0011| RELATING TO CORRECTIONS; ENACTING REGULATIONS THAT ALLOW RANDOM

0012| DRUG TESTING OF INMATES; REQUIRING CERTAIN INMATES TO
|
0013| PARTICIPATE IN DRUG REHABILITATION PROGRAMS; ENACTING A NEW
|
0014| SECTION OF THE NMSA 1978.
|

0016| BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF NEW MEXICO:
|
0017| Section 1. A new section of Chapter 33, Article 2 NMSA
|
0018| 1978 is enacted to read:
|
0019| "[NEW MATERIAL] REGULATIONS--RANDOM DRUG TESTING--
|
0020| REHABILITATION PROGRAM--CONDITION PRECEDENT TO EARNED
|
0021| MERITORIOUS DEDUCTIONS.--
|
0022| A. The corrections department, by December 31,
|
0023| 1997, shall adopt regulations for all adult correctional
|
0024| institutions operated by the department, or by a private
|
0025| company pursuant to a contract with the corrections department,
|
0001| for the implementation of a random drug testing program to
|
0002| detect use of one or more of the controlled substances listed
|
0003| in schedules I through V in the Controlled Substances Act. The
|
0004| regulations shall:
|
0005| (1) ensure that the laboratories used for
|
0006| testing for controlled substances shall use the best available
|
0007| technology to ensure the complete reliability and accuracy of
|
0008| controlled substances tests;
|
0009| (2) include strict procedures governing the
|
0010| chain of custody of specimens collected for controlled
|
0011| substances testing;
|
0012| (3) provide that each specimen be subdivided,
|
0013| secured and labeled in the presence of the tested individual
|
0014| and that a portion of the specimen be retained in a secure
|
0015| manner to prevent the possibility of tampering, so that if the
|
0016| inmate's results are positive, the inmate has an opportunity to
|
0017| have the retained part retested by another laboratory within
|
0018| three days after being advised of the results of the first
|
0019| test;
|
0020| (4) provide for the confidentiality of test
|
0021| results and medical information, except information about
|
0022| controlled substance abuse; provided, however, that this
|
0023| paragraph shall not be construed to limit the use of the test
|
0024| results for the orderly imposition of sanctions under this
|
0025| section; and
|
0001| (5) ensure that inmates are selected for tests
|
0002| by nondiscriminatory and impartial methods, so that no inmate
|
0003| is harassed by being treated differently from other inmates in
|
0004| similar circumstances.
|
0005| B. The rules and regulation adopted pursuant to
|
0006| Subsection A of this section shall establish requirements for
|
0007| rehabilitation programs that provide for the identification and
|
0008| opportunity for treatment of any inmate who is found to have
|
0009| used a controlled substance in violation of law. The rules and
|
0010| regulations shall provide that an inmate who is found to have
|
0011| used a controlled substance in violation of law and who refuses
|
0012| to participate in a rehabilitation program pursuant to this
|
0013| subsection shall not be eligible for monetary compensation for
|
0014| work performed or for meritorious deductions as set forth in
|
0015| Section 33-2-34 NMSA 1978.
|
0016| C. The rules and regulations adopted pursuant to
|
0017| Subsection A of this section shall also provide that:
|
0018| (1) an inmate who has tested positive for the
|
0019| use of a controlled substance in violation of law shall be
|
0020| retested at least every sixty days for the remainder of the
|
0021| term for which he was sentenced;
|
0022| (2) an inmate who retests positive for the use
|
0023| of a controlled substance in violation of law shall forfeit all
|
0024| meritorious deductions earned by that inmate; and
|
0025| (3) an inmate who retests positive shall be
|
0001| confined to solitary confinement for a period of not less than
|
0002| twelve months from the date of the retest."
|
0003| Section 2. EFFECTIVE DATE.--The effective date of the
|
0004| provisions of this act is July 1, 1997.
