0012| DEVELOPMENT DIVISION OF THE ECONOMIC DEVELOPMENT DEPARTMENT

0013| RESPONSIBLE FOR THE DEVELOPMENT TRAINING PROGRAM; PROVIDING FOR
|
0014| TECHNICAL ASSISTANCE; CHANGING ELIGIBILITY FOR TRAINING
|
0015| APPLICANTS; MAKING AN APPROPRIATION.

0017| BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF NEW MEXICO:
|
0018| Section 1. Section 21-19-7 NMSA 1978 (being Laws 1983,
|
0019| Chapter 299, Section 1, as amended) is amended to read:
|
0020| "21-19-7. DEVELOPMENT TRAINING.--
|
0021| A. The economic development department shall
|
0022| establish a development training program that provides quick-
|
0023| response classroom and in-plant training to furnish qualified
|
0024| manpower resources for new or expanding industries and non-
|
0025| retail service sector businesses in New Mexico that have
|
0001| business or production procedures that require skills unique to
|
0002| those industries. Training shall be custom-designed for the
|
0003| particular company and shall be based on the special
|
0004| requirements of each company. The program shall be operated on
|
0005| a statewide basis and shall be designed to assist any area in
|
0006| becoming more competitive economically.
|
0007| B. There is created the "industrial training board"
|
0008| [which shall be] composed of:
|
0009| (1) the director of the economic development
|
0010| division of the economic development department;
|
0011| (2) the director of the vocational education
|
0012| division of the state department of public education;
|
0013| (3) the director of the job training division
|
0014| of the labor department;
|
0015| (4) the executive director of the commission
|
0016| on higher education;
|
0017| (5) one member from organized labor appointed
|
0018| by the governor; and
|
0019| (6) one public member from the business
|
0020| community appointed by the governor.
|
0021| C. The industrial training board shall establish
|
0022| policies and promulgate rules and regulations for the
|
0023| administration of appropriated funds and shall provide review
|
0024| and oversight to assure that funds expended from the
|
0025| development training fund will generate business activity and
|
0001| give measurable growth to the economic base of New Mexico
|
0002| within the legal limits preserving the ecological state of New
|
0003| Mexico and its people.
|
0004| D. Subject to the approval of the industrial
|
0005| training board, the [vocational education division of the
|
0006| state department of public education] economic development
|
0007| division of the economic development department shall:
|
0008| (1) administer all funds allocated or
|
0009| appropriated for industrial development training purposes;
|
0010| (2) provide designated training services;
|
0011| (3) regulate, control and abandon any training
|
0012| program established under the provisions of this section;
|
0013| (4) assist companies requesting training in
|
0014| the development of a training proposal to meet the companies'
|
0015| manpower needs;
|
0016| (5) contract for the implementation of all
|
0017| training programs;
|
0018| (6) provide for training by educational
|
0019| institutions or by the company through in-plant training, at
|
0020| the company's request; and
|
0021| (7) evaluate training efforts on a basis of
|
0022| performance standards set forth by the industrial training
|
0023| board.
|
0024| E. The vocational education division of the state
|
0025| department of public education shall provide technical
|
0001| assistance to the economic development department concerning
|
0002| the development of agreements, the determination of the most
|
0003| appropriate instructional training to provide and the review of
|
0004| training program implementation.
|
0005| [E.] F. The state shall contract with a company
|
0006| or an educational institution to provide training or
|
0007| instructional services in accordance with the approved training
|
0008| proposal and within the following limitations:
|
0009| (1) no payment shall be made for training in
|
0010| excess of one thousand forty hours of training per trainee for
|
0011| the total duration of training;
|
0012| (2) training applicants shall have resided
|
0013| within the state for a minimum of one year immediately prior to
|
0014| the commencement of the training program and be [citizens of
|
0015| the United States] of legal status for employment;
|
0016| (3) payment for institutional classroom
|
0017| training shall be made under any accepted training contract for
|
0018| a qualified training program;
|
0019| (4) no payment shall be made under any
|
0020| accepted training contract for rental of facilities unless
|
0021| facilities are not available on site or at the educational
|
0022| institution;
|
0023| (5) all applicants shall be eligible under the
|
0024| federal Fair Labor Standards Act and shall not have terminated
|
0025| a public school program within the past three months except by
|
0001| graduation;
|
0002| (6) trainees shall be guaranteed full-time
|
0003| employment with the contracted company upon successful
|
0004| completion of the training;
|
0005| (7) persons employed to provide the
|
0006| instructional services shall be exempt from the minimum
|
0007| requirements established in the state plan for other state
|
0008| vocational programs; and
|
0009| (8) no payment shall be made for training
|
0010| programs or production of Indian jewelry or imitation Indian
|
0011| jewelry unless a majority of those involved in the training
|
0012| program or production are of Indian descent."
|
0013| Section 2. APPROPRIATION.--Six million dollars
|
0014| ($6,000,000) is appropriated from the general fund to the
|
0015| development training fund for expenditure in fiscal year 1998
|
0016| for a development training program providing classroom and in-
|
0017| plant training to furnish qualified manpower resources for
|
0018| certain new or expanding industries and businesses in the
|
0019| state. Included in the appropriation is seventy thousand
|
0020| dollars ($70,000) that may be used by the economic development
|
0021| department for program administration of the development
|
0022| training fund. Any unexpended or unencumbered balance
|
0023| remaining at the end of fiscal year 1998 shall not revert to
|
0024| the general fund.

0024| A. There is created in the state treasury the

0025| "development training fund". Money appropriated to the fund or

0001| accruing to it through gifts, grants, repayments or bequests
|
0002| shall not be transferred to any other fund or be encumbered or
|
0003| disbursed in any manner except as provided in Section 21-19-7
|
0004| NMSA 1978. Money in the fund shall not revert at the end of any
|
0005| fiscal year. Money in the fund is appropriated to the economic
|
0006| development department. Money in the fund shall be expended
|
0007| [only as provided] upon warrant drawn by the secretary of
|
0008| finance and administration pursuant to vouchers signed by the
|
0009| secretary of economic development or his authorized
|
0010| representative to carry out the purposes specified in Section
|
0011| 21-19-7 NMSA 1978.

|
0014| B. There is created in the state treasury the
|
0015| "development fund". Money appropriated to the fund or accruing
|
0016| to it through gifts, grants, repayments or bequests shall not be
|
0017| transferred to any other fund or be encumbered or disbursed in
|
0018| any manner except as provided in this subsection. Money in the
|
0019| fund shall not revert at the end of any fiscal year. Money in
|
0020| the fund shall be administered by the economic development
|
0021| department or its successor for the purpose of making low-
|
0022| interest loans to political subdivisions of the state so that
|
0023| they can construct or implement projects necessary to provide
|
0024| services that will encourage the location of industry in the
|
0025| political subdivisions. The economic development department
|
0001| shall coordinate these loans with the local government division
|
0002| of the department of finance and administration pursuant to the
|
0003| New Mexico Community Assistance Act. Money in the fund shall be
|
0004| expended as provided in Section 21-19-10 NMSA 1978."

0006| Section 3. TEMPORARY PROVISION--APPROPRIATION OF FUND
|
0007| BALANCES.--The economic development department may expend money
|
0008| in the development training fund in the 1997 and subsequent
|
0009| fiscal years that was appropriated in prior fiscal years to carry
|
0010| out the purposes of Section 21-9-7 NMSA 1978.".

|
0012| 3. Renumber the succeeding section accordingly.
|

|
0014| 4. On page 5, line 14, after "1998" insert "and subsequent
|
0015| fiscal years".
|

|
0017| 5. On page 5, line 21, after the period strike the
