0011| MAKING AN APPROPRIATION FOR ADDITIONAL JUVENILE CORRECTIONS

0012| BEDS; DECLARING AN EMERGENCY.

0014| BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF NEW MEXICO:
|
0015| Section 1. APPROPRIATION.--Three million nine hundred
|
0016| thousand dollars ($3,900,000) is appropriated from the general
|
0017| fund to the children, youth and families department for
|
0018| expenditure in fiscal years 1997 and 1998 to acquire, install,
|
0019| equip and furnish a total of three fifty-bed secure modulars to
|
0020| house high-risk youthful offenders at the New Mexico boys'
|
0021| school, the youth diagnostic and development center or any
|
0022| other appropriate juvenile facility operated by the department.
|
0023| Any unexpended or unencumbered balance remaining at the end of
|
0024| fiscal year 1998 shall revert to the general fund.
|
0025| Section 2. EMERGENCY.--It is necessary for the public
|
0001| peace, health and safety that this act take effect immediately.

0014| 1. On page 1, line 11, strike "MAKING AN APPROPRIATION" and
|
0015| insert in lieu thereof "AUTHORIZING THE ISSUANCE OF SEVERANCE TAX
|
0016| BONDS AND MAKING APPROPRIATIONS".
|

0018| 2. On page 1, between lines 14 and 15, insert the following
|
0019| new section:
|

|
0021| "Section 1. SEVERANCE TAX BONDS--PURPOSE FOR WHICH ISSUED--
|
0022| APPROPRIATION OF PROCEEDS.--The state board of finance may issue
|
0023| and sell severance tax bonds in compliance with the Severance Tax
|
0024| Bonding Act in an amount not exceeding seven million seven
|
0025| hundred thousand dollars ($7,700,000) when the property control
|
0001| division of the general services department certifies the need
|
0002| for the issuance of the bonds. The state board of finance shall
|
0003| schedule the issuance and sale of the bonds in the most
|
0004| expeditious and economical manner possible upon a finding by the
|
0005| board that the project has been developed sufficiently to justify
|
0006| the issuance and that the project can proceed to contract within
|
0007| a reasonable time. The state board of finance shall further take
|
0008| the appropriate steps necessary to comply with the Internal
|
0009| Revenue Code of 1986, as amended. The proceeds from the sale of
|
0010| the bonds are appropriated to the capital program fund to plan,
|
0011| design, construct, equip and furnish a one-hundred bed care,
|
0012| rehabilitation and treatment facility for male adjudicated
|
0013| delinquents committed to the children, youth and families
|
0014| department in the middle Rio Grande corridor. Any unexpended or
|
0015| unencumbered balance remaining at the end of fiscal year 2000
|
0016| shall revert to the severance tax bonding fund. If the property
|
0017| control division has not certified the need for the issuance of
|
0018| the bonds by the end of fiscal year 1999, the authorization
|
0019| provided in this section shall be void.".
|

0021| 3. Renumber the succeeding sections accordingly.
|

|
0023| 4. On page 1, lines 15 and 16, strike "Three million nine
|
0024| hundred thousand dollars ($3,900,000)" and insert in lieu thereof
|
0025| "Four million four hundred thousand dollars ($4,400,000)".
