0011| RELATING TO LAND SURVEYING; AMENDING SECTION 61-23-28.1 NMSA

0012| 1978 (BEING LAWS 1993, CHAPTER 218, SECTION 36) TO PROVIDE FOR
|
0013| FILING AND RECORDING A BOUNDARY SURVEY PLAT WITH A RESTRICTED
|
0014| CERTIFICATE BY THE SURVEYOR.
|

0016| BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF NEW MEXICO:
|
0017| Section 1. Section 61-23-28.1 NMSA 1978 (being Laws 1993,
|
0018| Chapter 218, Section 36) is amended to read:
|
0019| "61-23-28.1. SURVEYING--RECORD OF SURVEY.--
|
0020| A. Except as provided in Subsection C of this
|
0021| section, after the completion of a boundary survey in
|
0022| conformity with the practice of surveying as defined in the
|
0023| Engineering and Surveying Practice Act and in compliance with
|
0024| the minimum standards for surveying as published by the board,
|
0025| a professional surveyor shall file with the county clerk in the
|
0001| county [or counties] in which the survey was made a record of
|
0002| survey relating to land boundaries and property lines. The
|
0003| county clerk shall accept and record the record of survey.
|
0004| Filing procedures shall be prescribed in the board's minimum
|
0005| standards. The record of survey required to be filed and
|
0006| recorded pursuant to this section shall be filed within thirty
|
0007| calendar days after the completion of the survey or approval by
|
0008| the governing authority.
|
0009| B. Fees for recording a record of survey will be in
|
0010| conformance with Sections 14-8-12 through 14-8-16 NMSA 1978.
|
0011| The county clerk shall keep a proper index of the record of
|
0012| survey by the name of the owner and by section, township and
|
0013| range or projected section, township and range if the subject
|
0014| tract is in a land grant and with references with other legal
|
0015| subdivisions. These records shall be kept in conformance with
|
0016| Sections 14-8-12 through 14-8-16 NMSA 1978.
|
0017| C. For those surveys that do not create a division
|
0018| of land but only show existing tracts of record, a professional
|
0019| surveyor shall file and the county clerk shall accept and
|
0020| record a plat of survey entitled "boundary survey plat" that
|
0021| shall:
|
0022| (1) have on it a printed certification by the
|
0023| professional surveyor stating that "this is a boundary survey
|
0024| plat of an existing tract", or existing tracts if appropriate,
|
0025| and that "it is not a land division or subdivision as defined
|
0001| in the New Mexico Subdivision Act";
|
0002| (2) identify all tracts shown by the uniform
|
0003| parcel code designation established by the county assessor;
|
0004| (3) meet the minimum standards for surveying
|
0005| in New Mexico as established by the board;
|
0006| (4) not exceed a size of eighteen inches by
|
0007| twenty-four inches and be at least eight and one-half inches by
|
0008| eleven inches; and
|
0009| (5) consist of two black-line copies made by
|
0010| the surveyor from a mylar original, which he shall maintain in
|
0011| his files; one shall be filed and recorded by the county clerk
|
0012| and the other with the recording information on it shall be
|
0013| delivered by the county clerk to the county assessor."
