0014| DISTRICT ATTORNEYS AND PUBLIC DEFENDERS; AMENDING A SECTION OF

0015| THE NMSA 1978; MAKING AN APPROPRIATION.

0017| BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF NEW MEXICO:
|
0018| Section 1. Section 34-6-5 NMSA 1978 (being Laws 1968,
|
0019| Chapter 69, Section 8, as amended) is amended to read:
|
0020| "34-6-5. JUDGES--SECOND JUDICIAL DISTRICT.--There shall
|
0021| be [twenty-one] twenty-two district judges in the second
|
0022| judicial district."
|
0023| Section 2. TEMPORARY PROVISION--DRUG COURT.--The
|
0024| additional judge provided for in Section 1 of this act shall
|
0025| preside over the operation of a drug court.
|
0001| Section 3. TEMPORARY PROVISION--APPOINTMENT.--The
|
0002| additional judgeship provided for in Section 1 of this act
|
0003| shall be filled by the governor pursuant to Article 6, Section
|
0004| 36 of the constitution of New Mexico.
|
0005| Section 4. APPROPRIATION.--
|
0006| A. Three hundred eighty-nine thousand two hundred
|
0007| dollars ($389,200) is appropriated from the general fund to the
|
0008| following entities in the following amounts for expenditure in
|
0009| fiscal year 1998 for the purpose of establishing a drug court
|
0010| in the second judicial district:
|
0011| (1) one hundred ninety thousand nine hundred
|
0012| dollars ($190,900) to the second judicial district to pay a
|
0013| district court judge's salary and benefits and provide support
|
0014| staff for that judge;
|
0015| (2) one hundred one thousand three hundred
|
0016| dollars ($101,300) to the district attorney's office for the
|
0017| second judicial district to pay for salaries and benefits for
|
0018| two assistant district attorneys; and
|
0019| (3) ninety-seven thousand dollars ($97,000) to
|
0020| the public defender department to pay for salaries and benefits
|
0021| for two public defenders.
|
0022| B. Any unexpended or unencumbered balance remaining
|
0023| at the end of fiscal year 1998 shall revert to the general
|
0024| fund.
|
0025| Section 5. EFFECTIVE DATE.--The effective date of the
|
0001| provisions of this act is July 1, 1997. State of New Mexico

|
0004| SECTIONS OF THE NMSA 1978; MAKING APPROPRIATIONS.

0006| BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF NEW MEXICO:
|
0007| Section 1. Section 34-6-4 NMSA 1978 (being Laws 1968,
|
0008| Chapter 69, Section 7, as amended) is amended to read:
|
0009| "34-6-4. JUDGES--FIRST JUDICIAL DISTRICT.--There shall be
|
0010| [six] seven district judges in the first judicial district."
|
0011| Section 2. Section 34-6-5 NMSA 1978 (being Laws
|
0012| 1968, Chapter 69, Section 8, as amended) is amended to read:
|
0013| "34-6-5. JUDGES--SECOND JUDICIAL DISTRICT.--There shall
|
0014| be [twenty-one] twenty-three district judges in the second
|
0015| judicial district."
|
0016| Section 3. Section 34-8A-4.1 NMSA 1978 (being Laws 1981,
|
0017| Chapter 318, Section 2, as amended) is amended to read:
|
0018| "34-8A-4.1. METROPOLITAN COURT JUDGES--TERMS OF OFFICE--
|
0019| ELECTION.--
|
0020| A. The elected term of office for each judge of the
|
0021| metropolitan court is four years.
|
0022| B. Judges of the metropolitan court who have been
|
0023| previously elected in a partisan election or who were serving
|
0024| as metropolitan judges on January 1, 1989 in divisions one
|
0025| through twelve shall be subject to retention or rejection on a
|
0001| nonpartisan ballot at the 1990 general election for a four-year
|
0002| term ending December 31, 1994.
|
0003| C. Any person appointed to fill a vacancy on the
|
0004| metropolitan court after January 1, 1989 shall serve until the
|
0005| next general election. That person's successor shall be chosen
|
0006| at that general election and shall hold the office until the
|
0007| general election four years later.
|
0008| D. Judges of the Bernalillo county metropolitan
|
0009| court for divisions thirteen, fourteen and fifteen shall be
|
0010| appointed and shall serve until the 1992 general election.
|
0011| Their successors shall be chosen at that general election and
|
0012| shall hold office until the general election four years later.
|
0013| Additional judges shall be appointed and elected pursuant to
|
0014| Article 6 of the constitution of New Mexico."
|
0015| Section 4. Section 34-8A-8 NMSA 1978 (being Laws 1979,
|
0016| Chapter 346, Section 8, as amended) is amended to read:
|
0017| "34-8A-8. METROPOLITAN COURT--BERNALILLO DISTRICT.--
|
0018| A. The name of the metropolitan court in the
|
0019| Bernalillo metropolitan district shall be the "Bernalillo
|
0020| county metropolitan court".
|
0021| B. The metropolitan court is an agency of the judicial
|
0022| department of state government. Personnel of the metropolitan
|
0023| court are subject to all laws and regulations applicable to state
|
0024| officers and agencies and state officers and employees, except
|
0025| where otherwise specifically provided by law.
|
0001| C. There shall be [fifteen] eighteen judges of the
|
0002| Bernalillo county metropolitan court."
|
0003| Section 5. TEMPORARY PROVISION--DRUG COURT.--One of the
|
0004| additional judges provided for the second judicial district in
|
0005| this act shall preside over the operation of a drug court.
|
0006| Section 6. TEMPORARY PROVISION--APPOINTMENT.--The
|
0007| additional district judgeships provided for in this act shall be
|
0008| filled by appointment by the governor pursuant to Article 6 of the
|
0009| constitution of New Mexico for terms beginning July 1, 1997.
|
0010| Section 7. APPROPRIATIONS.--
|
0011| A. The following amounts are appropriated from the
|
0012| general fund to the following entities for expenditure in fiscal
|
0013| year 1998 for the specified purposes:
|
0014| (1) two hundred ninety-seven thousand five
|
0015| hundred seventy-seven dollars ($297,577) to pay the cost of adding
|
0016| an additional judgeship in the first judicial district, including
|
0017| salary and benefits, training and office equipment, furnishings
|
0018| and supplies;
|
0019| (2) four hundred ninety thousand nine hundred
|
0020| dollars ($490,900) to the second judicial district to pay two
|
0021| district court judges' salaries and benefits, provide support
|
0022| staff and purchase furniture and equipment for the judgeships;
|
0023| (3) six hundred twenty-one thousand dollars
|
0024| ($621,000) to the Bernalillo county metropolitan court for the
|
0025| purpose of paying salaries and benefits and providing furniture,
|
0001| equipment and supplies for three judges and support staff;
|
0002| (4) three hundred eighty-eight thousand three
|
0003| hundred dollars ($388,300) to the district attorney's office for
|
0004| the second judicial district to pay for salaries and benefits for
|
0005| assistant district attorneys and support staff; and
|
0006| (5) five hundred sixty-six thousand dollars
|
0007| ($566,000) to the public defender department to pay for salaries
|
0008| and benefits for public defenders and support staff.
|
0009| B. Any unexpended or unencumbered balance remaining at
|
0010| the end of fiscal year 1998 shall revert to the general fund.
|
0011| Section 8. EFFECTIVE DATE.--The effective date of the
|
