0011| RELATING TO INMATE WORK CAMPS; ESTABLISHING AN INMATE WORK CAMP

0012| PROGRAM; ENACTING NEW SECTIONS PERTAINING TO STATE CORRECTIONAL

0013| FACILITIES; ENACTING NEW SECTIONS OF THE FOREST CONSERVATION
|
0014| ACT; CREATING A FUND; MAKING AN APPROPRIATION.
|

|
0016| BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF NEW MEXICO:
|
0017| Section 1. A new Section 33-2-51 NMSA 1978 is enacted to
|
0018| read:
|
0019| "33-2-51. [NEW MATERIAL] INMATE WORK CAMP PROGRAM
|
0020| CREATED--PURPOSE.--There is created an inmate work camp program
|
0021| for which the corrections department shall provide inmate labor
|
0022| for natural resources work planned by the forestry division of
|
0023| the energy, minerals and natural resources department. The
|
0024| purpose of the inmate work camp program is to use minimum
|
0025| security inmates to perform work on natural resource projects
|
0001| on public lands and wildfire suppression in New Mexico. The
|
0002| inmate work camp program is not an inmate-release program
|
0003| pursuant to the provisions of Sections 33-2-43 through 33-2-47
|
0004| NMSA 1978."
|
0005| Section 2. A new Section 33-2-52 NMSA 1978 is enacted to
|
0006| read:
|
0007| "33-2-52. [NEW MATERIAL] INMATES ELIGIBLE TO
|
0008| PARTICIPATE.--The corrections department shall screen and
|
0009| classify inmate applicants for the inmate work camp program.
|
0010| To be eligible, a candidate for participation in the inmate
|
0011| work camp program shall:
|
0012| A. meet all of the standards provided in Section
|
0013| 33-2-44 NMSA 1978; and
|
0014| B. not be serving a sentence for first or second
|
0015| degree murder."
|
0016| Section 3. A new Section 33-2-53 NMSA 1978 is enacted to
|
0017| read:
|
0018| "33-2-53. [NEW MATERIAL] WORK CAMPS.--The corrections
|
0019| department may establish work camps for the custody of inmates
|
0020| performing labor pursuant to the inmate work camp program. As
|
0021| used in this section, "work camp" means a minimum security
|
0022| facility operated by the corrections department that houses
|
0023| inmates being trained or providing labor pursuant to the inmate
|
0024| work camp program."
|
0025| Section 4. A new Section 33-2-54 NMSA 1978 is enacted to
|
0001| read:
|
0002| "33-2-54. [NEW MATERIAL] INMATE COMPENSATION--INMATES
|
0003| NOT EMPLOYEES AND NOT ELIGIBLE FOR WORKERS' COMPENSATION.--
|
0004| A. The corrections department shall establish
|
0005| policies and procedures for compensating inmates who work in
|
0006| the inmate work camp program.
|
0007| B. No inmate compensated under this section shall
|
0008| be considered an employee of or shall be employed by the
|
0009| corrections department or the forestry division of the energy,
|
0010| minerals and natural resources department or any entity
|
0011| deriving benefits from inmate services; nor shall any inmate
|
0012| come within the provisions of the Workers' Compensation Act or
|
0013| be entitled to any benefits under that act whether on behalf of
|
0014| the inmate or of any other person."
|
0015| Section 5. A new section of the Forest Conservation Act
|
0016| is enacted to read:
|
0017| "[NEW MATERIAL] AUTHORITY TO CONTRACT WITH CORRECTIONS
|
0018| DEPARTMENT AND PUBLIC LAND MANAGEMENT AGENCIES.--
|
0019| A. The forestry division of the energy, minerals
|
0020| and natural resources department may enter into agreements with
|
0021| the corrections department to provide planning and supervision
|
0022| of natural resource projects for the inmate work camp program.
|
0023| B. The forestry division may contract with and
|
0024| receive funds for public land management agencies for which
|
0025| natural resource work is performed pursuant to the inmate work
|
0001| camp program."
|
0002| Section 6. A new section of the Forest Conservation Act
|
0003| is enacted to read:
|
0004| "[NEW MATERIAL] FORESTRY DIVISION TO SUPERVISE NATURAL
|
0005| RESOURCE WORK AND TO DEVELOP POLICIES.--
|
0006| A. The forestry division of the energy, minerals
|
0007| and natural resources department may plan and develop natural
|
0008| resource projects, provide technical direction and supervision
|
0009| of natural resource work performed by inmates, provide
|
0010| instruction in forestry and natural resource issues to inmates,
|
0011| provide direction and instruction to inmates in the use of
|
0012| tools and equipment and conduct safety training for inmates
|
0013| performing labor pursuant to the inmate work camp program.
|
0014| B. The forestry division may develop policies and
|
0015| procedures for the inmate work camp program that address
|
0016| planning and developing natural resource projects, supervising
|
0017| and directing natural resource projects and providing safety
|
0018| training for inmates performing assigned work."
|
0019| Section 7. A new section of the Forest Conservation Act
|
0020| is enacted to read:
|
0021| "[NEW MATERIAL] FORESTRY WORK CAMP REVOLVING FUND
|
0022| CREATED.--There is created within the state treasury the
|
0023| "forestry work camp revolving fund". All money received by the
|
0024| forestry division of the energy, minerals and natural resources
|
0025| department from public land management agencies for work
|
0001| performed pursuant to the inmate work camp program shall be
|
0002| delivered to the state treasurer and deposited in the forestry
|
0003| work camp revolving fund. Disbursements from the fund shall be
|
0004| made upon warrants drawn by the secretary of finance and
|
0005| administration pursuant to vouchers signed by the secretary of
|
0006| energy, minerals and natural resources. Money in the fund is
|
0007| appropriated to the energy, minerals and natural resources
|
0008| department for administration of the inmate work camp program,
|
0009| including the acquisition of tools and equipment and expenses
|
0010| incurred in planning and supervising natural resource projects.
|
0011| Any unexpended or unencumbered balance remaining in the
|
0012| forestry work camp revolving fund at the end of a fiscal year
|
0013| shall not revert to the general fund but shall remain and
|
0014| accrue to the benefit of the forestry work camp revolving
|
0015| fund."
|
0016| Section 8. EFFECTIVE DATE.--The effective date of the
|
0017| provisions of this act is July 1, 1997.
