0012| PARTE EMERGENCY ORDERS OF PROTECTION; AMENDING AND ENACTING
|
0013| SECTIONS OF THE FAMILY VIOLENCE PROTECTION ACT.

0015| BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF NEW MEXICO:
|
0016| Section 1. Section 40-13-1 NMSA 1978 (being Laws 1987,
|
0017| Chapter 286, Section 1) is amended to read:
|
0018| "40-13-1. SHORT TITLE. [This act] Chapter 40, Article
|
0019| 13 NMSA 1978 may be cited as the "Family Violence Protection
|
0020| Act"."
|
0021| Section 2. A new section of the Family Violence
|
0022| Protection Act is enacted to read:
|
0023| "[NEW MATERIAL] EX PARTE EMERGENCY ORDERS OF
|
0024| PROTECTION-- ISSUANCE BY THE COURT OR A DOMESTIC VIOLENCE
|
0025| COMMISSIONER.--
|
0001| A. The court or a domestic violence commissioner
|
0002| may issue an ex parte written or oral emergency order of
|
0003| protection when a law enforcement officer states to the court
|
0004| or commissioner in person or by telephone, and the court or
|
0005| commissioner finds that there exist reasonable grounds to
|
0006| believe that a petitioner is in immediate danger of domestic
|
0007| abuse involving violence based on an allegation of a recent
|
0008| incident of domestic abuse involving violence.
|
0009| B. A law enforcement officer who receives an oral
|
0010| emergency order of protection shall:
|
0011| (1) personally reduce the order to writing and
|
0012| sign it;
|
0013| (2) serve a signed copy on the respondent
|
0014| forthwith;
|
0015| (3) immediately provide the petitioner with a
|
0016| signed copy of the order; and
|
0017| (4) provide the original order to the court by
|
0018| the close of business on the next judicial day.
|
0019| C. An emergency order for protection may grant the
|
0020| following relief:
|
0021| (1) enjoin the respondent from threatening to
|
0022| commit or committing acts of domestic abuse against the
|
0023| petitioner and any designated household members;
|
0024| (2) prohibit the respondent from harassing,
|
0025| annoying, telephoning, contacting or otherwise communicating
|
0001| with the petitioner, directly or indirectly;
|
0002| (3) remove and exclude the respondent from the
|
0003| residence of the petitioner, regardless of ownership of the
|
0004| residence;
|
0005| (4) order the respondent to stay away from the
|
0006| residence, school and place of employment of the petitioner and
|
0007| any other specified place frequented by the petitioner and any
|
0008| designated household members;
|
0009| (5) provide for the petitioner's possession
|
0010| and use of an automobile and essential personal effects,
|
0011| regardless of their ownership;
|
0012| (6) direct the appropriate law enforcement
|
0013| officer to accompany the petitioner to ensure that the
|
0014| petitioner is safely restored to possession of the residence,
|
0015| automobile and other essential personal effects, or to
|
0016| accompany and supervise the petitioner's or respondent's
|
0017| removal of personal belongings;
|
0018| (7) grant temporary custody of any minor child
|
0019| to the petitioner; and
|
0020| (8) order other relief as deemed necessary to
|
0021| protect and provide for the safety of the petitioner and any
|
0022| designated household members.
|
0023| D. A judge or a domestic violence commissioner
|
0024| shall be available twenty-four hours a day to hear petitions
|
0025| for emergency orders of protection.
|
0001| E. An emergency order for protection expires
|
0002| seventy-two hours after issuance, unless extended for a like
|
0003| period by further court order.
|
0004| F. A domestic violence commissioner shall possess
|
0005| the following qualifications:
|
0006| (1) be a lawyer licensed to practice law in
|
0007| New Mexico; and
|
0008| (2) have at least five years of experience in
|
0009| the practice of law."

0003| "[NEW MATERIAL] EX PARTE EMERGENCY ORDERS OF
|
0004| PROTECTION.--
|
0005| A. The district court may issue an ex parte written
|
0006| emergency order of protection when a law enforcement officer or
|
0007| other appointed person states to the court in person, by
|
0008| telephone or via facsimile upon a verified petition, and the
|
0009| court finds reasonable grounds to believe, that a petitioner is
|
0010| in immediate danger of domestic abuse following an incident of
|
0011| domestic abuse by a household member.
|
0012| B. A law enforcement officer who receives an
|
0013| emergency order of protection, whether in writing or by
|
0014| facsimile transmission, from the court shall:
|
0015| (1) if possible, immediately serve a signed
|
0016| copy of the order on the respondent and complete the
|
0017| appropriate affidavit of service;
|
0018| (2) immediately provide the petitioner with a
|
0019| signed copy of the order; and
|
0020| (3) when necessary, provide the original order
|
0021| to the court by the close of business on the next judicial day.
|
0022| C. The court may grant the following relief in an
|
0023| emergency order for protection upon a probable cause finding
|
0024| that domestic abuse has occurred:
|
0025| (1) enjoin the respondent from threatening to
|
0001| commit or committing acts of domestic abuse against the
|
0002| petitioner or any designated household members;
|
0003| (2) enjoin the respondent from any contact
|
0004| with the petitioner, including harassing, telephoning,
|
0005| contacting or otherwise communicating with the petitioner;
|
0006| (3) temporarily remove and exclude the
|
0007| respondent from the residence of the petitioner, regardless of
|
0008| ownership of the residence;
|
0009| (4) enjoin the respondent from contacting the
|
0010| petitioner or any household member at the residence, school and
|
0011| place of employment of the petitioner and any other specified
|
0012| place frequented by the petitioner and any designated household
|
0013| members;
|
0014| (5) order temporary possession or use of the
|
0015| parties' automobile or other personal effects, as enumerated by
|
0016| the court, regardless of their ownership, and direct the
|
0017| appropriate law enforcement officer to accompany the petitioner at
|
0018| a specified time to safely obtain these items or to accompany and
|
0019| supervise the petitioner's or respondent's removal of personal
|
0020| belongings;
|
0021| (6) grant temporary legal or physical custody of
|
0022| any minor child to the petitioner, if necessary; and
|
0023| (7) order other relief as deemed necessary to
|
0024| protect and provide for the safety of the petitioner and any
|
0025| designated household members.
|
0001| D. Any designated judicial officer with authority to
|
0002| issue an order for protection shall be available for emergency
|
0003| matters as determined by each judicial district.
|
0004| E. An emergency order for protection expires seventy-
|
0005| two hours after issuance, unless extended after a hearing has been
|
0006| held."
