0011| RELATING TO CRIMINAL LAW; ENACTING THE STREET GANG ENFORCEMENT

0012| AND PREVENTION ACT; PROVIDING CRIMINAL PENALTIES FOR INDUCING
|
0013| MINORS TO PARTICIPATE IN A PATTERN OF CRIMINAL GANG ACTIVITY;
|
0014| PROVIDING CRIMINAL PENALTIES FOR PARTICIPATING IN A PATTERN OF
|
0015| CRIMINAL GANG ACTIVITY.
|

|
0017| BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF NEW MEXICO:
|
0018| Section 1. A new section of the Criminal Code is enacted
|
0019| to read:
|
0020| "[NEW MATERIAL] SHORT TITLE.--This act may be cited as
|
0021| the
|
0022| "Street Gang Enforcement and Prevention Act"."
|
0023| Section 2. A new section of the Criminal Code is enacted
|
0024| to read:
|
0025| "[NEW MATERIAL] FINDINGS AND PURPOSE.--
|
0001| A. The legislature finds and declares that it is
|
0002| the right of every person to be secure and protected from
|
0003| intimidation and physical harm caused by the criminal
|
0004| activities of violent groups and individuals. The legislature
|
0005| also finds that the citizens of New Mexico are concerned about
|
0006| the increase in criminal activity that can be attributed to
|
0007| criminal street gangs. This criminal activity presents a clear
|
0008| and present danger to public safety and is not the type of
|
0009| activity that is protected by the constitution of the United
|
0010| States or the constitution of the state of New Mexico.
|
0011| B. The purpose of the Street Gang Enforcement and
|
0012| Prevention Act is not to interfere with constitutionally
|
0013| protected rights of freedom of speech and freedom of
|
0014| association. Rather, the purpose of the Street Gang
|
0015| Enforcement and Prevention Act is to deter and punish criminal
|
0016| activity engaged in by individuals involved in criminal street
|
0017| gangs."
|
0018| Section 3. A new section of the Criminal Code is enacted
|
0019| to read:
|
0020| "[NEW MATERIAL] DEFINITIONS.--As used in the Street
|
0021| Gang Enforcement and Prevention Act:
|
0022| A. "criminal street gang" means an organization,
|
0023| association or group of three or more persons:
|
0024| (1) that has a common name or a common
|
0025| identifying sign or symbol; and
|
0001| (2) whose members engage in a pattern of
|
0002| criminal gang activity; and
|
0003| B. "pattern of criminal gang activity" means the
|
0004| commission of two or more of the following criminal offenses;
|
0005| provided, that at least one of the offenses occurs within three
|
0006| years of a prior offense; and provided further, that the
|
0007| criminal offenses are committed by two or more members of the
|
0008| same criminal street gang:
|
0009| (1) murder, as provided in Section 30-2-1 NMSA
|
0010| 1978;
|
0011| (2) aggravated assault, as provided in Section
|
0012| 30-3-2 NMSA 1978;
|
0013| (3) assault with intent to commit a violent
|
0014| felony, as provided in Section 30-3-3 NMSA 1978;
|
0015| (4) kidnapping, as provided in Section 30-4-1
|
0016| NMSA 1978;
|
0017| (5) aggravated battery, as provided in
|
0018| Subsection C of Section 30-3-5 NMSA 1978;
|
0019| (6) aggravated battery upon a peace officer,
|
0020| as provided in Subsection C of Section 30-22-25 NMSA 1978;
|
0021| (7) shooting at a dwelling or occupied
|
0022| building or shooting at or from a motor vehicle, as provided in
|
0023| Section 30-3-8 NMSA 1978;
|
0024| (8) dangerous use of explosives, as provided
|
0025| in Section 30-7-5 NMSA 1978;
|
0001| (9) criminal sexual penetration, as provided
|
0002| in Section 30-9-11 NMSA 1978;
|
0003| (10) robbery, as provided in Section 30-16-2
|
0004| NMSA 1978;
|
0005| (11) aggravated burglary, as provided in
|
0006| Section 30-16-4 NMSA 1978;
|
0007| (12) aggravated arson, as provided in Section
|
0008| 30-17-6 NMSA 1978;
|
0009| (13) attempt to commit one of the felonies set
|
0010| forth in Paragraphs (1) through (12) of this subsection, as
|
0011| provided in Section 30-28-1 NMSA 1978;
|
0012| (14) conspiracy to commit one of the felonies
|
0013| set forth in Paragraphs (1) through (12) of this subsection, as
|
0014| provided in Section 30-28-2 NMSA 1978; or
|
0015| (15) criminal solicitation of another person
|
0016| to commit one of the felonies set forth in Paragraphs (1)
|
0017| through (12) of this subsection, as provided in Section 30-28-3
|
0018| NMSA 1978."
|
0019| Section 4. A new section of the Criminal Code is enacted
|
0020| to read:
|
0021| "[NEW MATERIAL] INDUCEMENT OF MINORS TO PARTICIPATE IN
|
0022| A PATTERN OF CRIMINAL GANG ACTIVITY--PENALTY.--A person who
|
0023| uses threats, intimidation or persuasion to induce another
|
0024| person less than eighteen years of age to participate in a
|
0025| pattern of criminal gang activity is guilty of a third degree
|
0001| felony."
|
0002| Section 5. A new section of the Criminal Code is enacted
|
0003| to read:
|
0004| "[NEW MATERIAL] PARTICIPATION IN A CRIMINAL STREET
|
0005| GANG--ALTERATION OF BASIC SENTENCE--SUSPENSION AND DEFERRAL
|
0006| LIMITED.--
|
0007| A. When a separate finding of fact by the court or
|
0008| jury shows that a noncapital felony was committed by an
|
0009| individual in association with a criminal street gang with the
|
0010| specific intent to assist the criminal street gang with a
|
0011| pattern of criminal gang activity, the basic sentence of
|
0012| imprisonment prescribed for the offense in Section 31-18-15
|
0013| NMSA 1978 shall be increased by two years. The sentence
|
0014| imposed pursuant to this subsection shall be the first two
|
0015| years served and shall not be suspended, deferred or
|
0016| conditionally discharged; provided, that when the offender is a
|
0017| serious youthful offender or a youthful offender, the sentence
|
0018| imposed pursuant to this subsection may be increased by two
|
0019| years.
|
0020| B. For a second or subsequent noncapital felony
|
0021| committed by an individual in association with a criminal
|
0022| street gang with the specific intent to assist the criminal
|
0023| street gang with a pattern of criminal gang activity, the basic
|
0024| sentence of imprisonment prescribed for the offense in Section
|
0025| 31-18-15 NMSA 1978 shall be increased by four years. The
|
0001| sentence imposed pursuant to this subsection shall be the first
|
0002| four years served and shall not be suspended, deferred or
|
0003| conditionally discharged; provided, that when the offender is a
|
0004| serious youthful offender or a youthful offender, the sentence
|
0005| imposed pursuant to this subsection may be increased by four
|
0006| years.
|
0007| C. If the case is tried before a jury and if a
|
0008| prima facie case is established showing that the offense was
|
0009| committed by an individual in association with a criminal
|
0010| street gang with the specific intent to assist the criminal
|
0011| street gang with a pattern of criminal gang activity, the court
|
0012| shall submit the issue to the jury by special interrogatory.
|
0013| D. If the case is tried by the court and if a prima
|
0014| facie case is established showing that the offense was
|
0015| committed by an individual in association with a criminal
|
0016| street gang with the specific intent to assist the criminal
|
0017| street gang with a pattern of criminal gang activity, the court
|
0018| shall decide the issue and shall make a separate finding of
|
0019| fact thereon."
|
0020| Section 6. EFFECTIVE DATE.--The effective date of the
|
0021| provisions of this act is July 1, 1997.
