SANDOVAL | 0005| | 0006| | 0007| | 0008| | 0009| | 0010| AN ACT | 0011| RELATING TO MOTOR VEHICLE DEALER FRANCHISES; LIMITING THE TIME | 0012| PERIOD FOR CERTAIN AUDITS. | 0013| | 0014| BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF NEW MEXICO: | 0015| Section 1. Section 57-16-7 NMSA 1978 (being Laws 1973, | 0016| Chapter 6, Section 7, as amended) is amended to read: | 0017| "57-16-7. WARRANTY CLAIMS--PAYMENT.-- | 0018| A. Every manufacturer, distributor or | 0019| representative shall properly fulfill any warranty agreement | 0020| and adequately and fairly compensate each of its motor vehicle | 0021| dealers for labor, parts and other expenses incurred by the | 0022| dealer to perform the required warranty repairs. All | 0023| compensation for labor shall be the same as the dealer would | 0024| have made to and collected from an individual retail customer | 0025| for the same repairs if performed in the normal course of | 0001| business not covered by a warranty. Compensation for parts | 0002| shall be in an amount not less than the manufacturer's warranty | 0003| reimbursement rate for parts or the amount received by the | 0004| motor vehicle dealer from retail customers for parts used in | 0005| non-warranty work of like kind. All claims made by motor | 0006| vehicle dealers [under] pursuant to provisions of this | 0007| section and [under] Section 57-16-6 NMSA 1978 shall be paid | 0008| within thirty days following their approval. All claims shall | 0009| be either approved or disapproved within thirty days after | 0010| their receipt, and when any claim is disapproved, the motor | 0011| vehicle dealer who submits it shall be notified in writing of | 0012| its disapproval within that period, and each notice shall state | 0013| the specific grounds upon which the disapproval is based. Any | 0014| special handling of claims required by the manufacturer, | 0015| distributor or representative not uniformly required of all | 0016| dealers of that make may be enforced only after thirty days' | 0017| notice in writing and upon good and sufficient reason. A | 0018| manufacturer or distributor may audit a warranty claim only | 0019| during the twelve-month period immediately following payment or | 0020| credit issued for the claim; however, this limitation shall not | 0021| apply if there is a reasonable suspicion of fraud. | 0022| B. The provisions of this section shall not apply | 0023| to recreational travel trailers or to parts of systems, | 0024| fixtures, appliances, furnishings, accessories and features of | 0025| motor homes." | 0001| Section 2.
