0011| RELATING TO JUDGES; PROVIDING FOR AN ADDITIONAL JUDGE IN THE

0012| FIRST JUDICIAL DISTRICT; MAKING AN APPROPRIATION; DECLARING AN
|
0013| EMERGENCY.

0015| BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF NEW MEXICO:
|
0016| Section 1. Section 34-6-4 NMSA 1978 (being Laws 1968,
|
0017| Chapter 69, Section 7, as amended) is amended to read:
|
0018| "34-6-4. JUDGES--FIRST JUDICIAL DISTRICT.--There shall be
|
0019| [six] seven district judges in the first judicial
|
0020| district."
|
0021| Section 2. TEMPORARY PROVISION--APPOINTMENT--ELECTION.--
|
0022| The governor shall appoint one additional district judge to
|
0023| serve in the first judicial district beginning July 1, 1997.
|
0024| Thereafter, the office shall be filled by persons elected to
|
0025| that office. The first election to the office shall be held at
|
0001| the general election in 1998.
|
0002| Section 3. APPROPRIATION.--Two hundred ninety-seven
|
0003| thousand five hundred seventy-seven dollars ($297,577) is
|
0004| appropriated from the general fund to the administrative office
|
0005| of the courts for expenditure in fiscal year 1998 to pay the
|
0006| cost of adding an additional judgeship in the first judicial
|
0007| district, including salary and benefits, training and office
|
0008| equipment, furnishings and supplies. Any unexpended or
|
0009| unencumbered balance remaining at the end of the fiscal year
|
0010| 1998 shall revert to the general fund.
|
0011| Section 4. EMERGENCY.--It is necessary for the public
|
0012| peace, health and safety that this act take effect immediately.
