KING | 0005| | 0006| | 0007| | 0008| | 0009| | 0010| AN ACT | 0011| RELATING TO OPEN MEETINGS; REVISING ENFORCEMENT PROVISIONS OF | 0012| THE OPEN MEETINGS ACT. | 0013| | 0014| BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF NEW MEXICO: | 0015| Section 1. Section 10-15-3 NMSA 1978 (being Laws 1974, | 0016| Chapter 91, Section 3, as amended) is amended to read: | 0017| "10-15-3. INVALID ACTIONS--STANDING.-- | 0018| A. No resolution, rule, regulation, ordinance or | 0019| action of any board, commission, committee or other | 0020| policymaking body shall be valid unless taken or made at a | 0021| meeting held in accordance with the requirements of Section 10- | 0022| 15-1 NMSA 1978. Every resolution, rule, regulation, ordinance | 0023| or action of any board, commission, committee or other | 0024| policymaking body shall be presumed to have been taken or made | 0025| at a meeting held in accordance with the requirements of | 0001| Section 10-15-1 NMSA 1978. | 0002| B. All provisions of the Open Meetings Act shall be | 0003| enforced by the attorney general or by the district attorney in | 0004| the county of jurisdiction. However, nothing in that act shall | 0005| prevent an individual from independently applying for | 0006| enforcement through the district courts, provided that the | 0007| individual first provides written notice of the claimed | 0008| violation to the public body and that the public body has | 0009| denied or not acted on the claim within fifteen days of | 0010| receiving it. A public meeting held to address a claimed | 0011| violation of the Open Meetings Act shall include a summary of | 0012| comments made at the meeting at which the claimed violation | 0013| occurred. | 0014| C. The district courts of this state shall have | 0015| jurisdiction, upon the application of any person to enforce the | 0016| purpose of the Open Meetings Act, by injunction, mandamus or | 0017| other appropriate order. The court shall award damages, costs | 0018| and reasonable attorney fees to any person who is successful in | 0019| bringing a court action to enforce the provisions of the Open | 0020| Meetings Act. If the prevailing party in [that] a legal | 0021| action brought under this section is a public body defendant, | 0022| it shall be awarded court costs. | 0023| D.
