0011| RELATING TO MEDICAID; PROVIDING FOR INCREASED MEDICAID

0012| REIMBURSEMENTS TO PROVIDERS.

0014| BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF NEW MEXICO:
|
0015| Section 1. Section 27-2-12.3 NMSA 1978 (being Laws 1987,
|
0016| Chapter 269, Section 1, as amended) is amended to read:
|
0017| "27-2-12.3. MEDICAID REIMBURSEMENT--EQUAL PAY FOR EQUAL
|
0018| [PHYSICIANS', DENTISTS', OPTOMETRISTS', PODIATRISTS' AND
|
0019| PSYCHOLOGISTS'] PROVIDER SERVICES--EXCEPTION.--The human
|
0020| services department shall establish a rate for the
|
0021| reimbursement of physicians, dentists, optometrists,
|
0022| podiatrists and psychologists for services rendered to medicaid
|
0023| patients that provides equal reimbursement for the same or
|
0024| similar services rendered without respect to the date on which
|
0025| [such] the physician, dentist, optometrist, podiatrist or
|
0001| psychologist entered into practice in New Mexico, the date on
|
0002| which the physician, dentist, optometrist, podiatrist or
|
0003| psychologist entered into an agreement or contract to provide
|
0004| such services or the location in which such services are to be
|
0005| provided in the state; provided, however, that the requirements
|
0006| of this section shall not apply when the human services
|
0007| department contracts with entities pursuant to Section 27-2-
|
0008| 12.6 NMSA 1978 [to negotiate] and negotiates a rate for the
|
0009| reimbursement for services rendered to medicaid patients in the
|
0010| medicaid managed care system; and provided further that a
|
0011| higher rate of reimbursement may be given for services to
|
0012| medicaid patients in medically underserved areas, as determined
|
0013| by regulation adopted by the department."
