0011| RELATING TO LOBBYING; PROHIBITING LOCAL OFFICIALS FROM BEING

0012| EMPLOYED AS LOBBYISTS; AMENDING AND ENACTING SECTIONS OF THE

0013| NMSA 1978.

0015| BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF NEW MEXICO:
|
0016| Section 1. A new section of the Lobbyist Regulation Act
|
0017| is enacted to read:
|
0018| "[NEW MATERIAL] LOCAL OFFICIALS PROHIBITED FROM LOBBYING
|
0019| EMPLOYMENT.--
|
0020| A. No elected or appointed official of a county,
|
0021| district, city, town or village shall be employed as a
|
0022| lobbyist.
|
0023| B. For the purposes of this section, "employed"
|
0024| means that a person is in a contractual relationship with
|
0025| another person in which the person employed receives
|
0001| compensation."
|
0002| Section 2. Section 10-4-2 NMSA 1978 (being Laws 1909,
|
0003| Chapter 36, Section 2, as amended) is amended to read:
|
0004| "10-4-2. REMOVAL--CAUSES OF.--[Sec. 6.] The following
|
0005| shall be causes for removal of any officer belonging to the
|
0006| class mentioned in [the preceding] Section 10-4-1 NMSA
|
0007| 1978:
|
0008| [1] A. conviction of any felony or of any
|
0009| misdemeanor involving moral turpitude;
|
0010| [2] B. failure, neglect or refusal to discharge
|
0011| the duties of the office or failure, neglect or refusal to
|
0012| discharge any duty devolving upon the officer by virtue of his
|
0013| office;
|
0014| [3] C. knowingly demanding or receiving illegal
|
0015| fees as such officer;
|
0016| [4] D. failure to account for money coming into
|
0017| his hands as such officer;
|
0018| [5] E. gross incompetency or gross negligence
|
0019| in discharging the duties of the office;
|
0020| F. lobbying in violation of the Lobbyist
|
0021| Regulation Act; or
|
0022| [6] G. any other act [or acts which] that
|
0023| in the opinion of the court or jury [amount] amounts to
|
0024| corruption in office or gross immorality rendering the
|
0025| incumbent unfit to fill the office."

0001| Section 3. EFFECTIVE DATE.--The effective date of the
|
0002| provisions of this act is July 1, 1997.
