0011| RELATING TO PUBLIC SCHOOLS; AMENDING THE CALCULATION OF

0012| TRANSPORTATION ALLOCATIONS; CHANGING THE CALCULATION OF MILES
|
0013| TRAVELED PER STUDENT TRANSPORTED.

0015| BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF NEW MEXICO:
|
0016| Section 1. Section 22-8-29.1 NMSA 1978 (being Laws 1995,
|
0017| Chapter 208, Section 10) is amended to read:
|
0018| "22-8-29.1. CALCULATION OF TRANSPORTATION ALLOCATION.--
|
0019| A. The department [of education] shall calculate
|
0020| the transportation allocation for each school district in the
|
0021| following manner:
|
0022| (1) group [local] school districts on the
|
0023| basis of the average square miles served per student
|
0024| transported in the prior year;
|
0025| (2) in each group, calculate the prior year's
|
0001| average operational expenditure per student transported in each
|
0002| district;
|
0003| (3) calculate the average for the group by
|
0004| taking the total prior year's expenditure for the group and
|
0005| dividing it by the number of students in the group;
|
0006| (4) multiply the group average operational
|
0007| expenditure per student by the number of students transported
|
0008| on the fortieth day of the current year. Designate the product
|
0009| "A";
|
0010| (5) add "A" to the mileage supplement. The
|
0011| sum of "A" and the mileage supplement is "B";
|
0012| (6) for the 1995-96 and the 1996-97 school
|
0013| years, "B" shall not be less than ninety-five percent or more
|
0014| than one hundred fifteen percent of the district's previous
|
0015| year's operational allocation, provided that if "B" is less
|
0016| than ninety-five percent, "B" is deemed to equal ninety-five
|
0017| percent and if "B" is greater than one hundred fifteen percent,
|
0018| "B" is deemed equal to one hundred fifteen percent. Calculate
|
0019| "B" accordingly; and
|
0020| (7) multiply "B" by the transportation
|
0021| distribution adjustment factor and maintain that "B" shall not
|
0022| be less than ninety-five percent or more than one hundred
|
0023| fifteen percent of the district's previous year's operational
|
0024| allocation.
|
0025| B. For the 1997-98, 1998-99 and 1999-2000 school
|
0001| years, the transportation allocation for each school district
|
0002| shall not be less than ninety-five percent or more than one
|
0003| hundred fifteen percent of the 1996-97 school year's
|
0004| transportation allocation.
|
0005| C. For districts transporting [less] fewer than
|
0006| seventy-five students, the department [of education] may
|
0007| [utilize] use alternative calculation methods to determine
|
0008| the transportation allocation pursuant to regulation of the
|
0009| state board."
|
0010| Section 2. Section 22-8-29.2 NMSA 1978 (being Laws 1995,
|
0011| Chapter 208, Section 11) is amended to read:
|
0012| "22-8-29.2. GROUPING OF DISTRICTS--CALCULATION OF
|
0013| [AVERAGE SQUARE] NUMBER OF MILES [SERVED] TRAVELED PER
|
0014| STUDENT TRANSPORTED.--
|
0015| A. The department [of education] shall group
|
0016| school districts into not more than twelve groups. Groupings
|
0017| shall be made on the basis of the [average square] number
|
0018| of miles [served] traveled per student transported in the
|
0019| district in the [prior] current year on the fortieth day of
|
0020| school; provided, districts transporting [less] fewer than
|
0021| seventy-five students may be excluded from the groupings
|
0022| regardless of the [average square] miles per student
|
0023| transported.
|
0024| B. The [average square] number of miles
|
0025| [served] traveled per student transported shall be
|
0001| calculated by dividing the total [square] mileage [served]
|
0002| traveled by the district by the total number of students
|
0003| transported on the fortieth day of school in the following
|
0004| manner:
|
0005| "[average square] miles per student transported = total
|
0006| [square] miles [served] traveled by the district ö the
|
0007| total students transported [in the prior year] on the
|
0008| fortieth day of school"."
