0011|     RELATING TO PER DIEM AND MILEAGE OF LEGISLATIVE MEMBERS;
    |
0012|     AMENDING CERTAIN SECTIONS OF THE NMSA 1978 TO COMPLY WITH
    |
0013|     ARTICLE 4, SECTION 10 OF THE CONSTITUTION OF NEW MEXICO.

0015|     BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF NEW MEXICO:
    |
0016|          Section 1.  Section 2-1-8 NMSA 1978 (being Laws 1955,
    |
0017|     Chapter 2, Section 1, as amended) is amended to read:
    |
0018|          "2-1-8.  SESSION PER DIEM AND MILEAGE OF MEMBERS.--Each
    |
0019|     member of the legislature shall receive [as per diem expense
    |
0020|     the sum of seventy-five dollars ($75.00) for each day's
    |
0021|     attendance during each session and twenty-five cents ($.25) per
    |
0022|     mile for each mile traveled in going to and returning from the
    |
0023|     seat of government by the usual traveled route once each
    |
0024|     session] per diem at the internal revenue service per diem
    |
0025|     rate in effect on January 1 of each year for the city of Santa
    |
0001|     Fe for each day's attendance during each session of the
    |
0002|     legislature and the internal revenue service standard mileage
    |
0003|     rate in effect on January 1 of each year rounded to the nearest
    |
0004|     whole cent for each mile traveled in going to and returning
    |
0005|     from the seat of government by the usual traveled route, once
    |
0006|     each session as defined by Article 4, Section 5 of the
    |
0007|     constitution of New Mexico."
    |
0008|          Section 2.  Section 2-1-9 NMSA 1978 (being Laws 1971,
    |
0009|     Chapter 1, Section 11, as amended) is amended to read:
    |
0010|          "2-1-9.  OUT-OF-STATE TRAVEL--IN-STATE TRAVEL.--
    |
0011|               A.  Out-of-state travel of members, officers and
    |
0012|     employees of the legislative branch of government shall be
    |
0013|     exempt from approval by any member of the executive branch.
    |
0014|               B.  Members of the legislature serving on official
    |
0015|     business for interim committees shall receive per diem at the
    |
0016|     [rate of seventy-five dollars ($75.00) a day] internal
    |
0017|     revenue service per diem rate in effect on January 1 of each
    |
0018|     year each day served, including travel time, and the cost of
    |
0019|     public transportation by the shortest, most direct route or
    |
0020|     mileage for each mile traveled by privately owned automobiles
    |
0021|     at the [rate of twenty-five cents ($.25) a mile] internal
    |
0022|     revenue service standard mileage rate in effect on January 1 of
    |
0023|     each year rounded to the nearest whole cent or by privately
    |
0024|     owned aircraft at the rate of [thirty cents ($.30)] ten
    |
0025|     cents ($.10) more than the rate paid for privately owned
    |
0001|     automobiles per air mile on official business of the
    |
0002|     [committee] committees within the state, by the shortest,
    |
0003|     most direct route.
    |
0004|               C.  Reimbursement for out-of-state travel on
    |
0005|     committee business shall be as follows:
    |
0006|                    (1)  the cost of the tickets on public
    |
0007|     transportation by the shortest, most direct route; or
    |
0008|                    (2)  mileage at the same rates established for
    |
0009|     in-state travel if private automobiles or airplanes are used,
    |
0010|     based on official mileage by the shortest, most direct route;
    |
0011|     [and]
    |
0012|                    (3)  per diem for the number of days spent in
    |
0013|     travel and on committee business; and
    |
0014|                    (4)  in no event, however, shall the
    |
0015|     reimbursement for out-of-state travel exceed the dollar amount
    |
0016|     that would be due if the member had used first class public air
    |
0017|     transportation by the shortest, most direct route."
