0012| (BEING LAWS 1941, CHAPTER 188, SECTION 1, AS AMENDED) TO ALLOW

0013| PUBLIC SCHOOL DISTRICTS AND INSTITUTIONS OF HIGHER EDUCATION TO
|
0014| CONTRIBUTE UP TO ONE HUNDRED PERCENT OF THE COSTS OF GROUP
|
0015| INSURANCE.
|

0017| BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF NEW MEXICO:
|
0018| Section 1. Section 10-7-4 NMSA 1978 (being Laws 1941,
|
0019| Chapter 188, Section 1, as amended) is amended to read:
|
0020| "10-7-4. GROUP INSURANCE--CAFETERIA PLAN--CONTRIBUTIONS
|
0021| FROM PUBLIC FUNDS.--
|
0022| A. All state departments and institutions and all
|
0023| political subdivisions of the state, excluding municipalities
|
0024| and counties, shall cooperate in providing group term life,
|
0025| medical or disability income insurance for the benefit of
|
0001| eligible employees or salaried officers of the respective
|
0002| departments, institutions and subdivisions.
|
0003| B. Except as provided in Subsection C of this
|
0004| section, the group insurance contributions of the state or any
|
0005| of its departments or institutions, including institutions of
|
0006| higher education and the public schools, shall be made as
|
0007| follows:
|
0008| (1) seventy-five percent of the cost of the
|
0009| insurance of an employee whose annual salary is less than
|
0010| fifteen thousand dollars ($15,000);
|
0011| (2) seventy percent of the cost of the
|
0012| insurance of an employee whose annual salary is fifteen
|
0013| thousand dollars ($15,000) or more but less than twenty
|
0014| thousand dollars ($20,000);
|
0015| (3) sixty-five percent of the cost of the
|
0016| insurance of an employee whose annual salary is twenty thousand
|
0017| dollars ($20,000) or more but less than twenty-five thousand
|
0018| dollars ($25,000); or
|
0019| (4) sixty percent of the cost of the insurance
|
0020| of an employee whose annual salary is twenty-five thousand
|
0021| dollars ($25,000) or more.
|
0022| [As used in this subsection, "cost of the insurance"
|
0023| means the premium required to be paid to provide coverages.]
|
0024| C. Any group insurance contributions of the
|
0025| political subdivisions of the state, except the public schools
|
0001| or institutions of higher education, shall not exceed sixty
|
0002| percent of the cost of the insurance. School districts or
|
0003| institutions of higher education may contribute any amount up
|
0004| to one hundred percent of the cost of the insurance; provided
|
0005| that a school district or institution of higher education shall
|
0006| not contribute less than the amounts set forth in Subsection B
|
0007| of this section.
|
0008| D. As used in this section, "cost of the insurance"
|
0009| means the premium required to be paid to provide coverage.
|
0010| [C.] E. When a public employee elects to
|
0011| participate in a cafeteria plan as authorized by the Cafeteria
|
0012| Plan Act and enters into a salary reduction agreement with the
|
0013| governmental employer, the provision of Subsection B of this
|
0014| section with respect to the maximum contributions that can be
|
0015| made by the employer are not violated and will still apply.
|
0016| The employer percentage or dollar contributions as provided in
|
0017| Subsection B of this section shall be determined by the
|
0018| employee's gross salary prior to any salary reduction
|
0019| agreement.
|
0020| [D.] F. Any group medical insurance plan
|
0021| offered pursuant to this section shall include effective
|
0022| cost-containment measures to control the growth of health care
|
0023| costs. The responsible public body that administers a plan
|
0024| offered pursuant to this section shall report annually by
|
0025| September 1 to appropriate interim legislative committees on
|
0001| the effectiveness of the cost-containment measures required by
|
0002| this subsection."
