0012| AUTHORIZE SENIOR ORGANIZATIONS LICENSED AND FUNDED BY THE STATE

0013| AGENCY ON AGING TO APPLY FOR A LICENSE UNDER THE BINGO AND
|
0014| RAFFLE ACT.

0016| BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF NEW MEXICO:
|
0017| Section 1. Section 60-2B-3 NMSA 1978 (being Laws 1981,
|
0018| Chapter 259, Section 3, as amended) is amended to read:
|
0019| "60-2B-3. DEFINITIONS.--As used in the Bingo and Raffle
|
0020| Act:
|
0021| A. "charitable organization" means any
|
0022| organization, not for pecuniary profit, [which] that is
|
0023| operated for the relief of poverty, distress or other condition
|
0024| of public concern in New Mexico and [which] that has been
|
0025| so engaged for three years immediately prior to making ap-
|
0001|
|
0002| plication for a license under the Bingo and Raffle Act and
|
0003| [which] that has been granted an exemption from federal
|
0004| income tax by the United States commissioner of internal
|
0005| revenue as an organization described in Section 501 (c) of the
|
0006| United States Internal Revenue Code of [1954, as amended or
|
0007| renumbered] 1986;
|
0008| B. "chartered branch, lodge or chapter of a
|
0009| national or state organization" means any branch, lodge or
|
0010| chapter [which] that is a civic or service organization,
|
0011| not for pecuniary profit, and authorized by its written
|
0012| constitution, charter, articles of incorporation or bylaws to
|
0013| engage in a fraternal, civic or service purpose in New Mexico
|
0014| and [which] that has been so engaged for three years
|
0015| immediately prior to making application for a license under the
|
0016| Bingo and Raffle Act;
|
0017| C. "educational organization" means any
|
0018| organization within the state, not organized for pecuniary
|
0019| profit, whose primary purpose is educational in nature and
|
0020| designed to develop the capabilities of individuals by
|
0021| instruction and [which] that has been in existence in New
|
0022| Mexico for three years immediately prior to making application
|
0023| for a license under the Bingo and Raffle Act;
|
0024| D. "fraternal organization" means any organization
|
0025| within the state, except college and high school fraternities,
|
0001| not for pecuniary profit, [which] that is a branch, lodge
|
0002| or chapter of a national or state organization and exists for
|
0003| the common business, brotherhood or other interests of its
|
0004| members and [which] that has existed in New Mexico for
|
0005| three years immediately prior to making application for a
|
0006| license under the Bingo and Raffle Act;
|
0007| E. "labor organization" means any organization, not
|
0008| for pecuniary profit, within the state [which] that exists
|
0009| for the purpose, in whole or in part, of dealing with employers
|
0010| concerning grievances, labor disputes, wages, rates of pay,
|
0011| hours of employment or conditions of work and [which] that
|
0012| has existed in New Mexico for that purpose and has been so
|
0013| engaged for three years immediately prior to making application
|
0014| for a license under the Bingo and Raffle Act;
|
0015| F. "senior organization" means any organization or
|
0016| center within the state, not for pecuniary profit, that is
|
0017| licensed and funded pursuant to approved area plans by the
|
0018| state agency on aging, whose members gather for a common social
|
0019| and recreational purpose and that has existed in New Mexico for
|
0020| three years immediately prior to making application for a
|
0021| license under the Bingo and Raffle Act;
|
0022| [F.] G. "qualified organization" means any bona
|
0023| fide chartered branch, lodge or chapter of a national or state
|
0024| organization or any bona fide religious, charitable,
|
0025| environmental, fraternal, educational or veterans' organization
|
0001| operating without profit to its members [which] that has
|
0002| been in existence in New Mexico continuously for a period of
|
0003| three years immediately prior to the making of an application
|
0004| for a license under the Bingo and Raffle Act and [which]
|
0005| that has had, during the entire three-year period, a dues-
|
0006| paying membership engaged in carrying out the objects of the
|
0007| corporation or organization. A voluntary firemen's or-
|
0008|
|
0009| ganization is a qualified organization and a labor organization
|
0010| is a qualified organization for the purpose of the Bingo and
|
0011| Raffle Act if it uses the proceeds from a game of chance solely
|
0012| for scholarship or charitable purposes;
|
0013| [G.] H. "environmental organization" means any
|
0014| organization primarily concerned with the protection and
|
0015| preservation of the natural environment and [which] that
|
0016| has existed in New Mexico for three years immediately prior to
|
0017| making application for a license under the Bingo and Raffle
|
0018| Act;
|
0019| [H.] I. "religious organization" means any
|
0020| organization, church, body of communicants or group, not for
|
0021| pecuniary profit, gathered in common membership for mutual
|
0022| support and edification in piety, worship and religious
|
0023| observances or a society, not for pecuniary profit, of
|
0024| individuals united for religious purposes at a definite place,
|
0025| [which] and the organization, church, body of communicants,
|
0001| group or society has been so gathered or united in New Mexico
|
0002| for three years immediately prior to making application for a
|
0003| license under the Bingo and Raffle Act;
|
0004| [I.] J. "veterans' organization" means any
|
0005| organization within the state or any branch, lodge or chapter
|
0006| of a national or state organization within this state, not for
|
0007| pecuniary profit, the membership of which consists of
|
0008| individuals who were members of the armed services or forces of
|
0009| the United States, [which] that has been in existence in
|
0010| New Mexico for three years immediately prior to making
|
0011| application for a license under the Bingo and Raffle Act;
|
0012| [J.] K. "voluntary firemen's organization"
|
0013| means any organization for firefighting within the state, not
|
0014| for pecuniary profit, established by the state or any of its
|
0015| political subdivisions, [which] that has been in existence
|
0016| in New Mexico for three years immediately prior to making
|
0017| application for a license under the Bingo and Raffle Act;
|
0018| [K.] L. "dues-paying membership" means those
|
0019| members of an organization who pay regular monthly, annual or
|
0020| other periodic dues or who are excused from paying such dues by
|
0021| the charter, articles of incorporation or bylaws of the
|
0022| organization and those who contribute voluntarily to the
|
0023| corporation or organization to which they belong for the
|
0024| support of the corporation or organization;
|
0025| [L.] M. "equipment" means, with respect to
|
0001| bingo or lotto, the receptacle and numbered objects drawn from
|
0002| it; the master board upon which the numbered objects are placed
|
0003| as drawn; the cards or sheets bearing numbers or other
|
0004| designations to be covered and the objects used to cover them;
|
0005| the board or signs, however operated, used to announce or
|
0006| display the numbers or designations as they are drawn; the
|
0007| public address system; and all other articles essential to the
|
0008| operation, conduct and playing of bingo or lotto; or, with
|
0009| respect to raffles, implements, devices and machines designed,
|
0010| intended or used for the conduct of raffles and the
|
0011| identification of the winning number or unit and the ticket or
|
0012| other evidence or right to participate in raffles;
|
0013| [M.] N. "game of chance" means that specific
|
0014| kind of game of chance commonly known as bingo or lotto in
|
0015| which prizes are awarded on the basis of designated numbers or
|
0016| symbols on a card conforming to numbers or symbols selected at
|
0017| random and that specific kind of game of chance commonly known
|
0018| as raffles [which] that is conducted by drawing for prizes
|
0019| or the allotment of prizes by chance or by the selling of
|
0020| shares, tickets or rights to participate in the game;
|
0021| [N.] O. "gross receipts" means receipts from
|
0022| the sale of shares, tickets or rights in any manner connected
|
0023| with participation in a game of chance or the right to
|
0024| participate in a game of chance, including any admission fee or
|
0025| charge, the sale of equipment or supplies and all other
|
0001| miscellaneous receipts;
|
0002| [O.] P. "lawful purposes" means educational,
|
0003| charitable, patriotic, religious or public-spirited purposes,
|
0004| which terms are defined to be the benefiting of an indefinite
|
0005| number of persons either by bringing their minds or hearts
|
0006| under the influence of education or religion, by relieving
|
0007| their bodies from disease, suffering or constraint, by as-
|
0008|
|
0009| sisting them in establishing themselves in life, by erecting or
|
0010| maintaining public buildings or works, by providing legal
|
0011| assistance to peace officers or firemen in defending civil or
|
0012| criminal actions arising out of the performance of their duties
|
0013| or by otherwise lessening the burden of government. These
|
0014| terms include the erection, acquisition, improvement,
|
0015| maintenance, insurance or repair of property, real, personal or
|
0016| mixed, if the property is used for one or more of the purposes
|
0017| stated in this subsection;
|
0018| [P.] Q. "lawful use" means the devotion of the
|
0019| entire net proceeds of a game of chance exclusively to lawful
|
0020| purposes;
|
0021| [Q.] R. "licensee" means any qualified
|
0022| organization to which a license has been issued by the
|
0023| licensing authority;
|
0024| [R.] S. "licensing authority" means the
|
0025| regulation and licensing department;
|
0001| [S.] T. "member" means an individual who has
|
0002| qualified for membership in a qualified organization pursuant
|
0003| to its charter, articles of incorporation, bylaws, rules or
|
0004| other written statement;
|
0005| [T.] U. "net proceeds" means the receipts less
|
0006| the expenses, charges, fees and deductions as are specifically
|
0007| authorized under the Bingo and Raffle Act;
|
0008| [U.] V. "occasion" means a single gathering or
|
0009| session at which a series of successive bingo or lotto games is
|
0010| played;
|
0011| [V.] W. "person" means a natural person, firm,
|
0012| association, corporation or other legal entity; and
|
0013| [W.] X. "premises" means any room, hall,
|
0014| enclosure or outdoor area used for the purpose of playing a
|
0015| game of chance."
|
0016| Section 2. Section 60-2B-5 NMSA 1978 (being Laws 1981,
|
0017| Chapter 259, Section 5) is amended to read:
|
0018| "60-2B-5. ORGANIZATIONS ENTITLED TO LICENSES--FEES.--
|
0019| A. Any bona fide chartered branch, lodge or chapter
|
0020| of a national or state organization or any bona fide religious,
|
0021| charitable, labor, environmental, fraternal, senior,
|
0022| educational or veterans' organization [which] that operates
|
0023| without profit to its members and [which] that has been in
|
0024| existence in New Mexico continuously for a period of three
|
0025| years immediately prior to the making of application for a
|
0001| license under the Bingo and Raffle Act and has had, during the
|
0002| making of application for a license under that act and during
|
0003| the entire three-year period, dues-paying [members]
|
0004| membership, except in a senior organization, engaged in
|
0005| carrying out the objects of the corporation or organization is
|
0006| eligible for a license to be issued by the licensing authority
|
0007| under the Bingo and Raffle Act. In the event any license is
|
0008| revoked, the licensee and holder [thereof] of the license
|
0009| is not eligible to apply for another license under Subsection B
|
0010| of this section until after the expiration of the period of one
|
0011| year from the date of [such] revocation. Any voluntary
|
0012| firemen's organization established by the state or any
|
0013| political subdivision and [which] that has been in
|
0014| existence in New Mexico for three years shall also be an
|
0015| organization entitled to a license under the provisions of that
|
0016| act.
|
0017| B. The licenses provided by the Bingo and Raffle
|
0018| Act shall be issued by the licensing authority to applicants
|
0019| qualified under that act upon payment of a fee of one hundred
|
0020| dollars ($100), with the exception of a senior organization,
|
0021| which shall pay a fee of five dollars ($5.00). The licenses
|
0022| shall expire at the end of the calendar year in which they are
|
0023| issued by the licensing authority and may be renewed by the
|
0024| licensing authority upon the filing of an application for
|
0025| renewal provided by the licensing authority and the payment of
|
0001| a fee of one hundred dollars ($100) for the renewal with the
|
0002| exception of a senior organization, which shall pay a fee of
|
0003| five dollars ($5.00). No license or renewal granted under
|
0004| that act [shall be] is transferable."
|
0005| Section 3. Section 60-2B-6 NMSA 1978 (being Laws 1981,
|
0006| Chapter 259, Section 6) is amended to read:
|
0007| "60-2B-6. APPLICATION FOR LICENSE.--
|
0008| A. Each applicant for a license to be issued under
|
0009| the provisions of this section shall file with the licensing
|
0010| authority a written application in duplicate in the form
|
0011| prescribed by the licensing authority, duly executed and
|
0012| verified, [and] in which shall be stated:
|
0013| (1) the name and address of the applicant;
|
0014| (2) sufficient facts relating to [its] the
|
0015| applicant's incorporation and organization to enable the
|
0016| licensing authority to determine whether or not it is a bona
|
0017| fide chartered branch, lodge or chapter of a national or state
|
0018| organization or a bona fide religious, charitable, labor,
|
0019| environmental, fraternal, educational, senior, voluntary
|
0020| firemen's or veterans' organization [which] that operates
|
0021| without profit to its members and [which] that has been in
|
0022| existence continuously in New Mexico for a period of three
|
0023| years immediately prior to the making of application for a
|
0024| license and that has had during the entire three-year period
|
0025| dues-paying [members] membership, except in a senior
|
0001| organization, engaged in carrying out the objectives of the
|
0002| applicant;
|
0003| (3) the names and addresses of [its] the
|
0004| applicant's officers;
|
0005| (4) the specific kind of games of chance
|
0006| intended to be held, operated and conducted by the applicant;
|
0007| (5) the place where the games of chance are
|
0008| intended to be held, operated and conducted by the applicant
|
0009| under the license applied for;
|
0010| (6) the items of expense intended to be
|
0011| incurred or paid in connection with the holding, operating and
|
0012| conducting of [such] games of chance and the names and
|
0013| addresses of the persons to whom and the purposes for which
|
0014| they are to be paid;
|
0015| (7) a statement that no commission, salary,
|
0016| compensation, reward or recompense shall be paid to any person
|
0017| for holding, operating or conducting [such] games of chance
|
0018| or for assisting [therein] in games of chance except as
|
0019| [otherwise] provided in the Bingo and Raffle Act; and
|
0020| (8) such other information deemed advisable by
|
0021| the licensing authority to ensure that the applicant falls
|
0022| within the restrictions set forth by the Bingo and Raffle Act.
|
0023| B. In each application there shall be designated
|
0024| active members of the applicant organization under whom the
|
0025| games of chance described in the application are to be held,
|
0001| operated and conducted, and to the application shall be
|
0002| appended a statement executed by the applicant and by the
|
0003| members so designated that they will be responsible for the
|
0004| holding, operation and conduct of games of chance in accordance
|
0005| with the terms of the license and the provisions of the Bingo
|
0006| and Raffle Act.
|
0007| C. In the event any premises are to be leased or
|
0008| rented in connection with the holding, operating or conducting
|
0009| of any game of chance under the Bingo and Raffle Act, a written
|
0010| statement shall accompany the application signed and verified
|
0011| by the person leasing or renting the premises stating his
|
0012| address and the amount of rent [which] that will be paid
|
0013| for the premises and that the person, or its officers and
|
0014| directors if a corporation, is of good moral character and has
|
0015| not been convicted of any crime involving moral turpitude."
|
0016| Section 4. Section 60-2B-8 NMSA 1978 (being Laws 1981,
|
0017| Chapter 259, Section 8) is amended to read:
|
0018| "60-2B-8. PERSONS PERMITTED TO CONDUCT GAMES--PREMISES--
|
0019| EQUIPMENT--EXPENSES [COMPENSATION].--
|
0020| A. No person shall hold, operate or conduct any
|
0021| games of chance under any license issued under the Bingo and
|
0022| Raffle Act except an active member of the organization to which
|
0023| the license is issued, and no person shall assist in the
|
0024| holding, operating or conducting of any games of chance under
|
0025| that license except an active member or a member of an
|
0001| organization or association [which] that is an auxiliary to
|
0002| the licensee, a member of an organization or association of
|
0003| which the licensee is an auxiliary or a member of an
|
0004| organization or association [which] that is affiliated with
|
0005| the licensee by being, with it, auxiliary to another
|
0006| organization or association and except bookkeepers or ac-
|
0007|
|
0008| countants as provided in this section. No item of expense
|
0009| shall be incurred or paid in connection with the holding,
|
0010| operating or conducting of any game of chance held, operated or
|
0011| conducted pursuant to any license issued under that act except
|
0012| bona fide expenses in reasonable amount for goods, wares and
|
0013| merchandise furnished or services rendered, reasonably
|
0014| necessary for the holding, operating or conducting [thereof]
|
0015| of the game. No games of chance shall be conducted with any
|
0016| equipment except that which is owned or leased by the licensee.
|
0017| B. The officers of a licensee shall designate a
|
0018| bona fide active member of the licensee to be in charge of
|
0019| and primarily responsible for the conduct of the games of bingo
|
0020| or lotto on each occasion. The member in charge shall
|
0021| supervise all activities on the occasion for which he is in
|
0022| charge and be responsible for the making of the required
|
0023| report. The member in charge shall be familiar with the
|
0024| provisions of the state laws, the rules and regulations of the
|
0025| licensing authority and the provisions of the license. He
|
0001| shall be present on the premises continuously during the games
|
0002| and for a period of at least thirty minutes after the last
|
0003| game.
|
0004| C. The officers of a licensee shall designate an
|
0005| officer to be in full charge and primarily responsible for the
|
0006| proper utilization of the entire net proceeds of any game in
|
0007| accordance with state law.
|
0008| D. The entire net proceeds of any game shall be
|
0009| devoted to a lawful use [or uses].
|
0010| E. Each license issued for the conduct of games of
|
0011| chance shall be conspicuously displayed at the place where any
|
0012| game is being conducted at all times during the conduct of the
|
0013| game and for at least thirty minutes after the last game has
|
0014| been concluded.
|
0015| F. The premises where any game of chance is being
|
0016| held, operated or conducted or where it is intended that any
|
0017| equipment be used shall at all times be open to inspection by
|
0018| the licensing authority, its agents and employees and by peace
|
0019| officers of any political subdivision of the state.
|
0020| G. No licensee may hold, operate or conduct a game
|
0021| of bingo or lotto more often than on two hundred sixty
|
0022| occasions in any calendar year.
|
0023| H. When any merchandise prize is awarded in a game
|
0024| of bingo, its value shall be its current retail price. No
|
0025| merchandise prize shall be redeemable or convertible into cash
|
0001| directly or indirectly.
|
0002| I. Equipment, prizes and supplies for games of
|
0003| bingo shall not be purchased or sold at prices in excess of the
|
0004| usual price [thereof] of the equipment, prizes and
|
0005| supplies.
|
0006| J. The aggregate amount of all prizes offered or
|
0007| given in all games played on a single occasion shall not exceed
|
0008| one thousand five hundred dollars ($1,500), which shall be
|
0009| exclusive of pull tabs; provided that the aggregate amount of
|
0010| all prizes offered or given in all games played on a single
|
0011| occasion at a senior organization shall not exceed one hundred
|
0012| dollars ($100).
|
0013| K. No games shall be conducted more than five times
|
0014| in any one calendar week, with no game lasting more than four
|
0015| hours on each occasion and not more than two occasions in one
|
0016| calendar day by any one licensee.
|
0017| L. The net profits derived from the holding of
|
0018| games of chance [must] shall be devoted to the lawful
|
0019| purposes of the organization permitted to conduct the games.
|
0020| Any organization desiring to hold the net profits of games of
|
0021| chance for a period longer than one year [must] shall apply
|
0022| to the licensing authority for special permission, and, upon
|
0023| good cause shown, the authority shall grant the request.
|
0024| M. Any licensee [which] that does not report,
|
0025| during any one-year period, net profits [will] shall be
|
0001| required to show cause before the licensing authority why its
|
0002| right to conduct games of bingo should not be revoked.
|
0003| N. No person shall assist in the holding, operating
|
0004| or conducting of a bingo game under any license except bona
|
0005| fide active members of the licensee, active members of any
|
0006| organization [which] that is an auxiliary to the licensee
|
0007| or active members of an organization [which] that is
|
0008| affiliated with the licensee by being, with it, auxiliary to
|
0009| another organization.
|
0010| O. The equipment used in the playing of bingo and
|
0011| the method of play shall be such that each card has an equal
|
0012| opportunity to be a winner. The objects or balls to be drawn
|
0013| shall be essentially the same as to size, shape, weight,
|
0014| balance and all other characteristics that may influence their
|
0015| selection. All objects or balls shall be present in the
|
0016| receptacle before each game is begun. All numbers announced
|
0017| shall be plainly and clearly audible to all the players
|
0018| present. Where more than one room is used for any one game,
|
0019| the receptacle and the caller [must] shall be present in
|
0020| the room where the greatest number of players are present, and
|
0021| all numbers announced shall be plainly audible to the players
|
0022| in the [aforesaid] room where the receptacle and caller are
|
0023| and [also] audible to the players in the other rooms. A fair
|
0024| and equal chance shall be given to all participants, and any
|
0025| licensee, its representative, agent or employees whose acts or
|
0001| action may tend to negate the "right of equal chance" shall
|
0002| constitute grounds for revoking [such] the license.
|
0003| P. The receptacle and the caller who removes the
|
0004| objects or balls from the receptacle [must] shall be
|
0005| visible to all the players at all times except where more than
|
0006| one room is used for any one game, in which case the provisions
|
0007| of Subsection O of this section shall prevail.
|
0008| Q. The particular arrangement of numbers required
|
0009| to be covered in order to win the game and the amount of the
|
0010| prize shall be clearly and audibly described and announced to
|
0011| the players immediately before each game is begun.
|
0012| R. Any player is entitled to call for a
|
0013| verification of all numbers drawn at the time a winner is
|
0014| determined and for a verification of the objects or balls
|
0015| remaining in the receptacle and not yet drawn. The
|
0016| verification shall be made in the immediate presence of the
|
0017| member designated to be in charge of the occasion [but] or,
|
0018| if [such] that member is also the caller, [then] in the
|
0019| immediate presence of any officer of the licensee.
|
0020| S. In the playing of bingo, no person who is not
|
0021| physically present on the premises where the game is actually
|
0022| conducted shall be allowed to participate as a player in the
|
0023| game.
|
0024| T. No person shall act as a caller in the conduct
|
0025| of any game of bingo unless he has been a member in good
|
0001| standing of the licensee conducting the game or one of its
|
0002| licensed auxiliaries for at least six months immediately prior
|
0003| to the date of [such] the game, is of good moral character
|
0004| and has never been convicted of a felony.
|
0005| U. No owner, co-owner or lessee of the premises
|
0006| [or] and, if a corporation is the owner of the premises,
|
0007| [any] no officer, director or stockholder owning more than
|
0008| ten percent of the outstanding stock shall be a person
|
0009| responsible for or assisting in the holding, operating or
|
0010| conducting of any game of bingo."
