0011| RELATED TO OPTOMETRY; BROADENING THE DEFINITION OF THE PRACTICE

0012| OF OPTOMETRY; PERMITTING LASER SURGERY AND THE PRESCRIBING AND
|
0013| ADMINISTERING OF CERTAIN MEDICATIONS BY OPTOMETRISTS.
|

|
0015| BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF NEW MEXICO:
|
0016| Section 1. Section 61-2-2 NMSA 1978 (being Laws 1973,
|
0017| Chapter 353, Section 2, as amended) is amended to read:
|
0018| "61-2-2. DEFINITIONS.--As used in the Optometry Act:
|
0019| A. "practice of optometry" means:
|
0020| (1) the employment of any subjective or
|
0021| objective means or methods, including the prescription or
|
0022| administration of topical ocular pharmaceutical agents, for the
|
0023| purpose of determining the visual defects or abnormal
|
0024| conditions of the human eye and its adnexa; and
|
0025| (2) the employing, adapting or prescribing of
|
0001| preventive or corrective measures by any means, including
|
0002| low vision rehabilitation, orthoptics, vision therapy,
|
0003| lenses, prisms, contact or corneal lenses or other optical
|
0004| appliances; refractive and therapeutic laser surgery
|
0005| procedures of the anterior segment of the eye; and prescribing
|
0006| or administering topical ocular pharmaceutical agents and oral
|
0007| pharmaceutical agents as authorized in Section 61-2-10.2 NMSA
|
0008| 1978 for the correction, relief or referral of visual defects
|
0009| or abnormal conditions of the human eye and its adnexa. The
|
0010| "practice of optometry" shall include the procedures and
|
0011| methods as taught by an accredited school or college of
|
0012| optometry, if the optometrist is qualified to do so by having
|
0013| passed the instruction and has been credentialed to perform the
|
0014| procedure or method by the board of optometric examiners, and
|
0015| shall not include the use of incisional surgery [or
|
0016| injections in the treatment of eye diseases; provided].
|
0017| Persons who sell or dispense eyeglasses upon prescription and
|
0018| who do not prescribe ophthalmic lenses for the eyes shall not
|
0019| employ, adapt, dispense, modify, provide, sell, give or fit
|
0020| contact or corneal lenses; and provided further, the testing,
|
0021| design, dispensing and monitoring of a contact lens fitting
|
0022| shall be performed at the optometrist's place of practice;
|
0023| B. "ophthalmic lens" means a lens that has a
|
0024| spherical, cylindrical or prismatic value and that is ground
|
0025| pursuant to a prescription and intended to be used as
|
0001| eyeglasses or spectacles;
|
0002| C. "contact or corneal lens" means any lens to be
|
0003| worn on the anterior segment of the human eye, to be
|
0004| prescribed, dispensed, adapted, employed, modified, provided,
|
0005| sold and fitted by a licensed optometrist or physician;
|
0006| D. "prescription" means a formula written for
|
0007| ophthalmic lenses, for a topical ocular pharmaceutical agent or
|
0008| for an oral pharmaceutical agent as authorized in Section
|
0009| 61-2-10.2 NMSA 1978 that comes under the provisions of the New
|
0010| Mexico Drug, Device and Cosmetic Act by a person duly licensed
|
0011| and containing the following essential elements:
|
0012| (1) an order given individually for the person
|
0013| for whom prescribed, either directly from the prescriber to the
|
0014| pharmacist or indirectly by means of a written order signed by
|
0015| the prescriber, [and shall bear] that bears the name and
|
0016| address of the prescriber, his license classification, the name
|
0017| and address of the patient, the name and quantity of the drug
|
0018| prescribed, directions for use and the date of issue; or
|
0019| (2) dioptric power of spheres, cylinders and
|
0020| prisms, axes of cylinders, position of prism base and, if so
|
0021| desired by the prescriber, light transmission properties and
|
0022| lens curve values;
|
0023| (3) designation of pupillary distance; and
|
0024| (4) name of patient, date of prescription,
|
0025| expiration date and the name and office location of prescriber;
|
0001| provided, however, that:
|
0002| (5) those who sell and dispense eyeglasses
|
0003| upon the written prescription of a physician, surgeon or
|
0004| optometrist may determine the:
|
0005| (a) type, form, size and shape of
|
0006| ophthalmic lenses;
|
0007| (b) placement of optical centers for
|
0008| distance-seeing and near-work;
|
0009| (c) designation of type and placement of
|
0010| reading segments in multivision lenses;
|
0011| (d) type and quality of frame or
|
0012| mounting, type of bridge and distance between lenses, type,
|
0013| length and angling of temples; and
|
0014| (e) designation of pupillary distance;
|
0015| E. "eyeglasses" means any exterior optical device
|
0016| using ophthalmic lenses for the correction or relief of
|
0017| disturbances in and anomalies of human vision and includes
|
0018| spectacles and other devices using ophthalmic lenses; and
|
0019| F. "board" means the board of optometry."
|
0020| Section 2. Section 61-2-10.2 NMSA 1978 (being Laws 1995,
|
0021| Chapter 20, Section 5, as amended) is amended to read:
|
0022| "61-2-10.2. DESIGNATION OF ORAL PHARMACEUTICAL AGENTS--
|
0023| CERTIFICATION FOR USE OF CERTAIN AGENTS.--
|
0024| A. Subject to the provisions of the Optometry
|
0025| Act, optometrists qualified and certified by the board may
|
0001| prescribe or administer the following classes of oral
|
0002| pharmaceutical agents:
|
0003| (1) anti-infective medications, not
|
0004| including antifungals;
|
0005| (2) anti-glaucoma medications, not
|
0006| including osmotic medications;
|
0007| (3) anti-allergy medications;
|
0008| (4) anti-inflammatory medications [not
|
0009| including oral corticosteroids and immunosuppression
|
0010| agents]; and
|
0011| (5) analgesic medications, including
|
0012| schedules III through V controlled substances, as provided in
|
0013| the Controlled Substances Act.
|
0014| B. The board shall issue certification for the
|
0015| use of oral pharmaceutical agents as set forth in Subsection
|
0016| A of this section to optometrists currently licensed by the
|
0017| board who are certified for the use of topical ocular
|
0018| pharmaceutical agents. To be certified, an optometrist shall
|
0019| submit to the board proof of having satisfactorily completed
|
0020| a course in pharmacology as applied to optometry, with
|
0021| particular emphasis on the administration of oral
|
0022| pharmaceutical agents, including corticosteroids and
|
0023| immunosuppression agents, for the purpose of examination of
|
0024| the human eye, and analysis of ocular functions and treatment
|
0025| of visual defects or abnormal conditions of the human eye and
|
0001| its adnexa. The course shall constitute a minimum of twenty
|
0002| hours of instruction in clinical pharmacology, including
|
0003| systemic pharmacology as applied to optometry, and shall be
|
0004| taught by an accredited institution approved by the board.
|
0005| C. As of July 1, 1996, all applicants for
|
0006| licensure shall meet the requirements for certification in
|
0007| the use of diagnostic, topical therapeutic and oral
|
0008| pharmaceutical agents as set forth in the Optometry Act and
|
0009| shall successfully complete the board's examination in
|
0010| diagnostic, topical and oral pharmaceutical agents prior to
|
0011| licensure.
|
0012| D. The certification authorized by this section
|
0013| shall be displayed in a conspicuous place in the
|
0014| optometrist's principal office or place of business."
