|
0004| H. "motor vehicle" means any self-propelled vehicle
|
0005| or device subject to registration under Section 66-3-1 NMSA
|
0006| 1978 that is used or may be used on the public highways in
|
0007| whole or in part for the purpose of transporting persons or
|
0008| property and includes any connected trailer or semitrailer;
|
0009| I. "person" means an individual or any other legal
|
0010| entity; "person" also means, to the extent permitted by law,
|
0011| any federal, state or other government or any department,
|
0012| agency or instrumentality of the state, county, municipality or
|
0013| any political subdivision thereof;
|
0014| J. "registrant" means any person who has registered
|
0015| a motor vehicle pursuant to the laws of this state or of
|
0016| another state;
|
0017| K. "sale" means any delivery, exchange, gift or
|
0018| other disposition;
|
0019| L. "secretary" means the secretary of taxation and
|
0020| revenue or the secretary's delegate;
|
0021| M. "supply tank" means any tank or other receptacle
|
0022| in which or by which fuel may be carried and supplied to the
|
0023| fuel-furnishing device or apparatus of the propulsion mechanism
|
0024| of a motor vehicle when the tank or receptacle either contains
|
0025| alternative fuel or alternative fuel is delivered into it;
|
0001| N. "use" means:
|
0002| (1) the receipt or placing of alternative fuel
|
0003| by an alternative fuel user into the fuel supply tank of any
|
0004| motor vehicle registered, owned or operated by the alternative
|
0005| fuel user;
|
0006| (2) the consumption by an alternative fuel
|
0007| user of alternative fuel in the propulsion of a motor vehicle
|
0008| on the highways of this state and any activity ancillary to
|
0009| that propulsion; or
|
0010| (3) the importation of alternative fuel in the
|
0011| fuel supply tank of any motor vehicle as fuel for the
|
0012| propulsion of the motor vehicle on the highways;
|
0013| O. "user" means any person other than the United
|
0014| States government or any of its agencies or instrumentalities;
|
0015| the state of New Mexico or any of its political subdivisions,
|
0016| agencies or instrumentalities; or an Indian nation, tribe or
|
0017| pueblo or any agency or instrumentality of an Indian nation,
|
0018| tribe or pueblo who uses alternative fuel to propel a motor
|
0019| vehicle on the highways; and
|
0020| P. the definitions of "alternative fuel user" and
|
0021| "distributor" shall be construed so that a person may at the
|
0022| same time be an alternative fuel user and a distributor."
|
0023| Section 2. Section 13-1B-2 NMSA 1978 (being Laws 1992,
|
0024| Chapter 58, Section 2, as amended) is amended to read:
|
0025| "13-1B-2. DEFINITIONS.--As used in the Alternative Fuel
|
0001| Conversion Act:
|
0002| A. "alternative fuel" means natural gas, liquefied
|
0003| petroleum gas, electricity, hydrogen, [or] a fuel mixture
|
0004| containing not less than eighty-five percent ethanol or
|
0005| methanol or a water-phased hydrocarbon fuel emulsion
|
0006| consisting of a hydrocarbon base and water in an amount not
|
0007| less than twenty percent by volume of the total water-phased
|
0008| fuel emulsion;
|
0009| B. "conventional fuel" means gasoline or diesel
|
0010| fuel;
|
0011| C. "department" means the general services
|
0012| department;
|
0013| D. "fund" means the alternative fuel conversion
|
0014| loan fund;
|
0015| E. "political subdivision" means a county,
|
0016| municipality or school district;
|
0017| F. "post-secondary institution" means two- and
|
0018| four-year public post-secondary institutions; and
|
0019| G. "vehicle" means a passenger car or light, medium
|
0020| or heavy duty truck."
