Section 72-1-9 NMSA 1978 (being Laws 1985, | 0019| Chapter 198, Section 1, as amended by Laws 1990, Chapter 11, | 0020| Section 1 and also by Laws 1990, Chapter 40, Section 1) is | 0021| amended to read: | 0022| "72-1-9. MUNICIPAL, COUNTY, NONPROFIT COMMUNITY WATER | 0023| SYSTEMS AND STATE UNIVERSITY WATER DEVELOPMENT PLANS--PRESER- | 0024| | 0025| VATION OF MUNICIPAL, COUNTY AND STATE UNIVERSITY WATER | 0001| SUPPLIES.-- | 0002| A. It is recognized by the state of New Mexico that | 0003| it promotes the public welfare and the conservation of water | 0004| within the state for municipalities, counties, nonprofit | 0005| community water systems, state universities and public | 0006| utilities supplying water to municipalities or counties to plan | 0007| for the reasonable development and use of water resources. The | 0008| state further recognizes the state engineer's administrative | 0009| policy of not allowing municipalities, counties, nonprofit | 0010| community water systems and state universities to acquire and | 0011| hold, unused, water rights in an amount greater than their | 0012| reasonable needs within forty years ~~[and recognizes that this~~ | 0013| ~~administrative policy was incorporated into law by Chapter 2 of~~ | 0014| ~~Laws 1983]~~. | 0015| B. Municipalities, counties, nonprofit community | 0016| water systems, state universities and public utilities supply- | 0017| | 0018| ing water to municipalities or counties shall be allowed a | 0019| water use | 0020| planning period not to exceed forty years, and water rights for | 0021| municipalities, counties, nonprofit community water systems, | 0022| state universities and public utilities supplying water to such | 0023| municipalities or counties shall be based upon a water | 0024| development plan the implementation of which shall not exceed a | 0025| forty-year period from the date of the application for an | 0001| appropriation or a change of place or purpose of use pursuant | 0002| to a water development plan or for preservation of a municipal, | 0003| county, nonprofit community water system or state university | 0004| water supply for reasonably projected additional needs within | 0005| forty years. | 0006| C.
