ABEYTA | 0005| | 0006| | 0007| | 0008| | 0009| | 0010| AN ACT | 0011| RELATING TO CAPITAL EXPENDITURES; AUTHORIZING THE ISSUANCE OF | 0012| SEVERANCE TAX BONDS FOR VARIOUS CAPITAL PROJECTS IN MORA | 0013| COUNTY; MAKING APPROPRIATIONS; DECLARING AN EMERGENCY. | 0014| | 0015| BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF NEW MEXICO: | 0016| Section 1. SEVERANCE TAX BONDS--AUTHORIZATIONS-- | 0017| APPROPRIATION OF PROCEEDS.-- | 0018| A. The state board of finance may issue and sell | 0019| severance tax bonds in compliance with the Severance Tax | 0020| Bonding Act in an amount not to exceed the total of the amounts | 0021| authorized for purposes specified in Sections 2 through 5 of | 0022| this act. The state board of finance shall schedule the | 0023| issuance and sale of the bonds in the most expeditious and | 0024| economical manner possible upon a finding by the board that the | 0025| project has been developed sufficiently to justify the issuance | 0001| and that the project can proceed to contract within a | 0002| reasonable time. The state board of finance shall further take | 0003| the appropriate steps necessary to comply with the Internal | 0004| Revenue Code of 1986, as amended. Proceeds from the sale of | 0005| the bonds are appropriated for expenditure in Mora county for | 0006| the purposes specified in Sections 2 through 5 of this act. | 0007| B. The agencies named in Sections 2 through 5 of | 0008| this act shall certify to the state board of finance when the | 0009| money from the proceeds of the severance tax bonds authorized | 0010| in this section is needed for the purposes specified in the | 0011| applicable section of this act. | 0012| C. If the specified agency has not certified the | 0013| need for the issuance of the bonds by the end of fiscal year | 0014| 1999, the authorization provided in this act shall be void. | 0015| D. Unless otherwise specified in this act, any | 0016| unexpended or unencumbered balance remaining from the proceeds | 0017| of severance tax bonds issued pursuant to Sections 2 through 5 | 0018| of this act at the end of fiscal year 2000 shall revert to the | 0019| severance tax bonding fund. | 0020| Section 2. SEVERANCE TAX BONDS--DEPARTMENT OF FINANCE AND | 0021| ADMINISTRATION--PURPOSES.--Pursuant to the provisions of | 0022| Section 1 of this act, upon certification by the local | 0023| government division of the department of finance and | 0024| administration that the need exists for the issuance of the | 0025| bonds, the following amounts are appropriated to the local | 0001| government division of the department of finance and | 0002| administration for the following purposes in Mora county: | 0003| A. six hundred five thousand dollars ($605,000) for | 0004| the Mora county courthouse for various electrical and | 0005| mechanical renovations and remodeling necessary for compliance | 0006| with the federal Americans with Disabilities Act of 1990; | 0007| B. one million five hundred forty thousand dollars | 0008| ($1,540,000) for planning, designing, constructing and | 0009| equipping a county community and office center; | 0010| C. nine hundred thousand dollars ($900,000) for | 0011| planning, designing, constructing and equipping an addition to | 0012| the Mora county courthouse and remodeling parts of the existing | 0013| courthouse; | 0014| D. twenty-five thousand dollars ($25,000) for | 0015| planning, designing, constructing and equipping a road | 0016| department shop at the old county landfill; | 0017| E. three hundred twenty-five thousand dollars | 0018| ($325,000) for planning, designing, remodeling and equipping | 0019| the old county jail to accommodate juvenile prisoners, and for | 0020| purchasing and installing law enforcement equipment; | 0021| F. two hundred fifty thousand dollars ($250,000) | 0022| for purchasing and equipping a D-6-H bulldozer and two dump | 0023| trucks for county maintenance and road work; | 0024| G. two hundred seventy thousand dollars ($270,000) | 0025| for planning, designing, constructing, equipping and purchasing | 0001| land for a county fairgrounds; | 0002| H. one hundred twenty-five thousand dollars | 0003| ($125,000) for planning, designing, constructing, landscaping | 0004| and equipping a community park in the town of Mora; | 0005| I. one hundred thousand dollars ($100,000) for | 0006| purchasing and equipping an ambulance for the community of | 0007| Wagon Mound; | 0008| J. fifty thousand dollars ($50,000) for planning, | 0009| designing, constructing, remodeling and equipping the municipal | 0010| building in the community of Wagon Mound; and | 0011| K. fifty thousand dollars ($50,000) for planning, | 0012| designing, constructing and equipping a municipal building to | 0013| house emergency equipment in the community of Wagon Mound. | 0014| Section 3. SEVERANCE TAX BONDS--DEPARTMENT OF | 0015| ENVIRONMENT--PURPOSES.--Pursuant to the provisions of Section 1 | 0016| of this act, upon certification by the department of | 0017| environment that the need exists for the issuance of the bonds, | 0018| the following amounts are appropriated to the department of | 0019| environment for the following purposes in Mora county: | 0020| A. one million four hundred fifty-five thousand | 0021| dollars ($1,455,000) for planning, designing, constructing and | 0022| equipping a new domestic and wastewater system for the | 0023| unincorporated community of Mora, including line replacement, | 0024| installation of a seventy-five thousand gallon tank and | 0025| improvement of the settlement lagoons; | 0001| B. thirty-one thousand five hundred dollars | 0002| ($31,500) for improvements to and extension of the sanitary | 0003| sewer lines, including meter installations, in the community of | 0004| El Alto; | 0005| C. one million twenty-five thousand dollars | 0006| ($1,025,000) for planning, designing, constructing and | 0007| equipping improvements to various community domestic water and | 0008| wastewater systems throughout the county; and | 0009| D. one million six hundred forty-seven thousand | 0010| dollars ($1,647,000) for planning, designing, constructing and | 0011| equipping a new wastewater system, including new wastewater | 0012| lines, in the community of Watrous. | 0013| Section 4. SEVERANCE TAX BONDS--STATE DEPARTMENT OF | 0014| PUBLIC EDUCATION--PURPOSES.--Pursuant to the provisions of | 0015| Section 1 of this act, upon certification by the state | 0016| department of public education that the need exists for the | 0017| issuance of the bonds, the following amounts are appropriated | 0018| to the state department of public education for the following | 0019| purposes in Mora county: | 0020| A. two hundred twenty-three thousand nine hundred | 0021| ten dollars ($223,910) for improvements to the water system at | 0022| Mora high school, including upgrading the pressurized water | 0023| line system; | 0024| B. one hundred twenty thousand eight hundred fifty | 0025| dollars ($120,850) for planning, designing, constructing and | 0001| equipping the swimming pool at Mora high school; and | 0002| C. ninety thousand four hundred fifty dollars | 0003| ($90,450) for improvements to various schools in the Wagon | 0004| Mound public school district, including completely re-roofing | 0005| the high school building and plastering the gym building. | 0006| Section 5. SEVERANCE TAX BONDS--STATE HIGHWAY AND | 0007| TRANSPORTATION DEPARTMENT--PURPOSES.--Pursuant to the | 0008| provisions of Section 1 of this act, upon certification by the | 0009| state highway and transportation department that the need | 0010| exists for the issuance of the bonds, the following amounts are | 0011| appropriated to the state highway and transportation department | 0012| for the following purposes in Mora county: | 0013| A. one hundred forty thousand dollars ($140,000) | 0014| for improvements to Tramperos road, designated county road B- | 0015| 015; | 0016| B. one hundred thousand dollars ($100,000) for | 0017| improvements to Watrous road, designated C-022; | 0018| C. one hundred thousand dollars ($100,000) for | 0019| improvements to one and nine-tenths miles of county road A-002 | 0020| west of the junction with state road 94; and | 0021| D. three hundred thousand dollars ($300,000) for | 0022| improvements to El Alto road, designated A-030. | 0023| Section 6. EMERGENCY.--It is necessary for the public | 0024| peace, health and safety that this act take effect immediately. | 0025| - 6 - |
