0011| RELATING TO CRIMINAL OFFENDERS; PROVIDING THAT CERTAIN CRIMINAL
|
0012| OFFENDERS NOT BE LICENSED TO OPERATE A CHILD-CARE FACILITY OR
|
0013| BE EMPLOYED AT A CHILD-CARE FACILITY; AMENDING A SECTION OF THE
|
0014| CRIMINAL OFFENDER EMPLOYMENT ACT.
|

|
0016| BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF NEW MEXICO:
|
0017| Section 1. Section 28-2-4 NMSA 1978 (being Laws 1974,
|
0018| Chapter 78, Section 4, as amended) is amended to read:
|
0019| "28-2-4. POWER TO REFUSE, RENEW, SUSPEND OR REVOKE PUBLIC
|
0020| EMPLOYMENT OR LICENSE.--
|
0021| A. Any board or other agency having jurisdiction
|
0022| over employment by the state or any of its political
|
0023| subdivisions or the practice of any trade, business or
|
0024| profession may refuse to grant or renew or may suspend or
|
0025| revoke any public employment or license or other authority to
|
0001| engage in the public employment, trade, business or profession
|
0002| for any one or any combination of the following causes:
|
0003| (1) where the applicant, employee or licensee
|
0004| has been convicted of a felony or a misdemeanor involving moral
|
0005| turpitude and the criminal conviction directly relates to the
|
0006| particular employment, trade, business or profession;
|
0007| (2) where the applicant, employee or licensee
|
0008| has been convicted of a felony or a misdemeanor involving moral
|
0009| turpitude and the criminal conviction does not directly relate
|
0010| to the particular employment, trade, business or profession, if
|
0011| the board or other agency determines after investigation that
|
0012| the person so convicted has not been sufficiently rehabilitated
|
0013| to warrant the public trust; or
|
0014| (3) where the applicant, [or] employee or
|
0015| licensee has been convicted of trafficking in controlled
|
0016| substances, criminal sexual penetration or related sexual
|
0017| offenses or child abuse and the applicant, [or] employee or
|
0018| licensee has applied for reinstatement or issuance of a
|
0019| teaching certificate, a license to operate a child-care
|
0020| facility or employment at a child-care facility, regardless of
|
0021| rehabilitation.
|
0022| B. The board or other agency shall explicitly state
|
0023| in writing the reasons for a decision which prohibits the
|
0024| person from engaging in the employment, trade, business or
|
0025| profession if the decision is based in whole or in part on
|
0001| conviction of any crime described in Paragraphs (1) and (3) of
|
0002| Subsection A of this section. Completion of probation or
|
0003| parole supervision or expiration of a period of three years
|
0004| after final discharge or release from any term of imprisonment
|
0005| without any subsequent conviction shall create a presumption of
|
0006| sufficient rehabilitation for purposes of Paragraph (2) of Sub-
|
0007|
|
0008| section A of this section."
|
0009| Section 2. EFFECTIVE DATE.--The effective date of the
|
0010| provisions of this act is July 1, 1997.
