0011| RELATING TO THE ENERGY, MINERALS AND NATURAL RESOURCES

0012| DEPARTMENT; AMENDING AND ENACTING SECTIONS OF THE NMSA 1978
|
0013| PERTAINING TO THE ORGANIZATION OF THE DEPARTMENT.

0015| BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF NEW MEXICO:
|
0016| Section 1. Section 9-5A-3 NMSA 1978 (being Laws 1987,
|
0017| Chapter 234, Section 3) is amended to read:
|
0018| "9-5A-3. DEPARTMENT ESTABLISHED.--
|
0019| A. There is created in the executive branch the
|
0020| "energy, minerals and natural resources department". The
|
0021| department shall be a cabinet department and [shall include,
|
0022| but not be limited to] includes the following organizational
|
0023| units:
|
0024| (1) the administrative services division;
|
0025| (2) the state [park and recreation] parks
|
0001| division;
|
0002| (3) the forestry division; [which shall
|
0003| include a soil and water conservation bureau;
|
0004| (4) the energy conservation and management
|
0005| division;
|
0006| (5)] (4) the mining and minerals division;
|
0007| and
|
0008| [(6)] (5) the oil conservation division.
|
0009| B. The secretary of energy, minerals and natural
|
0010| resources may organize the department and the divisions
|
0011| specified in Subsection A of this section, including the
|
0012| transfer or merging of functions among divisions in the
|
0013| interest of efficiency and economy.
|
0014| C. The governor may by executive order merge,
|
0015| abolish or create divisions of the department in the interest
|
0016| of efficiency and economy.
|
0017| [B.] D. The state game commission is
|
0018| administratively attached to the department."
|
0019| Section 2. Section 9-5A-4 NMSA 1978 (being Laws 1987,
|
0020| Chapter 234, Section 4) is amended to read:
|
0021| "9-5A-4. DIVISIONS--DUTIES.--In addition to the duties
|
0022| assigned to each division of the energy, minerals and natural
|
0023| resources department by the secretary of energy, minerals and
|
0024| natural resources:
|
0025| A. the administrative services division shall
|
0001| provide clerical, recordkeeping and administrative support to
|
0002| the department in the areas of personnel, budget, procurement
|
0003| and contracting;
|
0004| [B. the energy conservation and management
|
0005| division shall plan, administer, review, provide technical
|
0006| assistance, maintain records and monitor state and federal
|
0007| energy conservation and alternative energy technology programs;
|
0008| C.] B. the forestry division shall enforce and
|
0009| administer all laws and regulations relating to forestry; [and
|
0010| soil and water conservation on lands within the state;
|
0011| D.] C. the mining and minerals division shall
|
0012| enforce and administer laws and regulations relating to mine
|
0013| safety, [coal surface mine] operation and reclamation of
|
0014| coal and non-coal mines and abandoned mine lands reclamation;
|
0015| [E.] D. the oil conservation division shall
|
0016| administer the laws and regulations relating to oil, gas and
|
0017| geothermal resources, except those laws specifically
|
0018| administered by another authority; and
|
0019| [F.] E. the state [park and
|
0020| recreation] parks division shall develop, maintain, manage
|
0021| and supervise all state parks and state-owned or state-leased
|
0022| recreation areas."

0023| Section 3. A new section of the Energy, Minerals and
|
0024| Natural Resources Department Act is enacted to read:
|
0025| "[NEW MATERIAL] ENERGY PROGRAMS.--The secretary of
|
0001| energy, minerals and natural resources may administer energy
|
0002| conservation, energy efficiency programs and alternative energy
|
0003| programs through the office of the secretary or other divisions
|
0004| of the energy, minerals and natural resources department as
|
0005| deemed appropriate."
|
0006| Section 4. A new section of the Energy, Minerals and
|
0007| Natural Resources Department Act is enacted to read:
|
0008| "[NEW MATERIAL] STATE PARKS DIVISION DESIGNATION.--As
|
0009| used in the NMSA 1978, "state park and recreation division"
|
0010| means the state parks division of the energy, minerals and
|
0011| natural resources department."
|
0012| Section 5. EFFECTIVE DATE.--The effective date of the
|
0013| provisions of this act is July 1, 1997.
