|
0011| RELATING TO PUBLIC SAFETY; PROVIDING FOR THE CREATION OF
|
0012| INDEPENDENT CITIZEN POLICE AND SHERIFF REVIEW BOARDS.
|
0013|
|
0014| BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF NEW MEXICO:
|
0015| Section 1. A new section of the Municipal Code is enacted
|
0016| to read:
|
0017| "[NEW MATERIAL] INDEPENDENT CITIZEN POLICE REVIEW
|
0018| BOARDS--SCOPE AND AUTHORITY.--
|
0019| A. A municipality whose charter has been authorized
|
0020| by general law or by the governing body of a municipality may
|
0021| establish a citizen police review board by ordinance, which
|
0022| shall be independent of the law enforcement agency of the
|
0023| municipality. The authority of a citizen police review board
|
0024| includes the ability to:
|
0025| (1) receive, review and investigate citizen
|
0001| complaints filed against peace officers;
|
0002| (2) recommend appropriate disciplinary action
|
0003| to the law enforcement agency or the district attorney's office
|
0004| against offending peace officers, including the imposition of
|
0005| progressive disciplinary action for peace officers who are
|
0006| repeat offenders;
|
0007| (3) recommend the appointment of independent
|
0008| investigators or prosecutors;
|
0009| (4) make recommendations for indictments to
|
0010| the district attorney or to a court of law for prosecution;
|
0011| (5) subpoena all relevant information and
|
0012| police records, reports, materials and witnesses to appear
|
0013| before the board; and
|
0014| (6) recommend policy to the law enforcement
|
0015| agency and the governing body.
|
0016| B. Any information gathered by the citizen police
|
0017| review board related to the prosecution of a peace officer
|
0018| shall remain confidential and shall be subject to any other
|
0019| confidentiality provisions in law.
|
0020| C. Citizen police review boards shall be subject to
|
0021| the provisions of the Public Records Act.
|
0022| D. Board members shall reside in the municipality
|
0023| where the citizen police review board is located.
|
0024| E. No person having a conflict of interest shall
|
0025| serve on a citizen police review board.
|
0001| F. As used in this section:
|
0002| (1) "conflict of interest" means a person
|
0003| currently employed with a law enforcement or security agency or
|
0004| holding a membership in a police association or any other
|
0005| formal law enforcement organization, whether public or private;
|
0006| and
|
0007| (2) "peace officer" means a public official or
|
0008| public officer vested by law with a duty to maintain public
|
0009| order or to make arrests for crime, whether that duty extends
|
0010| to all crimes or is limited to specific crimes."
|
0011| Section 2. [NEW MATERIAL] INDEPENDENT CITIZEN SHERIFF
|

|
