0011| RELATING TO PUBLIC PROPERTY; PROVIDING FOR ADDITIONAL METHODS

0012| OF DISPOSITION OF OBSOLETE, WORN-OUT AND UNUSABLE TANGIBLE
|
0013| PERSONAL PROPERTY.
|

0015| BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF NEW MEXICO:
|
0016| Section 1. Section 13-6-1 NMSA 1978 (being Laws
|
0017| 1961, Chapter 100, Section 1, as amended) is amended to read:
|
0018| "13-6-1. DISPOSITION OF OBSOLETE, WORN-OUT AND UNUSABLE
|
0019| TANGIBLE PERSONAL PROPERTY.--
|
0020| A. The governing authority of each state agency,
|
0021| local public body, school district and state educational
|
0022| institution may dispose of any item of tangible personal
|
0023| property belonging to that authority and delete the item from
|
0024| its public inventory upon a specific finding by the authority
|
0025| that the item of property is:
|
0001| (1) of a current resale value of five thousand
|
0002| dollars ($5,000) or less; and
|
0003| (2) worn-out, unusable or obsolete to the
|
0004| extent that the item is no longer economical or safe for
|
0005| continued use by the body.
|
0006| B. The governing authority shall, as a prerequisite
|
0007| to the disposition of any items of tangible personal
|
0008| property:
|
0009| (1) designate a committee of at least three
|
0010| officials of the governing authority to approve and oversee
|
0011| such disposition; and
|
0012| (2) give notification at least thirty days
|
0013| prior to its action making such deletion by sending a copy of
|
0014| its official finding and the proposed disposition of the
|
0015| property to the state auditor and any other appropriate or
|
0016| required authority, duly sworn and subscribed under oath by
|
0017| each member of the authority approving the action.
|
0018| C. A copy of the official finding and proposed
|
0019| disposition of the tangible personal property sought to be
|
0020| disposed of shall be made a permanent part of the official
|
0021| minutes of the governing authority or otherwise maintained as
|
0022| a public record subject to the Inspection of Public Records
|
0023| Act.
|
0024| D. The governing authority shall dispose of the
|
0025| [item] tangible personal property by negotiated sale,
|
0001| trade or donation to other state agencies, local public
|
0002| bodies, school districts, state educational institutions or
|
0003| municipalities or through the central purchasing office by
|
0004| means of competitive sealed bid or public auction or through
|
0005| the federal property assistance bureau of the general services
|
0006| department. If the governing authority is unable to dispose of
|
0007| any item of tangible personal property by the methods listed in
|
0008| this section, the governing authority may donate the items of
|
0009| tangible personal property to any charitable organization
|
0010| registered with the office of the attorney general pursuant to
|
0011| the Charitable Organizations and Solicitations Act.
|
0012| E. If the governing authority cannot sell or
|
0013| dispose of any item of tangible personal property by any of the
|
0014| methods listed in this section, it may order that the property
|
0015| be properly destroyed or otherwise permanently disposed of in
|
0016| accordance with applicable laws, rules and regulations.
|
0017| F. If the governing authority determines that any
|
0018| item of tangible personal property is hazardous and may not,
|
0019| under any circumstances, be used safely, such item may only be
|
0020| disposed of pursuant to the provisions of Subsection E of this
|
0021| section.
|
0022| G. In no event shall any item of tangible personal
|
0023| property be donated to any employees, or relative of an
|
0024| employee, of any state agency or local public body; provided
|
0025| that nothing in this section shall preclude an employee from
|
0001| participating and bidding for public property at a public
|
0002| auction.
|
0003| [E.] H. This section shall not apply to any
|
0004| tangible personal property acquired by a museum through
|
0005| abandonment procedures pursuant to the Abandoned Cultural
|
0006| Properties Act."
