LARRAĽAGA | 0005| | 0006| | 0007| | 0008| | 0009| | 0010| AN ACT | 0011| RELATING TO MOTOR VEHICLES; PROVIDING FOR SPECIAL HOT AIR | 0012| BALLOON REGISTRATION PLATES; CREATING A FUND; MAKING AN | 0013| APPROPRIATION. | 0014| | 0015| BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF NEW MEXICO: | 0016| Section 1. A new section of the Motor Vehicle Code is | 0017| enacted to read: | 0018| "[NEW MATERIAL] SPECIAL HOT AIR BALLOONING REGISTRATION | 0019| PLATES--PROCEDURES--FEE--APPROPRIATION.-- | 0020| A. The department shall establish and issue special | 0021| registration plates featuring artwork depicting the sport of | 0022| hot air ballooning for any private motor vehicle except a | 0023| motorcycle. The department shall adopt procedures for | 0024| application for and issuance of the special hot air ballooning | 0025| registration plates. | 0001| B. The department, with the advice and consultation | 0002| of the tourism department, shall determine the color and design | 0003| of the registration plate and provide for its issuance. No | 0004| personalized or vanity design variation of the special hot air | 0005| ballooning registration plates shall be issued. | 0006| C. For a one-time fee of twenty-five dollars | 0007| ($25.00), which shall be in addition to the regular motor | 0008| vehicle registration fees, any owner of a motor vehicle may | 0009| apply for the issuance of a special hot air ballooning | 0010| registration plate. The owner of a motor vehicle shall apply | 0011| for the plate and pay the twenty-five dollar ($25.00) fee, and | 0012| no fee in addition to the regular motor vehicle registration | 0013| fees shall be charged for subsequent years if he wishes to | 0014| retain and renew a special hot air ballooning registration | 0015| plate. | 0016| D. Notwithstanding the provisions of Section | 0017| 66-6-22.1 NMSA 1978, fifteen dollars ($15.00) of the fee | 0018| collected shall be paid to the state treasurer for credit to | 0019| the state tourism fund. | 0020| E. Souvenir sample registration plates may be | 0021| issued by the department and sold for a fee of ten dollars | 0022| ($10.00). Notwithstanding the provisions of Section 66-6-22.1 | 0023| NMSA 1978, five dollars ($5.00) of the fee collected shall be | 0024| paid to the state treasurer for credit to the state tourism | 0025| fund." | 0001| Section 2. [NEW MATERIAL] STATE TOURISM FUND--CREATED- | 0002| -PURPOSE.--The "state tourism fund" is created in the state | 0003| treasury. The fund shall consist of appropriations, fees, | 0004| gifts, grants, donations and interest earned on investment of | 0005| the fund. Money in the fund is appropriated to the tourism | 0006| department and shall not revert to the general fund at the end | 0007| of the fiscal year. The purpose of the fund is to promote | 0008| tourism. The state tourism fund shall be administered by the | 0009| secretary of tourism. Money in the fund shall be expended only | 0010| on warrants drawn by the secretary of finance and | 0011| administration pursuant to vouchers signed by the secretary of | 0012| tourism or the secretary of tourism's authorized | 0013| representative. | 0014| Section 3. Ten dollars ($10.00) of the fee collected | 0023| pursuant to Subsection C of this section shall be retained by the | 0024| department and is appropriated to the department to defray the | 0025| cost of making and issuing the special registration plates | 0001| authorized by this section.
